Jain, J.<\/p>\n<p> C.M.Nos. 582 &amp; 583\/2000<\/p>\n<p>1. These two applications have been<br \/>\nfiled by the proposed LRs of the deceased appellant<br \/>\nRaghubir Singh praying for restoration of the<br \/>\nappeal\/application under Order 22 Rule 3 CPC dismissed<br \/>\nby the Court on 29-09-1999. It is stated that the<br \/>\nappellant Raghubir Singh dies on 26-01-1999 at the<br \/>\nyoung age of 38 years and during his life time he<br \/>\nhimself was pursuing the present appeal and his wife<br \/>\nand children i.e. proposed LRs had not knowledge about<br \/>\nthe pendency of the present proceedings and they were<br \/>\nrequired to take steps for their substitution in place<br \/>\nof the deceased appellant. Counsel for he appellant<br \/>\ninformed the applicants that the matter was listed<br \/>\nbefore the Court on 10-9-1999 and had been adjourned<br \/>\nto 3-12-1999. However, the matter suddenly appeared<br \/>\nin the list of 20-9-1999 and was dismissed in default.<br \/>\nAs the application for restoration was not moved<br \/>\nwithin time, an application for condensation of delay<br \/>\nhas also been made.\n<\/p>\n<p>2. The application is opposed on behalf<br \/>\nof the respondents mainly on the ground that it<br \/>\nis hopelessly barred by time and is otherwise not<br \/>\nmaintainable as the applicants have not come before<br \/>\nthis Court with clean hands and have suppressed<br \/>\nmaterial facts. It is also stated that on 15-7-1999<br \/>\nwhen the Court ordered issue of notice on the<br \/>\napplication of the respondent to the counsel who had<br \/>\nfiled the present appeal, the counsel appeared on<br \/>\n16-8-1999 and was directed by the Court to inform<br \/>\nwithin a week the date of death of the appellant and<br \/>\nthe matter was adjourned to 10-9-199. On 10-9-1999<br \/>\nthe matter was listed before Court for appropriate<br \/>\norders and adjourned to 20-9-1999 in the presence of<br \/>\nthe counsel. That the absence of the<br \/>\ncounsel\/applicants on 20-9-1999 was without any<br \/>\nsufficient reason or explanation and the<br \/>\nappeal\/substitution application are not liable to be<br \/>\nrestored.\n<\/p>\n<p>3. I have heard the learned counsel for<br \/>\nthe parties and given my thoughtful considerations to<br \/>\ntheir submissions. Having regard to the facts and<br \/>\ncircumstances of the present case, more particularly<br \/>\nto the fact that the appellant died at a young age,<br \/>\nthe possibility of the applicants\/legal<br \/>\nrepresentatives herein of not being in the know of the<br \/>\nproceedings pending in this Court cannot be ruled out.<br \/>\nIt is true that the Counsel for the appellant became<br \/>\naware of the death of the appellant and he was<br \/>\nexpected to take further steps for substitution of<br \/>\nlegal heirs of the deceased appellant and in that view<br \/>\nof the matter he was negligent. However, it is well<br \/>\nsettled that a party should not be penalised for the<br \/>\nnegligence or lapse of the counsel. This Court is,<br \/>\ntherefore, of the considered opinion that it would be<br \/>\nexpedient in the interest of justice to restore the<br \/>\nappeal\/substitution application. The applications are<br \/>\nallowed subject to payment of Rs.2500\/- as costs.\n<\/p>\n<p> CM No. 576\/2000 &amp; 581\/2000 <\/p>\n<p>4. The applicants, who are wife, son and<br \/>\ndaughters of the deceased appellant Ragubir Singh,<br \/>\nseek their substitution in place of the deceased<br \/>\nappellant. The application was not moved within the<br \/>\nprescribed period of limitation and was rather moved<br \/>\nmuch later and an application under Section 5 of the<br \/>\nLimitation Act has been filed for condensation of delay<br \/>\nin filing the application primarily on the ground that<br \/>\nthe appellant had died at a young age and the<br \/>\napplicants were not aware of the present proceedings<br \/>\nand they came to know about the same from the counsel at a later stage and immediately the application was<br \/>\nmoved. The applications are supported by affidavit of<br \/>\nSmt. Jaswinder Kaur wife of the deceased appellant.\n<\/p>\n<p> 5. The applications are opposed mainly<br \/>\non the ground that the application is highly belated<br \/>\nand no sufficient explanation has come forward on the<br \/>\nbasis of which the delay in filing the application can<br \/>\nbe condoned. It is stated that the applicants have<br \/>\nnot come to the Court with clean hands and have rather<br \/>\nsuppressed the material facts.\n<\/p>\n<p>6. The applications have earlier<br \/>\nconsidered and disposed by this Court vide order dated<br \/>\n11-7-2000 which reads as under:-\n<\/p>\n<p> &#8220;CMs 576\/2000, 581\/583\/2000 &amp; SAO 39\/98<\/p>\n<p>The Appellant had died during<br \/>\nthe pendency of this appeal. The<br \/>\nRespondent had moved an application<br \/>\nsaying that no steps have been taken<br \/>\nfor bringing the LRs of the Appellant<br \/>\non record and as such the appeal<br \/>\nabates.\n<\/p>\n<p>Counsel for the Appellant was<br \/>\nrepresented in the application on<br \/>\n16th August, 1999 and 10th September,<br \/>\n1999. Inspite of the application<br \/>\nbeing filed for abatement of the<br \/>\nappeal, no steps were taken by the<br \/>\nappellant for bringing on record the<br \/>\nLRs of deceased Appellant.\n<\/p>\n<p>When the matter was taken up<br \/>\non 20th September, 1999 nobody<br \/>\nappeared on behalf of the Appellant.<br \/>\nThe appeal was accordingly dismissed.\n<\/p>\n<p>Applications have now been<br \/>\nfiled for bringing the LRs on record<br \/>\nand for restoration of the appeal as<br \/>\nwell as for condensation of delay in<br \/>\nfiling these applications.\n<\/p>\n<p> In view of the facts stated<br \/>\nabove, I am not inclined to entertain<br \/>\nthese application. The same are<br \/>\ndismissed.&#8221;\n<\/p>\n<p>7. Aggrieved by the said order the<br \/>\napplicants preferred Special Leave Petition (Civil)<br \/>\nNo. 1220\/2001 before the Hon&#8217;ble Supreme Court and it<br \/>\nwas allowed by an order dated 12th February, 2001<br \/>\nwhich reads as under:-\n<\/p>\n<p>&#8220;Leave granted.\n<\/p>\n<p>Heard learned counsel for<br \/>\nthe parties.\n<\/p>\n<p>The only ground to which we<br \/>\nare impressed, as submitted by the<br \/>\nlearned counsel for the appellant is<br \/>\nthat the application moved by the<br \/>\nappellant for bringing on record the<br \/>\nLRs to restore the appeal which has<br \/>\nbeen dismissed as abated that the<br \/>\nHigh Court has in fact not even<br \/>\nentertained such an application along<br \/>\nwith condensation of delay application<br \/>\nand thus not applied its mind.\n<\/p>\n<p>Having heard learned counsel for the<br \/>\nparties and perusing the impugned<br \/>\norder we find that the High Court<br \/>\nrecord:\n<\/p>\n<p> &#8220;In view of the facts stated<br \/>\nabove, I am not inclined to entertain<br \/>\nthese applications the same are<br \/>\ndismissed&#8221;.\n<\/p>\n<p>We feel that the High Court<br \/>\nby doing this has committed error in<br \/>\nnot entertaining these applications.\n<\/p>\n<p>The proper course for the High Court<br \/>\nis to consider these applications and<br \/>\ndecide in accordance with Law.\n<\/p>\n<p>Accordingly, we set aside the<br \/>\nimpugned order dated 11th July, 2000<br \/>\nand remand the case back to the High<br \/>\nCourt to consider afresh on merits.<br \/>\nThe High Court to dispose of the<br \/>\naforesaid application within eight<br \/>\nweeks from the date of receipt of the<br \/>\ncertified copy of this order which<br \/>\nshould<br \/>\nbe filed and place it before<br \/>\nthe Registrar who shall place the<br \/>\nmatter before Hon&#8217;ble the Chief<br \/>\nJustice for placing the matter before<br \/>\nthe appropriate court. With the said<br \/>\nobservations the appeal stands<br \/>\ndisposed of.&#8221;\n<\/p>\n<p>I have heard the learned counsel for the<br \/>\nparties and have given my thoughtful consideration to<br \/>\ntheir submissions. The arguments which were raised in<br \/>\nsupport of and against the application for restoration<br \/>\nof appeal\/substitution application are also pressed<br \/>\nfor the purpose of these applications as well. There<br \/>\nis no denial of the position that the applications<br \/>\nhave not been vigilant enough about their rights and<br \/>\nhave not taken timely steps for their substitution<br \/>\nwithin the prescribed period of limitation but as<br \/>\nnoticed above there are certain circumstances which<br \/>\nexplain the delay in filing of the application for<br \/>\nsubstitution within time. There is no dispute with<br \/>\nregard to the date of death of the deceased appellant<br \/>\nas also about the applicants being the only legal<br \/>\nheirs who are entitled to pursue the appeal. The<br \/>\ndisposal of the appeal no doubt has been delayed on<br \/>\naccount of the delayed action on part of the<br \/>\napplicants for which I am of the considered opinion<br \/>\nthat the respondent can be adequately compensated. It<br \/>\nwould meet the ends of justice if the delay is<br \/>\ncondoned and the application for substitution of LRs<br \/>\nis allowed and the appeal is heard on merits. The<br \/>\napplications are allowed subject to payment Rs. 2500\/-<br \/>\nas further costs and the applicants are ordered to be<br \/>\nsubstituted in place of the deceased appellant<br \/>\nRaghubir Singh. Amended memo of parties be filed<br \/>\nwithin two weeks.\n<\/p>\n<p>8.
