RADHAKRISHNAN, J.\n\n= = = = = = = = = = = = = = = = = = = = = = = =\n\n           W.P.(C).No.2047 of 2009-R\n\n= = = = = = = = = = = = = = = = = = = = = = = =\n\n    Dated this the 20th day of January, 2009.\n\n                   JUDGMENT\n<\/pre>\n<p>The petitioner availed a loan from the respondent<\/p>\n<p>in 2001. That was not repaid. The respondent<\/p>\n<p>filed a suit and obtained a decree on 20-10-2005.<\/p>\n<p>With  accruals  thereon,  the  outstandings  kept<\/p>\n<p>growing. However, no payment was made. Respondent<\/p>\n<p>initiated proceedings under the SARFAESI Act.<\/p>\n<p>This is under challenge. I do not find any legal<\/p>\n<p>infirmity or jurisdictional error in the impugned<\/p>\n<p>proceedings.\n<\/p>\n<p>Ext.P1 is only a notice under Section 13(2) of<\/p>\n<p>the Act. The petitioner can, therefore, aspire<\/p>\n<p>only to seek relief by requesting the bank to<\/p>\n<p>defer further steps following that notice to<\/p>\n<p>enable   the   petitioner    to   pay   off   the<\/p>\n<p>outstandings. With such a course of action being<\/p>\n<p><span class=\"hidden_text\">WP(C)2047\/2009       -: 2 :-<\/span><\/p>\n<p> available, this writ petition is closed without<\/p>\n<p> prejudice.\n<\/p>\n<\/p>\n<p>                     THOTTATHIL B.
