JUSTICE GOPAL KRISHAN VYAS\n\n\nMrs.Vidhyawati Boda, Public Prosecutor.\n\n\n\n           Heard learned Public Prosecutor.\n\n\n\n           In this leave to appeal the State of Rajasthan is\n\nchallenging judgment dated 16th May, 2008 passed by the\n\nSpecial Judge, N.D.P.S. Cases, Sri Ganganagar in regular\n\ncriminal case No.5\/2007 whereby he has acquitted the accused-\n\nnon-petitioners for the offence under Section 8\/21 of the\n\nN.D.P.S. Act.\n\n\n\n           According to facts of the case, a case was registered\n\nagainst accused-non-petitioners Vinod Kumar and Ved Prakash\n\nfor recovery of 8 gram smack from each of them at the time of\n\nsearch by Manoj Maachra, Police Sub Inspector, P.S. Kotwali. As\n\nper allegations levelled against accused-non-petitioners at the\n\ntime of search, 8 gram smack was found from the pocket of\n\nVinod Kumar and 8 gram smack was found from the pocket of\n                                      2\n\nVed Prakash and both are not possessing any valid licence for\n\nholding said contraband, therefore, they were arrested after\n\ngiving notice under Section 52 of the N.D.P.S. Act. The samples\n\nof 4 gram smack from each were taken and sealed for the\n\npurpose    of   analytic   chemical      examination   by   the   F.S.L.\n\nThereafter, a regular investigation was made and challan was\n\nfiled before the trial court.\n\n\n\n            After filing challan, learned trial court recorded\n\nevidence produced by prosecution as well as recorded the\n\nstatements of accused-non-petitioners under Section 313 Cr.P.C.\n\nIn all 23 prosecution witnesses were produced to prove the case\n\nagainst accused-non-petitioners, but after final hearing, learned\n\ntrial court acquitted accused-non-petitioners from the charges\n\nlevelled against them vide judgment dated 16th May, 2008.\n\n\n\n            Learned Public Prosecutor vehemently argued that\n\njudgment rendered by learned trial court is contrary to the facts\n\nand evidence on record.         It is also submitted that learned trial\n\ncourt has failed to appreciate the evidence in proper manner, so\n\nalso, learned trial court was to consider important aspect of the\n\nmatter that recovery of contraband was made from the exclusive\n\npossession of accused-non-petitioners and that recovery was\n\nproved by way of evidence by prosecution.\n                                   3\n\n\n\n              Learned Public Prosecutor while inviting attention of\n\nthis Court towards the fact that acquittal is totally based upon\n\nthe   main     contention   of   accused-non-petitioners   that   no\n\nindependent witnesses were called at the time of recovery, but in\n\nfact, due to non-availability of independent witnesses, search\n\nwas made in front of other police officials and, therefore, it\n\ncannot be said that recovery was not properly made, so also, it\n\ncannot be accepted that search was not conducted in accordance\n\nwith the provisions of Act. Further it is argued that acquittal is\n\nbased upon aforesaid reasons only, therefore, the judgment is\n\nerroneous and passed without considering evidence in the right\n\nperspective.\n\n\n\n              I have perused the judgment impugned, so also,\n\nconsidered     the   arguments     advanced   by   learned    Public\n\nProsecutor.\n\n\n\n              In my opinion, admittedly, no independent witnesses\n\nwere called although the recovery was made in populated area.\n\nMeaning thereby, the provisions of N.D.P.S. Act was not followed\n\nat the time of making search and recovery from accused-non-\n\npetitioners which is mandatory in nature.      The reason for not\n\ncalling independent witnesses is not accepted. It is also required\n                                                4\n\n             to be observed that learned trial Judge has specifically stated in\n\n             the judgment that no averments were made by the S.H.O. for\n\n             calling independent witnesses at the time of recovery. Meaning\n\n             thereby, the so called contraband which is said to be recovered\n\n             from accused-non-petitioners were not recovered in accordance\n\n             with provisions of N.D.P.S. Act, so also, it is admitted case of\n\n             prosecution that at the time of search and recovery no\n\n             independent    witnesses   were   present   and   contraband   was\n\n             recovered before police officials in the populated area.\n\n\n\n                          In this view of the matter, I am of the opinion that\n\n             the learned trial court has not committed any error while\n\n             acquitting accused-non-petitioners from the charges of recovery\n\n             of 8 gram smack from each of them because prosecution has\n\n             failed to prove its case beyond reasonable doubt.\n\n\n\n                          Hence, this criminal leave to appeal is hereby\n\n             dismissed.\n\n\n\n                                                   (GOPAL KRISHAN VYAS),J.\n<\/pre>\n<p>A.K.
