Heard learned counsel appearing for the petitioners and learned counsel<br \/>\n      appearing for the State.\n<\/p>\n<p>                     Learned counsel appearing for the petitioners submits that all the four<br \/>\n      petitioners have been allotted different Flats having nos.188\/2-4, 189\/2-2, 189\/2-4 and<br \/>\n      189\/2-3 by the Jharkhand State Housing Board. Contiguous to each houses a piece of<br \/>\n      land lies which in terms of the regulation of the Housing Board can be declared to be a<br \/>\n      &#8216;cut piece&#8217; land and according to regulation, priority should be given to these petitioners<br \/>\n      in the matter relating to settlement of cut piece land as the petitioners are having<br \/>\n      houses contiguous to it but the Housing Board is going to settle the land through lottery<br \/>\n      to different persons without giving any offer to the petitioners, hence, the petitioners<br \/>\n      have moved to this Court.\n<\/p>\n<p>                     As against this, learned counsel appearing for the Housing Board submits<br \/>\n      that the land which is being said to be a cut piece land is not, in fact, cut piece land<br \/>\n      and, therefore, Housing Board has proceeded to allot the land through lottery.\n<\/p>\n<p>                     The aforesaid statement has been made without there being any counter<br \/>\n      affidavit and therefore, let a counter affidavit be filed by the Housing Board within one<br \/>\n      week.\n<\/p>\n<p>                     Let this matter be listed after one week.+<br \/>\n                     Any settlement made to a person of the aforesaid land would be subject<br \/>\n      to result of this writ application.\n<\/p>\n<p>                                                                                ( R.R.
