         Petitioner   was   tried   for   the   offence<\/p>\n
punishable under Sections 451 and 435 of IPC. The trial<\/p>\n
Court  found  him  guilty  and  he   was,  accordingly,<\/p>\n
convicted and sentenced to undergo simple imprisonment<\/p>\n
for one month and to pay a fine of Rs.1,000\/- under<\/p>\n
Section 435 of IPC. For the offence under Section 451<\/p>\n
of IPC he was sentenced to undergo simple imprisonment<\/p>\n
for three months and to pay a fine of Rs.500\/-. In<\/p>\n
appeal the Sessions Court confirmed the above Order of<\/p>\n
conviction and sentence. Hence this revision petition.<\/p>\n
    2.   The prosecution case in a nutshell was that<\/p>\n
the petitioner\/accused  had committed trespass into the<\/p>\n
single room tenament (hut) of PW1 at about 10 PM on<\/p>\n
August 6, 1991 and then set fire to certain clothes<\/p>\n
belonging to PW1, PW2 and their children. The value of<\/p>\n
the  clothes  damaged  in  the  fire  was  assessed  at<\/p>\n
Rs.2,000\/-. In support of its case the prosecution had<\/p>\n
examined Pws.1 to 6. Exts.P1 and P2 and MO1 series were<\/p>\n
marked in the case. There was no oral or documentary<\/p>\n
evidence on the side of the defence.\n<\/p>\n<\/p>\n
    3.   PW1 who was none other than the brother-in-law<\/p>\n
of the accused was not admittedly, available at the<\/p>\n
residence  when  the   alleged  crime  was   committed.<\/p>\n
According to him, he came to know about the incident on<\/p>\n
the next day. He went to the police station and<\/p>\n
reported the matter. The police recorded Ext.P1 First<\/p>\n
Information Statement. Accordingly,    Ext.P1(a) First<\/p>\n
Information Report was registered.\n<\/p>\n<\/p>\n
    4.   PW2, the wife of PW1 deposed before the Court<\/p>\n
that she and PW3, her sister-in-law (her husband’s<\/p>\n
sister) had gone to her uncle’s residence in the<\/p>\n
neighbourhood for spending the night there, since PW1<\/p>\n
was not at home. According to PW2 the accused had come<\/p>\n
to their residence during the night. She and PW3 saw<\/p>\n
the accused when they came out of the house to attend<\/p>\n
the call of nature. On the next day, it was found that<\/p>\n
some clothes had been burnt by fire. In short, PW2 did<\/p>\n
not see the accused setting fire to the   clothes. She<\/p>\n
further stated that she could not say as to how the<\/p>\n
clothes happened to be burnt. PW3 is the wife of the<\/p>\n
accused (sister of PW1). According to this witness, she<\/p>\n
had been living separately from her husband because of<\/p>\n
ill-treatment  for the last two years. PW3 deposed that<\/p>\n
she accompanied  PW2 to the residence of her uncle. She<\/p>\n
also stated that the accused had come to the residence<\/p>\n
of PW1, in the night. At that time, they had gone to<\/p>\n
the neighbouring house. But she stated that she had<\/p>\n
come out of the house to attend the call of nature at<\/p>\n
about 10 PM. At that time, she saw somebody lighting<\/p>\n
the torch. Then she saw some smoke. She went and tried<\/p>\n
to find out what had happened. She also stated that she<\/p>\n
saw the accused and identified him.\n<\/p>\n<\/p>\n
    5.   PW4 attested Ext.P2 Scene Mahazar. PW5 Head<\/p>\n
Constable  stated  that  he  had  recorded   the  First<\/p>\n
Information  Statement   and   registered   the   First<\/p>\n
Information  Report.  PW6  who  was  the  Investigating<\/p>\n
Officer spoke about the process of investigation.<\/p>\n
    6.   PW2 and PW3 are the prime witnesses on the<\/p>\n
side of the prosecution. It was admitted by PW2 and PW3<\/p>\n
that they had slept in the house of the uncle of PW1 on<\/p>\n
that night. PW2 admitted that she did not see the<\/p>\n
accused setting fire to the    clothes. Of course, she<\/p>\n
deposed that the accused had come to the house in the<\/p>\n
night while she was in     uncle’s house. Her husband<\/p>\n
(PW1) was away. Interestingly PW3 stated that she and<\/p>\n
PW2 had come out of the house at about 10 PM to attend<\/p>\n
the call of nature. At that time, she saw somebody with<\/p>\n
a torch and a little later, late  she found some smoke.<\/p>\n
According to PW3, she went to scene of occurrence on<\/p>\n
seeing the smoke and found the accused there. But PW2<\/p>\n
did not have such a case at all.\n<\/p>\n
    7.   There is yet another aspect to be noted.   PW2<\/p>\n
had stated that she had gone to the police station on<\/p>\n
the next day (August 7, 1993). The police had recorded<\/p>\n
her statement and obtained her signature. But the<\/p>\n
statement had never seen the light of the day. On the<\/p>\n
contrary,  the prosecution had produced Ext.P1 First<\/p>\n
Information Statement admittedly given by PW1 on the<\/p>\n
next day of the incident. There is no explanation as to<\/p>\n
what  happened to the signed statement of PW2, which<\/p>\n
according to her, was recorded by the police first.<\/p>\n
Though, there is some force in the contention by the<\/p>\n
learned public prosecutor that the deposition of PW2<\/p>\n
and PW3 are quite natural and trustworthy. I am not<\/p>\n
satisfied that  the accused can be convicted solely on<\/p>\n
the basis of the identification made by his estranged<\/p>\n
wife, particularly, since the prosecution had failed to<\/p>\n
give any plausible explanation for its omission to<\/p>\n
produce the statement of PW2 which was the earliest one<\/p>\n
recorded by the police.\n<\/p>\n<\/p>\n
         Having  regard   to  the   entire  facts   and<\/p>\n
circumstances of the case, I am satisfied that the<\/p>\n
petitioner is entitled to get the benefit of doubt.<\/p>\n
Therefore, the order of conviction and sentence against<\/p>\n
the petitioner is set aside. Revision petition is<\/p>\n
allowed.\n<\/p>\n<\/p>\n
