Mujtaba Ahmad\n                                    Versus\n                            The State Of Bihar\n                                  -----------\n<\/pre>\n<p>2   22.07.2011              Heard learned counsel for the petitioner as<\/p>\n<p>                        well as learned counsel for the State.<\/p>\n<p>                             The petitioner has surrendered before the<\/p>\n<p>                        Court below and is custody in connection with<\/p>\n<p>                        Barauni P.S. Case No. 322 of 2009 under<\/p>\n<p>                        Sections 302\/34 of the I.P.C.         registered on<\/p>\n<p>                        24.10.2009.\n<\/p>\n<p>                             It is submitted by the learned counsel for<\/p>\n<p>                        the petitioner that the informant, who is the wife<\/p>\n<p>                        of the deceased, neither named him in the FIR<\/p>\n<p>                        nor in the protest petition filed later on.<\/p>\n<p>                             He further submits that the other accused in<\/p>\n<p>                        the case have also not taken name of the<\/p>\n<p>                        petitioner. He states that the petitioner is over 70<\/p>\n<p>                        years old being a retired Government Teacher<\/p>\n<p>                        and there is nothing to connect him to the said<\/p>\n<p>                        crime. He has been made accused by the police<\/p>\n<p>                        on the very flimsy ground that there was some<\/p>\n<p>                        suspicion and the petitioner is in custody since<\/p>\n<p>                        28.3.2011.\n<\/p>\n<p>                             Considering the facts and circumstances of<\/p>\n<p>                        the case, let the petitioner be released on bail<br \/>\n<span class=\"hidden_text\">          2<\/span><\/p>\n<p>        upon furnishing bail bond to Rs 10,000\/- along<\/p>\n<p>        with two sureties of like amount each to the<\/p>\n<p>        satisfaction of the Chief Judicial Magistrate,<\/p>\n<p>        Begusarai in Barauni P.S.
