THOMAS\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t O R D E R<br \/>\n     This Court\t by  order dated November 16, 1995 dismissed<br \/>\nthe special  leave petition  on the ground that the original<br \/>\npetitioner had died on September 1, 1993 and the application<br \/>\nto bring  the legal  representatives on\t record was filed on<br \/>\nJanuary 27,  1994 and  , therefore,  the  application  stood<br \/>\nabated. It  is not  in dispute\tthat the original petitioner<br \/>\ndied on\t September 1,  1993. By\t operation of Article 120 of<br \/>\nthe Schedule to the Limitation Act, 1963, the application to<br \/>\nbring on  record the  legal representatives  of the  decease<br \/>\nplaintiff or  defendant, should be filed within 90 days from<br \/>\nthe date  of the  death of  the plaintiff\/defendant.  If the<br \/>\napplication is\tnot filed  within the  date,  the  abatement<br \/>\ntakes place.  As contemplated in Article 121 of the Schedule<br \/>\nwhich envisages\t that for  seeking an order to set aside the<br \/>\nabatement, the\tapplication need  to be filed within 60 days<br \/>\nfrom the  date of  the adatement.  In this  case, since\t the<br \/>\noriginal  petitioner   died  on\t  September  1,\t  1993,\t the<br \/>\napplication was required to be filed within 90 day from that<br \/>\ndate which,  no doubt,\twas not\t filed. So,  abatement\ttook<br \/>\nplace.\tThereafter,   the  application\t to  set  aside\t the<br \/>\nadatement was  filed on\t January 27, 1994 which is within 60<br \/>\ndays. Though  at that  stage the  action had abated, for the<br \/>\nreasons stated\tin the application, the adatement stands set<br \/>\naside. The  Petition for  setting  aside  the  abatement  is<br \/>\naccordingly allowed.\n<\/p>\n<p>     We have  heard the\t case on  merits. The  case  of\t the<br \/>\nrespondent is that the has come into possession by virtue of<br \/>\nlease granted  by the landlord and he has been in possession<br \/>\nfor well  over 20  years. In  paragraph 7 of the judgment of<br \/>\nthe division  Bench of\tthe High Court dated August 29, 1990<br \/>\nmade in\t CRP No.  4171\/75,  it\thas  pointed  out  that\t the<br \/>\nrespondent came into lawful possession of the property under<br \/>\na lease\t deed though  the same\twas found  to  be  defective<br \/>\nSection 7-B the Kerala Land Reforms Act postulates thus:\n<\/p>\n<blockquote><p>     &#8220;Notwithstanding  anything\t to  the<br \/>\n     contrary contained in any law or in<br \/>\n     any contract,  custom or  usage, or<br \/>\n     in any  judgment, custom  or usage,<br \/>\n     or in any judgment, decree or order<br \/>\n     of Court,\tany person in occupation<br \/>\n     of\t the  land  of\tanother\t at  the<br \/>\n     commencement  of  the  Kerala  Land<br \/>\n     Reforms (Amendment)  Act,\t1969  on<br \/>\n     the  basis\t of  a\tregistered  deed<br \/>\n     purporting to be a lease deed shall<br \/>\n     be deemed\tto be  a tenant if he or<br \/>\n     his predecessor-in-interest  was in<br \/>\n     occupation of  such land\t on  the<br \/>\n     11th day  of  April,  1957\t of  the<br \/>\n     basis of that deed, notwithstanding<br \/>\n     the fact that the lease was granted<br \/>\n     by a  person who  had no right over<br \/>\n     the land  or who  was not competent<br \/>\n     to lease the land.<\/p><\/blockquote>\n<p>     A\t  reading    thereof\tclearly\t   envisages\tthat<br \/>\nnotwithstanding anything  to the  contrary contained  in any<br \/>\nlaw or in any contract, custom or usage, or in any judgment,<br \/>\ndecree or  order of   the Court, any parson in occupation of<br \/>\nthe land..  on the  basis of a registered deed purporting to<br \/>\nbe a lease deed, shall be deemed to be a tenant if he or his<br \/>\npredecessor in\tinterest was  in occupation  of such land on<br \/>\nthe 11th  day of  April, 1957  on the  basis of\t that  deed,<br \/>\nnotwithstanding the  fact that\tthe lease was granted by the<br \/>\nperson who  had no  title over\tthe  land  or  who  was\t not<br \/>\ncompetent to  lease the\t land. Thus,  it would be seen that,<br \/>\nthough there  is a  defect in  the conferment  of  right  to<br \/>\npossession under  registered lease deed and in such a defect<br \/>\na person  who remained\tin lawful  possession is entitled to<br \/>\noccupancy right,  the High  Court has found, as a fact, that<br \/>\nthe respondent\thaving come  into lawful  possession of\t the<br \/>\nland by\t virtue of  defective lease  deed his  possession is<br \/>\nprotected under\t Section 7-B of the Kerala Land Reforms Act.<br \/>\nTherefore, we do not find any merit warranting interference.\n<\/p>\n<p>     The special  leave petition  is accordingly  dismissed.<br \/>\nThe Review petition is allowed accoringly.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Puthiya Purayil Kannan&#8217;S Widow &#8230; vs Patinhare Koyyattan Balan &amp; Ors on 21 March, 1997 Bench: K.
