PATTANAIK (J)\n\nCITATION:\n JT 1996 (7)   468\t  1996 SCALE  (6)247\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t O R D E R<br \/>\n     Leave granted.\n<\/p>\n<p>     We have heard learned counsel on both sides.<br \/>\n     This appeal  by special  leave arises against the order<br \/>\nof the\tA.P. Admn. Tribunal, Hyderabad dated 10.11.1995 made<br \/>\nin O.A.\t No.1499\/94. The  admitted facts are that to fill up<br \/>\nthe post  of Chairman,\tthe  Chairman  of  the\tMunicipality<br \/>\ncalled for  names from\tthe employment\texchange.  When\t the<br \/>\nnames were  sent preceding the selection, the Chairman was a<br \/>\ncompetent authority  to make  selection without\t any counter<br \/>\nverification of\t the process  of selecting  the\t candidates,<br \/>\npursuant to  the  Government  Memorandum  No.372,  Municipal<br \/>\nAdministration dated  February 18,  1992. The Government, on<br \/>\nbecoming aware\tof the\tmal-practice being  committed in the<br \/>\nmethod of  recruitment of  the\tcandidates  and\t that  undue<br \/>\nfavouratism was\t being shown,  have issued  G.O. No.413,  MA<br \/>\ndated March 10, 1992 under which though the Committee headed<br \/>\nby the\tChairman of the Municipality was competent to select<br \/>\nthe candidates,\t it was required to be counter-verified by a<br \/>\ncommittee  consisting\tof  District  Collector\t (Convener),<br \/>\nDistrict Educational  Officer  in  case\t of  recruitment  of<br \/>\nMunicipal  School   teachers,  Regional\t Joint\tDirector  of<br \/>\nMunicipal   Administration    and   Municipal\tCommissioner<br \/>\nconcerned, was\tconstituted to\tscrutinise the selection and<br \/>\nthen on\t the basis  of\tthe  recommendations  so  made,\t the<br \/>\nappointment would  be made.  This was  issued with a view to<br \/>\neliminate   mal-practices    in\t  the\tselection   process.<br \/>\nAdmittedly, the selection had taken place on March 28, 1992.<br \/>\nThough the  Commissioner had pointed out in his note that no<br \/>\norder of appointment would be issued pending the scrutiny by<br \/>\nthe Supervisory\t Committee nominated in the above Government<br \/>\norder,\tyet   the  Chairman   chose  to\t  proceed  with\t the<br \/>\nappointment; but  the Committee,  in the  meanwhile, had met<br \/>\nand recorded  that the\trespondent who\twas selected  by the<br \/>\nChairman had passed only SSC with 207 marks while one of the<br \/>\ncandidates Shri\t Kollu Satyanarayana was a B.A. graduate and<br \/>\nsecured 224  marks with SSC examination. No reason was given<br \/>\nas to  why  a  better  candidate  was  not  preferred  to  a<br \/>\ncandidate   who\t   secured   lesser   marks.   Under   those<br \/>\ncircumstances, the respondent had gone to the Tribunal for a<br \/>\ndirection.  The\t  Tribunal  had\t  issued  a   direction\t for<br \/>\nappointment of\tthe respondent. The Tribunal held that under<br \/>\nSection 74 of the Municipalities Act, 1965, the Chairman was<br \/>\nthe competent  authority on  the date  the selection process<br \/>\nwas initiated  the above  G.O. had  not come into force and,<br \/>\ntherefore, the\tChairman  was  the  competent  authority  to<br \/>\nselect and appoint the candidate. Accordingly, the direction<br \/>\ncame to be issued. Thus this appeal by special leave.\n<\/p>\n<p>     It cannot\tbe disputed  that  as  on  that\t date  under<br \/>\nSection 74, the Chairman was the competent authority to make<br \/>\nappointment of\tthe staff of the municipality. Subsequently,<br \/>\nthe Act\t came to  be amended in 1994 giving the power to the<br \/>\nCommissioner of\t the Municipality  with\t which\twe  are\t not<br \/>\nconcerned. Though the selection process had started as names<br \/>\nhad  been  from\t the  employment  exchange  on\tthe  day  of<br \/>\nselection, namely,  March 28, 1992, G.O. was in force w.e.f.<br \/>\nMarch 10,  1992.  Consequently,\t any  selection\t made  by  a<br \/>\nCommittee headed  by the  Chairman would  be subject  to the<br \/>\nscrutiny by the Scrutiny Committee referred to hereinbefore,<br \/>\nIn spite  of the  fact that the Commissioner had pointed out<br \/>\nthe above rule and had also issued directions not to proceed<br \/>\nwith finalisation  of selection\t and the  Scrutiny Committee<br \/>\nhaving\tpointed\t  out\tthe   irregularity   of\t  selection,<br \/>\nnonetheless  selection\t came  to  be  finalised  which\t the<br \/>\nTribunal has  directed to  be implemented.  Under the  above<br \/>\ncircumstances, we  are of the view that the Tribunal was not<br \/>\njustified in giving direction to make the appointment of the<br \/>\nrespondent.\n<\/p>\n<p>     The appeal is dismissed. It is open to the Municipality<br \/>\nto conduct  fresh selection  to\t the  post  and\t select\t the<br \/>\ncandidates according  to the  qualifications and  merits and<br \/>\nproceed with the appointments as per the rules.
