Justice R.BASANT\n\n Dated :25\/06\/2007\n\n O R D E R\n                              R.BASANT, J.\n\n                           ----------------------\n\n                           B.A.No.3805  of 2007\n\n                       ----------------------------------------\n\n                Dated this the  25th     day of June 2007\n\n\n\n\n                                  O R D E R\n<\/pre>\n<p>      Application   for   regular   bail.     The   petitioner   is   the   fifth<\/p>\n<p>accused in a crime registered inter alia under Sections 326 and<\/p>\n<p>307   read   with   149   I.P.C.     The   alleged   incident   took   place   on<\/p>\n<p>17\/9\/2006.     The victim has allegedly  suffered a grievous injury.<\/p>\n<p>Altogether   there   are   fifteen   accused   persons.     There   are   three<\/p>\n<p>injured persons.   The petitioner was arrested on 15\/6\/2007.  He<\/p>\n<p>continues in custody from that date.\n<\/p>\n<\/p>\n<p>      2.     The   learned   counsel   for   the   petitioner   submits   that<\/p>\n<p>the petitioner is absolutely innocent.  The petitioner may now be<\/p>\n<p>enlarged  on  bail  subject  to  appropriate  conditions,  it  is prayed.<\/p>\n<p>The   learned   Public   Prosecutor   opposes   the   application.     The<\/p>\n<p>learned Public Prosecutor only prays that some further time may<\/p>\n<p>be   granted   to   the   investigators   to   complete   the   investigation<\/p>\n<p>before the petitioner is released from custody.       I am satisfied<\/p>\n<p>in these circumstances that bail can be granted to the petitioner<\/p>\n<p>subject to appropriate conditions.\n<\/p>\n<p>\n<span class=\"hidden_text\">B.A.No.3805\/07                            2<\/span><\/p>\n<p>       3.      In  the result, this  petition  is  allowed.    The petitioner<\/p>\n<p>shall be released on bail on the following terms and conditions:<\/p>\n<p>       i)      The   petitioner   shall   not   be   released   on   bail   on   the<\/p>\n<p>strength of this order prior to 02\/07\/2007.
