Justice K.HEMA\n\n Dated :21\/06\/2010\n\n O R D E R\n                             K.HEMA, J.\n           ----------------------------------------------\n               Bail Application No.3720 of 2010\n           ----------------------------------------------\n                     Dated 21st June, 2010.\n\n                              O R D E R\n<\/pre>\n<p>           This petition is for bail.\n<\/p>\n<p>           2. The alleged offences are under Sections 143, 145,<\/p>\n<p>147, 148, 341 and 353 read with Section 149 of the Indian Penal<\/p>\n<p>Code and Section 3(1) of the Prevention of Damage to Public<\/p>\n<p>Property Act. According to prosecution, on 12.10.2009, at about<\/p>\n<p>6.25 p.m., an unlawful assembly was formed and in prosecution of<\/p>\n<p>the common object of the assembly, pelted stones and sticks<\/p>\n<p>towards police party, who were on law and order duty and caused<\/p>\n<p>damage to a police Jeep, causing a loss of Rs.5,000\/-.<\/p>\n<p>           3.   Learned counsel for petitioner submitted that<\/p>\n<p>petitioner was arrested in connection with crime no.410\/09, in<\/p>\n<p>which he was first accused. Petitioner is thereafter, implicated in<\/p>\n<p>the present case as the 70th accused. He is absolutely innocent of<\/p>\n<p>the allegations made.\n<\/p>\n<p>           4. Learned Public Prosecutor submitted that petitioner<\/p>\n<p>is involved in two other crimes of similar nature and hence this<\/p>\n<p>petition is opposed.     Petitioner is 70th accused and he was<\/p>\n<p><span class=\"hidden_text\">BA NO.3720\/10                    2<\/span><\/p>\n<p>arrested in connection with another case, on 7.5.2010 and his<\/p>\n<p>formal arrest was recorded in this case on 25.5.2010, when he<\/p>\n<p>was caused to be produced before the court as per a production<\/p>\n<p>warrant. The offence alleged against him is of serious nature.<\/p>\n<p>           5.      On hearing both sides and considering the<\/p>\n<p>circumstances under which petitioner was implicated, I find that<\/p>\n<p>bail can be granted to petitioner on conditions. Hence, the<\/p>\n<p>following order is passed :\n<\/p>\n<blockquote><p>           Petitioner shall be released on bail on his executing a<\/p>\n<p>           bond for Rs.25,000\/- (Rupees twenty five thousand<\/p>\n<p>           only) with two solvent sureties each for the like sum to<\/p>\n<p>           the satisfaction of the court concerned, on the<\/p>\n<p>           following conditions :<\/p>\n<blockquote>\n<\/blockquote>\n<blockquote><p>                (i) Petitioner shall report before the Investigating<\/p>\n<p>                      Officer   on every Monday      and Thursday<\/p>\n<p>                      between 10 a.m. and 1 p.m. until further<\/p>\n<p>                      orders.<\/p><\/blockquote>\n<\/blockquote>\n<blockquote>\n<\/blockquote>\n<blockquote><p>                (ii)  Petitioner shall not enter the limits of the<\/p>\n<p>                      police   station, within   which    crime   is<\/p>\n<p><span class=\"hidden_text\">BA NO.3720\/10                  3<\/span><\/p>\n<p>                    registered,   except   for   compliance       of<\/p>\n<p>                    condition no.1<\/p>\n<\/blockquote>\n<blockquote><p>              (iii)  Petitioner shall not influence or intimidate<\/p>\n<p>                    any witness or tamper with evidence.<\/p>\n<\/blockquote>\n<blockquote><p>              (iv)  In case the petitioner    is involved in any<\/p>\n<p>                    offence of similar nature, his bail is liable to<\/p>\n<p>                    be cancelled.\n<\/p><\/blockquote>\n<blockquote><p>                         Petition is allowed.\n<\/p><\/blockquote>\n<blockquote>\n<\/blockquote>\n<blockquote><p>                                          K.HEMA, JUDGE.\n<\/p><\/blockquote>\n<p>tgs<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Kuttil Othayoath Shabeer vs State Of Kerala on 21 June, 2010 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 3720 of 2010() 1.
