Justice C.N.RAMACHANDRAN NAIR\n\n Dated :15\/01\/2007\n\n O R D E R\n                  C.N.RAMACHANDRAN NAIR, J.\n\n                           --------------------------\n\n                       W.P.(C)No.1259 OF 2007\n\n                           --------------------------\n\n              Dated this the 15th  day of January, 2007\n\n\n                             J U D G M E N T\n<\/pre>\n<p>      Petitioner   is   challenging   an   order   determining   Motor<\/p>\n<p>Transport   workers   Welfare   Fund   confirmed   in   appeal.   On   the<\/p>\n<p>posting   date,   counsel   could   not   appear   on   personal   reasons.<\/p>\n<p>However,   appeal   was   dismissed   without   deferring   it,   against<\/p>\n<p>which this writ petition is filed.  On hearing the matter on merits,<\/p>\n<p>I find demand is only for two workers.  For that period petitioner<\/p>\n<p>admittedly operated the stage carriage.  This court has held that<\/p>\n<p>at a time four workers are required to operate a stage carriage<\/p>\n<p>and   so   much   so   petitioner   cannot   have   any   grievance   against<\/p>\n<p>demand of contribution for two workers.\n<\/p>\n<\/p>\n<p>      2.      In   such   circumstances   and   in   petitioner&#8217;s   own<\/p>\n<p>interest,   I   decline   to   remand   for   hearing   before   the   appellate<\/p>\n<p>authority.     However   having   regard   to   the   financial   hardship<\/p>\n<p>expressed   by   the   petitioner,   petitioner   is   granted   three   equal<\/p>\n<p>monthly   instalments   to   clear   the   arrears   exclusive   of   collection<\/p>\n<p>charges.        Petitioner   will   make   payments   before   the   2nd<\/p>\n<p>respondent.   First instalment will be paid on or before 20.2.2007<\/p>\n<p><span class=\"hidden_text\">W.P.(C)No.1259\/2007                    2<\/span><\/p>\n<p>and   the   balance   will   be   paid   on   or   before   20th  of   the   two<\/p>\n<p>succeeding   months.
