One of the two suits was a Civil Suit which was<br \/>\n\tregistered as Civil Suit No. B-4\/1994. In respect of which a decree<br \/>\n\tdated 28.8.1998 for a sum of Rs.3,09,600\/- allowing interest @ of<br \/>\n\t15% per annum, came to be passed. Mr. Gandhi further submitted that<br \/>\n\tafter the decree was passed and before the execution proceedings<br \/>\n\twere initiated, compromise between the bank and the<br \/>\n\tpetitioners-borrowers, who happened to be the original borrowers<br \/>\n\tagainst whom the decree came to be passed, was entered into on<br \/>\n\t19.7.2000 by which, the petitioners agreed  to pay lumusum amount of<br \/>\n\tRs.5,23,700\/- towards full satisfaction of the decree and the bank<br \/>\n\taccepted the said settlement. Mr. Gandhi has further submitted that<br \/>\n\tsubsequently i.e. within 15 days from the date of the said<br \/>\n\tcompromise, the petitioners paid a sum of Rs.5,05,182\/-. Having said<br \/>\n\tthus, he has made a grievance that though the aforesaid amount was<br \/>\n\tpaid by the petitioners which was required to be credited against<br \/>\n\tthe decree dated 28.8.1998 in Civil Suit No. B-4\/1994 towards full<br \/>\n\tand satisfactory discharge of the decree, the bank seems to have<br \/>\n\tcredited the aforesaid amount in some other account and has not<br \/>\n\tgiven credit of the said amount in favour of the petitioners. He has<br \/>\n\talso made grievance that without giving credit to the aforesaid<br \/>\n\tpayment, bank has initiated and is prosecuting the execution<br \/>\n\tproceedings in respect of the decree on 28.8.1998 in Civil Suit<br \/>\n\tNo.B-4\/1994 and therefore the petitioners are constrained to prefer<br \/>\n\tpresent petition.\n<\/p>\n<p>Mr.\n<\/p>\n<p>\tThakkar, learned advocate for the respondent has resisted the<br \/>\n\tpetition stating, inter alia, that in respect of the dispute raised<br \/>\n\tin the petition, it does not deserve to be entertained.\n<\/p>\n<p>The<br \/>\n\tpetition involves disputed questions of fact which would require the<br \/>\n\tparty to lead appropriate evidence, oral and\/or documentary in<br \/>\n\tsupport of the rival contentions. The Code of Civil Procedure<br \/>\n\tprescribes appropriate procedure for the aforesaid purpose<br \/>\n\tparticularly under Rule 2 of Order 21 and other provisions under<br \/>\n\tOrder 21.\n<\/p>\n<p>In<br \/>\n\tthat view of the matter, learned advocate    Mr. Gandhi has<br \/>\n\tsubmitted that the petitioners will take out appropriate<br \/>\n\tapplication-proceedings before the learned Executing Court so as to<br \/>\n\testablish the fact that the amount of Rs.5,05,182\/- has already been<br \/>\n\tpaid by the petitioners-borrowers pursuant to the above referred<br \/>\n\tsettlement. However, the bank has not given credit of the said<br \/>\n\tpayment in favour of the petitioners-borrowers. He also submitted<br \/>\n\tthat so as to approach the learned Executing Court for the said<br \/>\n\tpurpose, he does not press the petition at this stage.\n<\/p>\n<p>In<br \/>\n\tview of the said statement and submission  the petition stands<br \/>\n\tdisposed of as not pressed so as to enable the petitioners-borrowers<br \/>\n\tto take out appropriate proceedings before the learned Executing<br \/>\n\tCourt so as to place relevant facts on record and make appropriate<br \/>\n\trequest with regard to the maintainability and justifiability of the<br \/>\n\texecution proceedings. Rule is discharged. Ad-interim relief\/interim<br \/>\n\trelief if any, stands vacated.
