1.\t\tRULE.\n<\/p>\n
 Learned Additional Public Prosecutor Ms. Manisha L. Shah waives
\nservice of Rule on behalf of the respondent-State.  In the facts and
\ncircumstances of the case, the matter is taken up for hearing today.\n<\/p>\n
2.\t\tThis
\nis an application filed under Section 438 of the Code of Criminal
\nProcedure seeking anticipatory bail in connection with C. R. bearing
\nNo. I-46 of 2008 dated 30-05-2008 registered with the Bavlu Police
\nStation, District:- Mehsana for the offences punishable under Section
\n325, 324 and 114 of the Indian Penal Code and Section 135 of the
\nBombay Police Act.\n<\/p>\n
3.\t\tLearned
\nAdvocate Mr. Mehul Rathod for the applicant submitted that
\nconsidering the role played by the applicant which is reflected in
\nthe FIR which is produced at Annexure-A, it is a fit case to release
\nthe applicant on anticipatory bail.  The applicant would abide by the
\nterms and conditions which the Hon’ble Court may impose on him.\n<\/p>\n
4.\t\tAs
\nagainst the aforesaid submission, learned Additional Public
\nProsecutor Ms. Manisha L. Shah submitted that considering the FIR at
\nAnnexure-A, the role attributed to the applicant, it becomes clear
\nthat it is not a fit case to enlarge the applicant on anticipatory
\nbail.\n<\/p>\n
5.\t\tHaving
\nheard the learned Counsel of both the sides and on perusal of the
\naverments made in the application as well as the FIR at Annexure-A,
\nthe applicant is involved in Sections 325, 324 and 114 of the Indian
\nPenal Code and Section 135 of the Bombay Police Act.  The nature of
\nthe involvement of the applicant is considered by me.\n<\/p>\n
6.\t\tIn
\nview of the aforesaid facts and circumstances of the case, I am
\ninclined to use my discretion in favour of the applicant without
\nentering into the merits of the case at this stage.\n<\/p>\n
7.\t\tFor
\nthe foregoing reasons, the application is allowed.  In the event of
\narrest of the petitioner in connection with C. R. bearing No. I-46 of
\n2008 dated 30-05-2008 registered with the Bavlu Police Station,
\nDistrict:- Mehsana for the offences punishable under Sections 325,
\n324 and 114 of the Indian Penal Code and Section 135 of the Bombay
\nPolice Act, he shall be released on bail on executing a bond of
\nRs.10,000\/- [Rupees Ten Thousand Only] with one surety of the like
\namount on the following conditions that he shall:\n<\/p>\n
[a]\tco-operate
\nwith the investigation and make himself available for interrogation
\nwhenever and wherever required;\n<\/p>\n
[b]\tshall
\nremain present at the concerned Police Station on 23-07-2008 July
\n2008 between 9.00 AM to 3.00 PM;\n<\/p>\n
[c]\tshall
\nnot hamper the investigation in any manner nor shall directly or
\nindirectly make any inducement, threat or promise to any person
\nacquainted with the facts of the case so as to dissuade them from
\ndisclosing such facts to the Court or to any police officer;\n<\/p>\n
[d]\tat
\nthe time of execution of bond, furnish his residential address to the
\nInvestigating Officer and the Court concerned and shall not change
\nthe residence till the final disposal of the case or till further
\norders;\n<\/p>\n
[e]\tnot
\nleave India without the permission of the Court and, if holding a
\npassport, he shall surrender the same before the trial Court within a
\nweek; and,<\/p>\n
[f]\tnot
\nobstruct or hamper the police investigation and not play mischief
\nwith the evidence collected or yet to be collected by the police.\n<\/p>\n
8.\t\tIt
\nwould be open to the Investigating Officer to file an application for
\nremand if he considers it proper and just; and the competent Court
\nwould decide it on merits.\n<\/p>\n
9.\t\tThis
\norder will hold good, if the petitioner is arrested at any time
\nwithin 90 days from today.  The order for release on bail will remain
\noperative only for a period of ten days from the date of his arrest.
\nThereafter, it will be open to the petitioner to make a fresh
\napplication for being enlarged on bail in usual course, which, when
\nit comes up before the competent Court, will be decided in accordance
\nwith law, having regard to all the attending circumstances and the
\nmaterials available at the relevant time, without being influenced by
\nthe fact that anticipatory  bail was granted.\n<\/p>\n
10.\t\tRule
\nis made absolute.   Direct Service is permitted.\n<\/p>\n
