Criminal Justice breaks down at a point when\nexpeditious  trial  is\tnot  attempted\twhile  the  affected\nparties are languishing in jail. The Criminal Procedure Code\nin Sections  167, 209  and 309 has emphasised the importance\nof expeditious\tdisposal of  cases including  investigations\nand trials. [786E]\n     2. The  State Government to take a policy decision with\na view\tto ensure  that accused persons, too indigent to set\nin motion  the judicial process, do not suffer incarceration\nsilently. [787B]\n     3. The  Government will  do well  to  comply  with\t the\nspirit of  the Code  of Criminal Procedure especially in the\nmatter\tof   persons  sought  to  be  bound  over  for\tgood\nbehaviour, persons  against whom  summons cases\t are pending\nand persons  who have  been in\tcustody for  more  than\t six\nmonths This  will involve  a mass  release from\t jails,\t but\nGovernment has to pay homage in substance and reality to the\nprovisions of the Constitution and the Code. [787C]\n     The Court directed that :-\n     (a) The  State do\tconsent to  release all\t persons who\nhave been  in custody  for over\t six months and whose trials\nhave not  commenced or\tagainst whom  charge sheets have not\nbeen laid  excepting in\t those cases  under Sections 302 and\n395 I.P.C. Mukherjee for the Respondents.\n<\/p>\n<p>     The Order of the Court was delivered by<br \/>\n     KRISHNA IYER, J.-This is a petition for the issuance of<br \/>\na writ of habeas corpus in view of alleged illegal detention<br \/>\nof a  large number  of persons\tunder guise  of the judicial<br \/>\nprocess.\n<\/p>\n<p><span class=\"hidden_text\">786<\/span><\/p>\n<p>     Even without  going into details, we are satisfied that<br \/>\npetitioners Nos.  3 and\t 4 should  be released\ton their own<br \/>\nbonds to  the satisfaction  of the  trial court\t subject  to<br \/>\ntheir reporting\t to the\t nearest police\t station once  every<br \/>\nfortnight and  appearing in court whenever called upon to do<br \/>\nso to take their trial. We direct accordingly.\n<\/p>\n<p>     So far  as petitioner  No. 1 is concerned, the State in<br \/>\nits affidavit  swear that there is no such person in custody<br \/>\nin connection with any case. This matter will be scrutinised<br \/>\nfurther by  the State  so that it may satisfy itself that no<br \/>\none is in custody except under due process of law.\n<\/p>\n<p>     This Court in its earlier order dated March 5, 1979 has<br \/>\ndirected  the\tState  to   file  a   statement\t  containing<br \/>\nparticulars of\tthe  under-trial  prisoners  who  have\tbeen<br \/>\nconfined in  Jail for  a period\t of over  six months without<br \/>\ntheir trials  having commenced.\t Further details  as to\t the<br \/>\nages of\t such under-trials,  the dates\tfrom which they were<br \/>\nconfined and  the offences with which they were charged were<br \/>\nalso called  for. In  the reply\t statement  put\t in  by\t the<br \/>\nrespondent, we\tfind a large number of cases where detention<br \/>\nfor considerable  periods, without  the\t trial\thaving\teven<br \/>\ncommenced, is  being suffered  by various  persons. Criminal<br \/>\njustice breaks\tdown, at  a point  when expeditious trial is<br \/>\nnot attempted  while the affected parties are languishing in<br \/>\njail. The  Criminal Procedure  Code in sections 167, 209 and<br \/>\n309 has emphasised the importance of expeditious disposal of<br \/>\ncases\tincluding   investigations   and   trials.   It\t  is<br \/>\nunfortunate, indeed  pathetic, that  there should  have been<br \/>\nsuch considerable  delay in  investigations by the police in<br \/>\nutter disregard of the fact that a citizen has been deprived<br \/>\nof his\tfreedom on  the ground\tthat he\t is  accused  of  an<br \/>\noffence. We  do not approve of this course and breach of the<br \/>\nrule of\t law and  express our  strong  displeasure  at\tthis<br \/>\nchaotic state  of affairs  verging on  wholesale  breach  of<br \/>\nhuman rights  guaranteed under\tthe Constitution  especially<br \/>\nunder Article 21 as interpreted by this Court.\n<\/p>\n<p>     Even so we do not wish to pass any orders at the moment<br \/>\nuntil more  particulars are  brought to\t our notice. It will<br \/>\nsuffice for the present-and counsel for the State assures us<br \/>\nthat any  direction given  by this  Court will\tbe  promptly<br \/>\ncomplied with-that we direct the State to consent to release<br \/>\nall persons who have been in custody for over six months and<br \/>\nwhose trials  have not\tcommenced  or  against\twhom  charge<br \/>\nsheets have  not been  laid. But make one exception in cases<br \/>\nwhere sections 302 and 395, IPC are involved. We direct that<br \/>\nthe State shall complete the investigation within two months<br \/>\nfrom today  where charge  sheets  have\tnot  been  laid\t and<br \/>\nfurther direct\tthe Sessions  Court concerned  to dispose of<br \/>\nthe cases  where charge sheets have been laid and commitment<br \/>\nhas been  made, within\tsix months from today. A report will<br \/>\nbe made to<br \/>\n<span class=\"hidden_text\">787<\/span><br \/>\nthis Court at the end of six months from today by the State.<br \/>\nWe must\t emphatically record  our view that there has been a<br \/>\nself-condemnation in  the statement  put  in  by  the  State<br \/>\nGovernment in  that in quite a number of cases which are not<br \/>\nof a  serious character\t and even  in  those  which  involve<br \/>\nserious\t offences,  investigations  have  been\tpending\t for<br \/>\nnearly two years. There are cases where persons have been in<br \/>\ncustody\t for  five  years-a  situation\ttoo  ghastly  for  a<br \/>\ncivilised country like ours. We therefore draw the attention<br \/>\nof the\tState Government  to take  a policy  decision with a<br \/>\nview to\t ensure that accused persons, too indigent to set in<br \/>\nmotion the  judicial process,  do not  suffer  incarceration<br \/>\nsilently.
