JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 06\/08\/2008 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>(Per<br \/>\n: HONOURABLE MR.JUSTICE A.L.DAVE)<\/p>\n<p>1.\tThis<br \/>\nLetters Patent Appeal challenges  the order passed in Special Civil<br \/>\nApplication No.2817 of 2008 dated 18-2-2008, whereby the appellant&#8217;s<br \/>\npetition came to be dismissed. The said petition was preferred to<br \/>\nchallenge the order passed by Controlling Authority on 12-2-2006 and<br \/>\nthe order passed by the appellate authority on 8-8-2007 granting<br \/>\nbenefit of gratuity to the respondent with 10% interest from<br \/>\n15-10-2004 on the amount of Rs.57,689\/-.\n<\/p>\n<p>2.\tAs<br \/>\nrightly submitted by learned  advocate Mr.Vasavada, the core question<br \/>\ninvolved in this litigation is whether the provisions of Payment of<br \/>\nGratuity Act would be applicable to the appellant-Institution.\n<\/p>\n<p>3.\tIn<br \/>\nthis regard a reference to the order passed by the Controlling<br \/>\nAuthority under the Payment of Gratuity Act under Gratuity<br \/>\nApplication No.133 of 2005 dated 12-2-2007 is relevant(in fact this<br \/>\nis the order under challenge). On the question of applicability of<br \/>\nthe provisions of Payment of Gratuity Act, it has been observed that<br \/>\nearlier in respect of a former employee Shri Labhshankar T.Badheka,<br \/>\nsame question had arisen before the Controlling Officer in Gratuity<br \/>\nApplication No.23 of 1997 and by order dated 14-7-1998 the appellant<br \/>\nwas directed to pay gratuity. Said order  in Gratuity Application<br \/>\nNo.23 of 1997 was passed ex parte and, therefore, a Revision<br \/>\nApplication bearing No.26 of 1997 was preferred, which came to be<br \/>\ndismissed by the then Controlling Authority. Thereafter,the appellant<br \/>\ndid not pursue the matter further and accepted the order. Now,<br \/>\ntherefore, the question was decided against the appellant and that<br \/>\norder having not been challenged before higher forum, has attained<br \/>\nfinality. The Controlling Officer under the Payment of Gratuity Act<br \/>\nwas, therefore, justified in turning down the point raised by the<br \/>\nappellant on question of applicability of the provisions of Payment<br \/>\nof Gratuity Act.\n<\/p>\n<p>4.\tSo<br \/>\nfar as other factual aspects of the present case are concerned, there<br \/>\nare concurrent findings of the authorities below, which are upheld by<br \/>\nthe learned single Judge and,therefore, we do not find any reason to<br \/>\ninterfere with the order impugned in this appeal.
