Imposition of Ceiling on Land Holdings Act (U.P. 1  of\n1961), s. 6(xvii) and r. 4(4) of the Rules made\t thereunder-\nIf protected by Arts. 31A and 31B.\n\n\n\nHEADNOTE:\nSection\t 6(xvii) of the U.P. Imposition of Ceiling  on\tLand\nHoldings  Act,\t1960,  and  rule  4(4)\tof  the\t rules\tmade\nthereunder  are\t protected  by\tArts. 31A  and\t31B  of\t the\nConstitution. [720C-D]\n(a)They\t are part of a scheme of land reform in\t U.P.  and\nwould  therefore  be protected from attack under  Art.\t31A.\n[720D]\n(b)The rule does not go beyond the powers conferred by the\nsection read with s. 44 of the Act, and the Act is  included\nto  the Ninth Schedule to the Constitution.  If a  statutory\nrule is within the power conferred by a section of a statute\nprotected by Art. 31B the rule cannot further be scrutinised\nunder Arts. 14, 19 and 31. [720C]\n\n\n\nJUDGMENT:\n<\/pre>\n<p>ORIGINAL JURISDICTION : Writ Petition No. 261 of 1968.<br \/>\nPetition  under Article 32 of the Constitution of India\t for<br \/>\nthe enforcement of fundamental rights.\n<\/p>\n<p>S.   C. Agarwala and D. P. Singh, for the petitioner.<br \/>\nS.   C. Manchanda and O. P. Rana, for the respondent<br \/>\nThe Judgment of the Court was delivered by<br \/>\nSikri, C. J.&#8211;This petition under Art. 32 has been filed  by<br \/>\nthe three appellants in Civil Appeals No. 2018-2020 of 1968,<br \/>\nin which we have just delivered judgment.  In this  petition<br \/>\nthe  vires  of s. 6, cl. (xvii), of the U.P.  Imposition  of<br \/>\nCeiling\t on Land Holdings Act, 1960 (U.\t P. Act 1 of  1961)-<br \/>\nhereinafter  referred to as the Act-and rule 4(4) of the  U.<br \/>\nP.  Imposition\tof Ceilings and Land Holdings  Rules,  1961,<br \/>\nhave  been  challenged.\t It is urged that  these  provisions<br \/>\nviolate\t Art.  14,  19(1)(f)  and  (g)\tand  31(1)  of\t the<br \/>\nConstitution.\tThe learned counsel for the State  contended<br \/>\nthat  the impugned provisions are protected by Art.  31B  of<br \/>\nthe Constitution, as the Uttar Pradesh Imposition of Ceiling<br \/>\non Land Holdings Act, 1960 is included in the Ninth Schedule<br \/>\nas  item  58.  The learned counsel for the  petitioners,  in<br \/>\nreply,\turged (1) that the impugned provisions have  nothing<br \/>\nto  do with land reform, and (2) that rules made  under\t the<br \/>\nAct do not enjoy the protection of Art. 318.  It is admitted<br \/>\nthat the land<br \/>\n<span class=\"hidden_text\">\t\t\t    720<\/span><br \/>\nin  dispute is a &#8216;holding&#8217; within S. 3(d) of the  Act.\t The<br \/>\ndefinition reads :\n<\/p>\n<blockquote><p>\t      &#8220;Holding&#8221; means the land or lands held by\t a<br \/>\n\t      person  as a bhumidhar, sirdar, asami of\tGaon<br \/>\n\t      Samaj or ant asami mentioned in Section 11  of<br \/>\n\t      the  Uttar  Pradesh, Zamindari  Abolition\t and<br \/>\n\t      Land  Reforms Act, 1950, or as a tenant  under<br \/>\n\t      the U.P. Tenancy Act, 1939, other than a\tsub-<br \/>\n\t      tenant,  or  as a Government lessee, or  as  a<br \/>\n\t      sublessee\t of a Government lessee,  where\t the<br \/>\n\t      period  of the sub-lease is co-extensive\twith<br \/>\n\t      the period of the lease.&#8221;\n<\/p><\/blockquote>\n<p>It seems to us that if a statutory rule is within the powers<br \/>\nconferred  by a section of a statute protected by Art.\t31B,<br \/>\nit  is\tdifficult  to  say that the  rule  must\t further  be<br \/>\nscrutinised under-Arts. 14, 19, etc.  Rule 4(4) seems to  us<br \/>\nto  be a rule which does not go beyond the powers  conferred<br \/>\nunder s. 6(xvii), read with S. 44 of the Act.  At any  rate,<br \/>\nS. 6(xvii) and rule 4(4) are part of a scheme of land reform<br \/>\nin U.P. and would be protected from attack under Art. 31A of<br \/>\nthe Constitution.\n<\/p>\n<p>In  the\t result we hold that s. 6(xvii) and  rule  4(4)\t are<br \/>\nvalid The petition accordingly fails.  In the  circumstances<br \/>\nthere will be no order as to costs.\n<\/p>\n<pre>V. P.
