it  for the purpose of restoration of the original<\/p>\n
matters dismissed for default; let apart, as
\nsubmitted by the learned Counsel for the
\nappellant Sri Patil, the learned District Judge<\/p>\n
was too technical in the matter of entertaining<\/p>\n

 be binding. The Judgment rendered was with<\/p>\n
sreference to the facts & circumstances of that case and is<\/p>\n
devoid of any declaration of taw. The oniy reason<\/p>\n

prornulgated. If the pxr’ovis~ioi1.s\u00a7of the’:i_ia’w–are to be given a<\/p>\n
go\u00abby.e ontitie;s.olVe.pfoot’i*n_g that the Court has an inherent
\npower ‘under Section  CPC, would render the entire<\/p>\n
Coof_e”o_f Civii-\u00bb Fflrocedlytirel as redundant. Certainly, that is<\/p>\n
   ijntentionmof granting an inherent power under<\/p>\n
 ._se1ct*io-.%{‘r_,,S:.”p.r–?~ci>c. Therefore, to take a View that it is too<\/p>\n
te’c.hni,g:’ai~,to disrniss when a wrong provision of law has<\/p>\n
 peen “gtioted wouid be incorrect. Therefore, I’am unable<\/p>\n
 -accept to the view taken by the learned Single Judge in<\/p>\n
