The petitioner has challenged the Tahsildar’s V.<\/p>\n
06.07.2010 (Annexure–A) prohibiting the sake of toddy  H<\/p>\n
petitioner in the premises in question.\n<\/p>\n
2. Sri S.K.Acharya, the learned,counsevl”‘for petitiorgerl<\/p>\n
submits that the reason for Passing tVh’e.:_i’rn.pugVned’g_VV:o’rderf\u00a7is that
\nthe petitioner has violated  entered into
\nbetween the respondent No.2’Aaifl:d_He brings to
\nmy notice that  “a:lre’adji:*V.oi:taiined an order of
\nstatus quo against  VC)’.S.No.10\/2009. To
\novercome this:Vvorder;  filed a false complaint<\/p>\n
with the responide-ntoMNo.w.1i.’   <\/p>\n
 3. S.ri.{:I’\\VcilaryaVlfurther\u00e9isubmits that the petitioner is not<\/p>\n
heard inlthe  is not given an opportunity of hearing in<\/p>\n
:7V__the  that there is total non–app|ication of the<\/p>\n
V77lr_ninciV on  the Tahsildar. The documents available on<\/p>\n
.1therecor~d.._of the Tahsildar was not given any weightage. He<\/p>\n
the petitioner has the licence to vend the toddy<\/p>\n

4. Sri H.T.Narendra Prasad, the learned High Court<\/p>\n
Government Pleader appearing for the respondent No.1 <\/p>\n
that the petitioner has no licence whatsoever to  .<\/p>\n
in the premises in question. Therefore _the__i4mpugried’jorldievr-is.,_ <\/p>\n
passed as per the provisions containedain1’_Se’ction  of.”‘t.ri\u00e911.ij<\/p>\n
Karnataka Excise Act, 1965.\n<\/p>\n
5. Sri Shashikanth, the learned-‘coup-s’e’l\u00bb..for.thle-resvpondent
\nNo.2 submits that the challanst’p\u00ab’ro’d’uc,e:’dfbyjtvh\ufb01tiypetitioner are in
\nrespect of different that the
\npetitioner has no  inlthe shop belonging<\/p>\n
to the respondent  if<\/p>\n
6. The earlier piartvA..of_llthewimpugned order refers to the
\nsecond respo.,nden4’t’s,_:allegati’on\u00ab”‘of the sale of the toddy by the
\npetitio-ner”:a—lunautraorisedly’ “”” and in violation of the tenancy<\/p>\n
agreemegjetll.’  discussion, no finding that the petitioner<\/p>\n
V7U”‘i~s’vnot ail_i44cence.\u00a5h”o.id;er at all. Only on this short ground, the<\/p>\n
-\u00ab.l.i.fmp_ug.ned order is liable to be quashed and accordingly it Is<\/p>\n
  7.?The quashing of the impugned order does not mean that<\/p>\n
‘jatDthefpetitioner can continue to vend the todcly in the second<\/p>\n
\ufb01BH,<\/p>\n
respondent’s shop, if he is not a valid iicence-hoider. __The<\/p>\n
respondent No.1 is directed to hoid the enquiry afresh and.vgi:v-ei_ia_V<\/p>\n
clear finding as to whether or not the petitioner <\/p>\n
licence. If the petitioner fails to produceithe vaiid”ii’ce’nce~~:o’r_ifit ‘*~ 1′<\/p>\n
the Tahsidlar is satisfied that he does notviqavaaafivaiid ii\u00a2ence;ne::si’<\/p>\n
shall pass the order prohibiting the__ saie-._o.’  <\/p>\n
