(C) NO. 25183 OF 2009\n                     ---------------------------------------------\n                    Dated this the 13th day of October, 2009\n\n\n                                   JUDGMENT\n<\/pre>\n<p>Kurian Joseph, J.\n<\/p>\n<p>       This Writ Petition is filed with the following prayer:<\/p>\n<blockquote><p>              &#8220;Issue a writ of mandamus or such other writ or<br \/>\n              direction directing 1st respondent to extend<br \/>\n              adequate protection to the life of petitioners from<br \/>\n              respondents 3 to 6 and their men or agents and<br \/>\n              further to conduct an enquiry in the matter after<br \/>\n              summoning all the material witnesses and records<br \/>\n              in the matter.&#8221;\n<\/p><\/blockquote>\n<p>       2. Having realised that the basis of the dispute is one regarding<\/p>\n<p>partition of the property among the members of the family, we directed the<\/p>\n<p>parties to be present before the Kerala Mediation Centre.              Adv. Smt.<\/p>\n<p>Lalitha Nair, the learned Mediator filed a report stating that the parties<\/p>\n<p>have settled their disputes in the following terms:<\/p>\n<blockquote><p>              i. The petitioners and respondents 3 to 6 have<br \/>\n                  mutually agreed to settle their dispute<br \/>\n                  pending before Sub Court, Perumbavoor<br \/>\n                  (Transferred     A.S. No. 113\/2006 of Sub<br \/>\n                  Court, Muvattupuzha.\n<\/p><\/blockquote>\n<blockquote><p>              ii. For the purpose of settlement the parties have<br \/>\n                  decided    to   measure       out    the    disputed<br \/>\n                  properties     by     Kothamangalam            Taluk<br \/>\n                  Surveyor. The survey has to be done based<br \/>\n                  on all documents produced by either side<\/p>\n<p><span class=\"hidden_text\">W.P.(C) NO. 25183\/2009                  2<\/span><\/p>\n<p>                before the Munsiff Court and Sub Court at<br \/>\n                Muvattupuzha.\n<\/p><\/blockquote>\n<blockquote><p>             iii.The parties have also agreed to make proper<br \/>\n                application and measurement before the<br \/>\n                Taluk Surveyor without any           delay and<br \/>\n                expressed their readiness to share equally all<br \/>\n                the expenses for the survey.<\/p><\/blockquote>\n<p>       3.   In view of the settlement as above, no further orders are<\/p>\n<p>necessary in this Writ Petition. It is made clear that in the event of the<\/p>\n<p>parties taking law into their hands, it will be open to the aggrieved party to<\/p>\n<p>approach the police in which case, the police will render necessary<\/p>\n<p>protection for violation of the agreement referred to above. It is made<\/p>\n<p>clear that the parties are free to approach the Sub Court, Muvattupuzha for<\/p>\n<p>appropriate orders regarding measurement of the properties.<\/p>\n<p>       The Writ Petition is disposed of as above. The parties are directed<\/p>\n<p>to pay Rs.1,000\/- each to the learned Mediator Adv. Smt.
