The petitioner &#8211;<br \/>\nBhavnagar Nagrik Sahakari Bank Ltd. is before this Court through its<br \/>\nChairman\/Manager being aggrieved by the priorities fixed by the<br \/>\nliquidator of Shri Vardhman Co-operative Bank Ltd., a copy of which<br \/>\nis produced at page 49.\n<\/p>\n<p>2.1\tAgainst<br \/>\nthe fixation of priorities, the petitioner preferred an appeal before<br \/>\nthe Registrar, Co-operative Societies, Gujarat State, Gandhinagar,<br \/>\nwho decided the appeal by judgment and order dated 5th<br \/>\nFebruary 2010 and rejected Appeal No.79 of 2009.  The learned<br \/>\nadvocate for the petitioner effectively demonstrated that the<br \/>\nAdditional Registrar (Appeals) has decided the appeal by stating<br \/>\ntherein that, &#8216;the liquidator has not disallowed the claim of the<br \/>\napplicant (present petitioner); that the applicant (present<br \/>\npetitioner) is already included in the Priority List at serial No. 5&#8217;<br \/>\nand very cursorily, it is also mentioned in the order that, &#8216;overall,<br \/>\nthe priorities fixed by the liquidator do not warrant any<br \/>\ninterference&#8217;.  This is nothing but shirking of responsibility of<br \/>\ndeciding as to whether, the liquidator has rightly fixed the<br \/>\npriorities or not.  The Additional Registrar (Appeals) ought to have<br \/>\ndecided that, as to whether the priorities fixed by the liquidator<br \/>\nare properly fixed or not.\n<\/p>\n<p>2.2\tAgainst<br \/>\nthe order of Additional Registrar (Appeals), the petitioner<br \/>\napproached the Deputy Secretary (Appeals), Agriculture and<br \/>\nCo-operation Department, Gandhinagar, who too, dismissed the same and<br \/>\nconfirmed the order of Additional Registrar (Appeals) dated 5th<br \/>\nFebruary 2010.  The learned advocate for the petitioner invited<br \/>\nattention of the Court to the observations made by the Deputy<br \/>\nSecretary (Appeals) that, &#8216;taking into consideration the contents of<br \/>\nSection 110-E of the Gujarat Co-operative Societies Act, there is no<br \/>\nprovision for hearing the applicant (present petitioner)&#8217;.\n<\/p>\n<p>3.0\tThe<br \/>\nright of hearing is to be read in every provision, where the<br \/>\nauthority decides the right of a person.  In the present case, it is<br \/>\nthe liquidator who decided the right of the petitioner by putting the<br \/>\npetitioner at serial No. 5 in the Priority List and by that, it<br \/>\nadversely affected the right of the petitioner without affording any<br \/>\nhearing to the petitioner.  To such an order, the higher authorities\n<\/p>\n<p>&#8211; appellate authority has affixed the seal of approval by<br \/>\nsaying that, &#8216;the liquidator has not disclaimed the claim of the<br \/>\npetitioner&#8217; and the Deputy Secretary (Appeals) has said that, &#8216;there<br \/>\nis no provision for hearing and therefore, the order of the<br \/>\nRegistrar, does not warrant any interference&#8217;.\n<\/p>\n<p>3.1\tIn<br \/>\nthe opinion of this Court both these orders are suffering from<br \/>\n&#8216;non-application of mind&#8217; and also &#8216;ignorance of the settled position<br \/>\nof law&#8217; to the effect that, right of hearing is required to be read<br \/>\nin every provision.  Therefore, this petition deserves to be allowed.<br \/>\n The Priority List at page 49, order passed by the Additional<br \/>\nRegistrar (Appeals), and order passed by the Deputy Secretary<br \/>\n(Appeals) are quashed.  The exercise of fixing the priority be<br \/>\nundertaken afresh by the liquidator, after giving necessary hearing<br \/>\nto all the concerned parties and priorities be fixed de novo.\n<\/p>\n<p>3.2\tAt<br \/>\nthe request of learned Assistant Government Pleader<br \/>\nMs. Jirga<br \/>\nJhaveri it is clarified that quashing of these orders does not mean<br \/>\nthat the Court has pronounced anything on the claim of the<br \/>\npetitioner.  The only pronouncement is that the action of fixing the<br \/>\npriorities by the liquidator without affording any hearing to the<br \/>\npetitioner is unknown to law and therefore, it is quashed along with<br \/>\nthe order passed by the Additional Registrar (Appeals) and order<br \/>\npassed by the Deputy Secretary (Appeals).\n<\/p>\n<p>3.3\tThe<br \/>\npetition is allowed.  Rule is made absolute with no order as to<br \/>\ncosts.  Direct service is permitted.\n<\/p>\n<p>3.4\tIt<br \/>\ngoes without saying that when it comes to the Official Liquidator to<br \/>\ndecide the priorities, he will fix the priorities in accordance with<br \/>\nlaw without being influenced by the factum of allowing of this<br \/>\npetition.\n<\/p>\n<p>3.5\tIf<br \/>\nany respondent is aggrieved by this judgment and order then can<br \/>\napproach this Court within three weeks from the date of service of<br \/>\nthis judgment.\n<\/p>\n<p>[<br \/>\nRavi R.
