Sharma, Mumbai\nRespondent:          Ministry of Defence. (MoD)\n\n\nFACTS<\/pre>\n<p>       By an application of 8-8-06 Shri J.P. Sharma of Malad, West Mumbai<br \/>\napplied to Shri C. Prakash, Director and CPIO, Ministry of Defence     seeking<br \/>\nthe following information on Canteen Stores Department of MoD inviting<br \/>\ntenders with the condition that the transporters be registered with Indian<br \/>\nBanks Association (IBA):\n<\/p>\n<blockquote><p>       &#8220;You will notice that the IBA takes no responsibility. It is not a<br \/>\n       statutory authority and has no power to enforce its scheme.<br \/>\n       That being so, please let me know the rationale behind insisting<br \/>\n       on the registration with the IBA. A copy of the order, if any,<br \/>\n       issued by the Ministry of Defence on this subject to the Canteen<br \/>\n       Stores Department may kindly be supplied to me.&#8221;<\/p><\/blockquote>\n<p>       To this he received a reply of 11.1.2007 from Brig S. C. Nair, DDG<br \/>\nPublic Information as follows: &#8211;\n<\/p>\n<blockquote><p>        &#8220;It is intimated that no such instructions of the Ministry of<br \/>\n       Defence regarding awarding contracts to only those transporters<br \/>\n       whose banks are member of IBA have been received by CSD,<br \/>\n       HQ.&#8221;<\/p><\/blockquote>\n<p>     Not satisfied with this response Shri J. P. Sharma moved his first<br \/>\nappeal before DG, (DC&amp;W) Integrated, HQ, MoD on 25.1.2007, upon<br \/>\nwhich he received the response from Col. A. K. Sharma, Director, HRC<br \/>\non 27.2.2007 informing him that his case was being re-examined &#8220;in<br \/>\nconjunction with ADG PI and Canteen Stores Department. Comments<br \/>\non the issues raised in the appeal by you have been sought. You will<br \/>\nget a considered response shortly. Request accept response in 45<br \/>\ndays instead of 30 days.&#8221;\n<\/p>\n<p>       In the mean time Shri J. P. Sharma also addressed a letter to Shri<br \/>\nSanjay Kumar, Dy. Director &amp; APIO, Department of Public Enterprises<br \/>\nseeking the following information;\n<\/p>\n<p><span class=\"hidden_text\">                                       1<\/span><\/p>\n<blockquote><p>       &#8220;(i)    A copy of the government order under which public sector<br \/>\n              enterprises have been ordered to insist that every<br \/>\n              transporters must be IBA approved.\n<\/p><\/blockquote>\n<blockquote><p>      (ii)    A copy of the policy laid down by the public sector<br \/>\n              enterprises in this regard.\n<\/p><\/blockquote>\n<blockquote><p>      (iii)   How this insistence helps the public enterprises in<br \/>\n              resolving any dispute when IBA does not take any<br \/>\n              responsibility.&#8221;\n<\/p><\/blockquote>\n<p>To this he received a clear reply on 19-2-07 as follow:\n<\/p>\n<blockquote><p>      &#8220;It is clarified that Department of Public Enterprises has not<br \/>\n      issued any guide lines on this issue for the compliance by<br \/>\n      Central Public Enterprises.&#8221;<\/p><\/blockquote>\n<p>      Appellant has then moved his second appeal before us with reference<br \/>\nto the application made to Ministry of Defence with the following prayer:\n<\/p>\n<blockquote><p>      &#8220;I request that the CPIO may kindly be directed to furnish me the<br \/>\n      information in the form in which was asked.&#8221;\n<\/p><\/blockquote>\n<blockquote><p>      This was on the grounds that response of 11-1-07 from CPIO, Brig.\n<\/p><\/blockquote>\n<p>S.C. Nair was &#8220;unrelated to my application dated 8-8-2007&#8221; (sic.). He has<br \/>\nenclosed a copy of the response received by him from the Department of<br \/>\nPublic Enterprises clearly stating that the Dep&#8217;t. of Public Enterprises has not<br \/>\nissued any such guidelines.\n<\/p>\n<p>      The appeal was heard through videoconference on 28-8-2008. The<br \/>\nfollowing are present.\n<\/p>\n<p>      Respondents<br \/>\n      Brig. P.C. Chakraborty, CPIO of IHQ of MOD, DDGAE<br \/>\n      Maj. M. Gahlot, CSO-1 (Legal) RTI Cell.\n<\/p>\n<p>      Shri K.K. Srivastava, AGM (Legal) CSD HO, Mumbai<br \/>\n      Shri A.K. Gupta, Dy. Director (CS)\/CMG Branch, Army HQ.\n<\/p>\n<p>      Although informed of the date of hearing through our letter of 18-8-08,<br \/>\narrangement was made for him at NIC, Mumbai, appellant opted not to be<br \/>\npresent.\n<\/p>\n<p>      Shri K.K. Srivastava, AGM (Legal) CSD HO, Mumbai submitted that<br \/>\nthe information sought was for the copy of an order issued by Ministry of<br \/>\nDefence on the subject. Appellant Shri Sharma has been informed by the<\/p>\n<p><span class=\"hidden_text\">                                       2<\/span><br \/>\n PIO that no such instructions from MOD have been received by CSD-Hq. He<br \/>\nadmitted that, in fact, the tender document does specify bank approval issued<br \/>\nby Indian Banks Association. However, this is an old tradition, no record<br \/>\nregarding the origin of which is available. During the hearing, he displayed<br \/>\ntender notice of the canteen Stores Dep&#8217;t of 1995-96 also, carrying the same<br \/>\ncondition worded &#8220;only IBA approved transporters need apply&#8221;.\n<\/p>\n<p>      Respondents were asked the reason why an application of 8-8-06 was<br \/>\nreplied only on 11-1-07, i.e. overdue by 125 days. Maj. Gahlot submitted that<br \/>\nthe original application, which was addressed to MoD, was received in Army<br \/>\nHqrs. only on 14-8-06. Besides Shri J.P. Sharma did not submit it in his<br \/>\nindividual capacity but as J.P. Sharma Carriers, and no fees were attached.<br \/>\nFees were received on 17th October, 06 by IPO dated 7th October, 06. It was<br \/>\nonly after this that the information was sought to be collated and having been<br \/>\nreceived only on 10-1-07, was sent to appellant on the very next day.\n<\/p>\n<p>                              DECISION NOTICE<\/p>\n<p>               We find that the response to the RTI application is incomplete.<br \/>\n Appellant Shri J.P. Sharma has specifically asked two questions:\n<\/p>\n<blockquote><p>        (i)     The reasons for insisting on registration with the IBA; and<\/p>\n<\/blockquote>\n<blockquote><p>        (ii)    A copy of the order of the Ministry of Defence.<\/p><\/blockquote>\n<p>      Only the second has been answered, although the first was explained<br \/>\nto us in the hearing. CPIO Brig. P. Chakraborty assured that the answer to<br \/>\nthe first would be sent to the appellant Shri J.P. Sharma within 10<br \/>\nworking days of the date of issue of this decision.\n<\/p>\n<p>      On the question of delay we are not satisfied with the explanation<br \/>\nprovided in the hearing. Even if we have to concede that because the fees<br \/>\nwas not received till 17-10-06, the response was not sent till then, information<br \/>\nstill became due by 17-11-06. In fact it has been sent on 11-1-07, even then<br \/>\na delay of 55 days. Maj. Manisha Gahlot will, therefore, enquire into the<\/p>\n<p><span class=\"hidden_text\">                                        3<\/span><br \/>\n reasons for this delay between the time when the information would have<br \/>\nnormally become due i.e. 8-9-06, assign responsibility on the defaulting<br \/>\nofficials including those in MoD, obtain their explanations and submit a<br \/>\nreport to us by 15th September, 2008 for consideration of further action by<br \/>\nthis Commission.\n<\/p>\n<p>The Appeal is allowed. There will be no cost.\n<\/p>\n<p>Announced in the hearing.
