Opposite Party.\n                                             -----------\n<\/pre>\n<p>5.   09.09.2011               The accused-petitioner has preferred<\/p>\n<p>                  this revision application against the judgment<\/p>\n<p>                  and order dated 28th January 2011 passed by the<\/p>\n<p>                  learned     Additional         Sessions     Judge,      FTC-V,<\/p>\n<p>                  Araria in Cr. Appeal No. 29 of 1995 by which<\/p>\n<p>                  the appeal has been dismissed confirming the<\/p>\n<p>                  judgment     of    conviction        and    sentence        dated<\/p>\n<p>                  29.5.1995 passed by the 1st Assistant Sessions<\/p>\n<p>                  Judge, Araria in Sessions Trial No. 305 of 1987<\/p>\n<p>                  by which the accused petitioner has been held<\/p>\n<p>                  guilty under Sections 395 and 412 of I.P.C. and<\/p>\n<p>                  sentenced to undergo rigorous imprisonment for<\/p>\n<p>                  seven years each of sections and all sentences<\/p>\n<p>                  are to run concurrently.\n<\/p>\n<p>                              Having      perused       the     trial         Court<\/p>\n<p>                  judgment and paragraph 8 of the Appellate Court<\/p>\n<p>                  judgment,    this      Court    is   satisfied      that     the<\/p>\n<p>                  matter     requires      consideration       only      on    the<\/p>\n<p>                  question of sentence.\n<\/p>\n<p>                              Heard. With consent of parties, the<\/p>\n<p>                  application       is   being   finally      disposed    of     at<br \/>\n<span class=\"hidden_text\">                       2<\/span><\/p>\n<p>admission stage itself.\n<\/p>\n<p>              It has been submitted on behalf of<\/p>\n<p>the     petitioner          that       out     of    four     accused<\/p>\n<p>appellants, three have filed Cr. Revision No.<\/p>\n<p>511 of 2011 in the High Court which has been<\/p>\n<p>disposed of by order dated 2.5.2011 and the<\/p>\n<p>case of the petitioner is similarly situated<\/p>\n<p>except the facts that the petitioner has also<\/p>\n<p>been found guilty under Section 395 and 412<\/p>\n<p>I.P.C.       and     has    been       sentenced       to    rigorous<\/p>\n<p>imprisonment          for       seven     years      under         each<\/p>\n<p>section        and        the     sentences          are     to     run<\/p>\n<p>concurrently. The sentence of other convicts<\/p>\n<p>has    been reduced to three and a half years<\/p>\n<p>under Section 412 I.P.C. Since sentences have<\/p>\n<p>to    run    concurrently,               the    sentence      of    the<\/p>\n<p>petitioner         may     also    be    reduced      to    the    same<\/p>\n<p>period.\n<\/p>\n<p>              Altogether four persons were charged<\/p>\n<p>for the offence punishable under Sections 395<\/p>\n<p>and 412 I.P.C. in Sessions Trial No. 305 of<\/p>\n<p>1987    in    the     Court       of    1st   Assistant      Sessions<\/p>\n<p>Judge, Araria. A dacoity was committed in the<\/p>\n<p>house    the       informant       (P.W.3)      wherein      certain<\/p>\n<p>households         articles        including         utensils       and<\/p>\n<p>cloths        were         looted.        On        conclusion       of<br \/>\n<span class=\"hidden_text\">                    3<\/span><\/p>\n<p>investigation,         charge-sheet             was      submitted<\/p>\n<p>leading     to      trial.     At         the     trial,        nine<\/p>\n<p>prosecution      witnesses         were    examined        besides<\/p>\n<p>exhibiting       documents.        After        trial    all    the<\/p>\n<p>accused except Dayanand Singh were held guilty<\/p>\n<p>for the offence punishable under Section 412<\/p>\n<p>I.P.C. and sentenced to rigorous imprisonment<\/p>\n<p>for seven years and the petitioner was further<\/p>\n<p>held guilty under Section 395 and was sentenced<\/p>\n<p>to rigorous imprisonment for seven years and<\/p>\n<p>the sentences under Sections 395 and 412 I.P.C.<\/p>\n<p>are to run concurrently. Thereafter, all the<\/p>\n<p>convicts filed Cr. Appeal No. 29 of 1995 which<\/p>\n<p>was     dismissed      by    the      learned           Additional<\/p>\n<p>Sessions Judge, FTC-V, vide impugned judgment<\/p>\n<p>dated     28.1.2011    confirming          the     judgment      of<\/p>\n<p>sentence    passed     by    the    learned       trial     court.<\/p>\n<p>Thus the petitioner has been held guilty by the<\/p>\n<p>two Courts below.\n<\/p>\n<p>            It appears that the petitioner has no<\/p>\n<p>criminal    antecedent       and    all     dacoits       and    the<\/p>\n<p>petitioner were aged about 30 years at the time<\/p>\n<p>of conviction. The occurrence has taken place<\/p>\n<p>on 22\/23 March 1987. More than 24 years have<\/p>\n<p>passed and the petitioner has been suffering<\/p>\n<p>from mental agony for long years.<br \/>\n<span class=\"hidden_text\">                             4<\/span><\/p>\n<p>                     Considering            the        facts        and<\/p>\n<p>          circumstances, this Court is satisfied that the<\/p>\n<p>          petitioner       deserves         lesser      quantum      of<\/p>\n<p>          punishment for the proved charge. Accordingly,<\/p>\n<p>          while upholding the conviction recorded by the<\/p>\n<p>          learned Trial Court and duly affirmed by the<\/p>\n<p>          learned Appellate Court, the sentence imposed<\/p>\n<p>          on   the   petitioner        is   reduced     to     rigorous<\/p>\n<p>          imprisonment for three and a half years under<\/p>\n<p>          Section    395   and   412    IPC    each    and   both   the<\/p>\n<p>          sentences to run concurrently.\n<\/p>\n<p>                     In    the   result,      this    application    is<\/p>\n<p>          dismissed with the aforesaid modification in<\/p>\n<p>          the sentence.\n<\/p>\n<\/p>\n<pre>Kanchan                          (Amaresh Kumar Lal, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Rajendra Singh vs The State Of Bihar on 9 September, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA CR.
