SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 13\/05\/2010 \n\n \n\n \n \nORAL\nJUDGMENT<\/pre>\n<p>Rule.\n<\/p>\n<p>\tLearned advocate, Shri Manav Mehta, waives service of notice of rule<br \/>\n\ton behalf of the respondent No.1 who is the main contesting party<br \/>\n\tand Shri A.B.Munshi, learned advocate appearing on behalf of the<br \/>\n\trespondent Nos. 3 to 7.\n<\/p>\n<p>Shri<br \/>\n\tManav Mehta, learned advocate has stated at the Bar that proposed<br \/>\n\trespondents i.e. respondent Nos. 11 and 12 herein who have purchased<br \/>\n\tthe disputed land in question during the pendency of second appeal<br \/>\n\tare personally present in the Court and they have filed a separate<br \/>\n\tundertakings through him. He has stated at the Bar that after<br \/>\n\tnecessary formalities are completed and the respondent Nos. 11 and<br \/>\n\t12 are joined as party respondents to the second appeal, they will<br \/>\n\tbe represented through Advocate and Vakalatnama on their behalf<br \/>\n\tshall be filed latest by tomorrow.\n<\/p>\n<p>Present<br \/>\n\tapplication has been preferred by the applicants-original appellants<br \/>\n\tpermitting the applicants to join respondent Nos. 11 and 12 herein<br \/>\n\tas party to the main second appeal as well as civil application for<br \/>\n\tinterim relief therein and for an appropriate order restraining them<br \/>\n\tfrom further alienating, transferring the suit land in question<br \/>\n\twhich they have purchased by the registered sale-deed dated 20th<br \/>\n\tApril, 2010.\n<\/p>\n<p>Shri<br \/>\n\tA.J.Patel, learned advocate appearing on behalf of the applicants<br \/>\n\tseeks permission to delete the respondent Nos. 13 to 16 and does not<br \/>\n\tpress their prayer to join respondent Nos. 13 to 16 as party to the<br \/>\n\tmain second appeal as such, they are confirming parties to the<br \/>\n\tsale-deed dated 20th April, 2010.\n<\/p>\n<p>Having<br \/>\n\theard learned advocates appearing for the respective parties and as<br \/>\n\tthe application is not opposed by respondent Nos. 11 and 12, who are<br \/>\n\tpersonally present in the Court, present application is allowed.<br \/>\n\tApplicants are permitted to join respondent Nos. 11 and 12 as party<br \/>\n\trespondents in main second appeal as well as in the civil<br \/>\n\tapplication for interim relief therein.\n<\/p>\n<p>By<br \/>\n\tway of interim relief, when the respondents more particularly,<br \/>\n\trespondent Nos. 11 and 12 have purchased the suit property during<br \/>\n\tthe pendency of second appeal and considering the undertakings filed<br \/>\n\tby respondent Nos. 11 and 12 herein and affidavit filed by the<br \/>\n\toriginal respondent no.1 in civil application, respondents more<br \/>\n\tparticularly, respondent Nos. 11 and 12 are hereby restrained from<br \/>\n\tfurther alienating, transferring the suit land in question in any<br \/>\n\tmanner whatsoever.\n<\/p>\n<p>Rule<br \/>\n\tis made absolute to the aforesaid extent.
