Vineeta Mahajan, respondent in this appeal, appeared in<br \/>\nthe Class XII examination conducted by the Central Board  of<br \/>\nSecondary Education, Delhi, in the month of March 1993.\t She<br \/>\nsat for the Political Science paper on March 16, 1993 in the<br \/>\nsaid  examination.   During the course of  examination,\t the<br \/>\ninvigilator  found the respondent in possession\t of  written<br \/>\nmaterial in the shape of three small pieces of paper kept in<br \/>\nthe  pencil  box.  The matter was reported  to\tthe  Central<br \/>\nSuperintendent.\t  Proceedings in respect of the charge\t&#8220;for<br \/>\nusing unfair means at the examination&#8221; were initiated by the<br \/>\nResult Committee of the Board.\tThe respondent was  examined<br \/>\nby the said Committee on July 19, 1993.\t She admitted having<br \/>\nkept  the said papers in the pencil box but she stated\tthat<br \/>\nshe  had  not  used the same while  answering  the  question<br \/>\npaper.\tAccording to her she arrived at the examination hall<br \/>\nlate  due  to  car puncture on the way\tand,  as  such,\t was<br \/>\nutterly\t confused and panicky and in that mental  state\t she<br \/>\nforgot\tto  take out the papers from the pencil\t box  before<br \/>\nentering the examination hall.\tThe Deputy Superintendent of<br \/>\nthe examination centre stated before the Committee that\t she<br \/>\nhad  given the usual warning in the examination\t hall  about<br \/>\nthe  possession\t of undesirable material by  the  examinees.<br \/>\nWhen questioned by the Deputy Superintendent the  respondent<br \/>\nanswered  that she was too tense to hear the  warning.\t The<br \/>\nCommittee found the respondent guilty of using unfair  means<br \/>\nat  the examination and as a punishment her examination\t for<br \/>\nthe year 1993 was cancelled.  She challenged the said  order<br \/>\nby way of a writ petition before the Delhi High Court.\t The<br \/>\nHigh  Court  allowed  the  writ\t petition  and\tquashed\t the<br \/>\npunishment awarded to the respondent.  This appeal by way of<br \/>\na special leave is against the judgment of the High Court.\n<\/p>\n<p>3.   Rule  36.1 (iv)(a) of the Rules for unfair means  cases<br \/>\nframed\tby the Board which is relevant for our\tpurposes  is<br \/>\nreproduced hereunder:\n<\/p>\n<p>&#8220;36.  1.  (iv)\tIf during the  course  of  examination,\t any<br \/>\ncandidate  is  found indulging in any of the  following,  he<br \/>\nshall\tbe  deemed  to\thave  used  unfair  means   at\t the<br \/>\nexaminations:\n<\/p>\n<p>(a)  having in possession papers, books, notes or any  other<br \/>\nmaterial  or information relevant to the examination in\t the<br \/>\npaper concerned.&#8221;\n<\/p>\n<p>4.   The  High\tCourt  allowed\tthe  writ  petition  on\t the<br \/>\nfollowing reasoning:\n<\/p>\n<p>&#8220;The question which arises for our consideration is, if\t the<br \/>\npositive  finding  of  the  result  committee  is  that\t the<br \/>\npetitioner  had not copied then can the provisions  of\tRule<br \/>\n36.1 (iv) be so invoked so as to come to the conclusion that<br \/>\nthe petitioner had been guilty of using unfair means.<br \/>\nIt  is\tno  doubt  true\t that  the  said  provisions   raise<br \/>\npresumption  that  the candidate is guilty of  using  unfair<br \/>\nmeans  if,  inter  alia, written material is  found  on\t her<br \/>\nperson in the examination.  But this is a rebuttable<br \/>\n<span class=\"hidden_text\">8<\/span><br \/>\n\t      presumption and it can be seen whether in fact<br \/>\n\t      the material was not used &#8230;. We find here in<br \/>\n\t      this  case that the result  committee,  having<br \/>\n\t      come to a positive finding that the petitioner<br \/>\n\t      had not copied despite having written material<br \/>\n\t      on  her person, ought not to have imposed\t any<br \/>\n\t      penalty.\t Having come to the  conclusion,  on<br \/>\n\t      facts, that the petitioner had not copied, the<br \/>\n\t      question of imposing any penalty merely on the<br \/>\n\t      presumption of some written notes being  found<br \/>\n\t      with  the candidate, could not be arrived\t at,<br \/>\n\t      on the facts and circumstances of the  present<br \/>\n\t      case.   The  decision of\tthe  respondents  of<br \/>\n\t      cancelling  the result for the year  1993\t did<br \/>\n\t      not flow, in other words, from the finding  of<br \/>\n\t      fact  which that authority itself had  arrived<br \/>\n\t      at.  This Court is merely correcting the error<br \/>\n\t      which  has crept in the impugned\torder.\t For<br \/>\n\t      the  aforesaid reasons, this writ petition  is<br \/>\n\t      allowed.\t The decision of the respondents  in<br \/>\n\t      cancelling  the examination of the  petitioner<br \/>\n\t      for   the\t year  1993  is\t quashed   and\t the<br \/>\n\t      respondents are directed to declare the result<br \/>\n\t      of  the  petitioner  within  two\tweeks\tfrom<br \/>\n\t      today.&#8221;\n<\/p>\n<p>5.   We\t do not agree with the reasoning of the High  Court.<br \/>\nThe  High  Court  fell\tinto  patent  error  in\t reading   a<br \/>\nrebuttable  presumption\t in the language of the\t Rule.\t The<br \/>\nRule  clearly  defines\t&#8220;the  use of  unfair  means  at\t the<br \/>\nexamination&#8221;  and  lays\t down  in  simple  language  that  a<br \/>\ncandidate  having  in  possession papers,  relevant  to\t the<br \/>\nexamination, in the paper concerned, shall be deemed to have<br \/>\nused unfair means at the examination.  The sine qua non, for<br \/>\nthe  misconduct\t under\tthe Rule, is  the  recovery  of\t the<br \/>\nincriminating material from the possession of the candidate.<br \/>\nOnce  the candidate is found to be in possession  of  papers<br \/>\nrelevant to the examination, the requirement of the Rule  is<br \/>\nsatisfied  and there is no escape from the  conclusion\tthat<br \/>\nthe candidate has used unfair means at the examination.\t The<br \/>\nRule does not make any distinction between bona fide or mala<br \/>\nfide  possession  of the incriminating material.   The\tHigh<br \/>\nCourt  reasoning,  that the candidate having  not  used\t the<br \/>\nmaterial  in spite of the opportunity available to  her<br \/>\nthe possession alone would not attract the provisions of the<br \/>\nRule, in our view, is not borne out from the plain  language<br \/>\nof  the\t Rule.\tMay be, because of strict vigilance  in\t the<br \/>\nexamination hall the candidate was not in a position to take<br \/>\nout  the papers from the pencil box and use the\t same.\t The<br \/>\nvery  fact  that  she  took  the  papers  relevant  to\t the<br \/>\nexamination  in the paper concerned and was found to  be  in<br \/>\npossession of the same by the invigilator in the examination<br \/>\nhall is sufficient to prove the charge of using unfair means<br \/>\nby her in the examination under the Rule.\n<\/p>\n<p>6.
