In\t Civil Appeal Nos. 3882-85 of 1990 and\tSLP  (Civil)<br \/>\nNos. 10832-33 of 1989 this Court by order dated November 18,<br \/>\n1991,  referred\t the disputes and differences  in  the\tsaid<br \/>\nCivil  Appeals\tand  leave applications\t to  arbitration  by<br \/>\nconsent\t of parties.  The order passed on November 18,\t1991<br \/>\nis to the following effect:-\n<\/p>\n<blockquote><p>\t      &#8220;The  disputes and differences referred to  in<br \/>\n\t      the aforesaid matters are by consent  referred<br \/>\n\t      to  the  arbitration of  Mr.J.P.\tThakur,\t Dy.<br \/>\n\t      Chief   Engineer\t(Civil)\t  Koylanagar   P.O.,<br \/>\n\t      Koylanagar District, Dhanbad, Bihar.  Both the<br \/>\n\t      parties undertake to rile a regular  reference<br \/>\n\t      agreement\t before the said  arbitrator  within<br \/>\n\t      two weeks. Award to be made within four months<br \/>\n\t      thereafter.&#8221;\n<\/p><\/blockquote>\n<p>2.   The  sole arbitrator thereafter entered  the  reference<br \/>\nand   parties  to  the\tarbitration  appeared\tbefore\t the<br \/>\narbitrator and made submissions.  The arbitrator  thereafter<br \/>\nmade an award on February 14, 1994 and such award was  filed<br \/>\nbefore\tthis Court by the arbitrator.  The Registry of\tthis<br \/>\nCourt  gave notice of filing of the award on April 29,\t1994<br \/>\nto   the  learned  counsel  for\t both  the   parties.\t The<br \/>\nrespondents  namely  M\/s.  C.K. Ahuja and  another  made  an<br \/>\napplication  under  Section 14(2), 17 and 29 of\t the  Indian<br \/>\nArbitration  Act,  1940 on July II, 1994 before\t this  Court<br \/>\nInter  alia praying that the award dated February  14,\t1994<br \/>\ndelivered by the sole arbitrator, Shri J.P. Thakur, be\tmade<br \/>\nrule  of  Court\t and interest @ 24% be\talso  given  to\t the<br \/>\nappellants  on the awarded sum from the date of\t the  award.<br \/>\nIt  appears  that  Civil Appeal Nos. 3882-85  of  1990\twere<br \/>\nlisted on March 22, 1993 for hearing but in view of the fact<br \/>\nthat the disputes relating to the appeals had been  referred<br \/>\nto  arbitration\t by consent of parties this Court  by  order<br \/>\ndated March 22, 1993 dismissed the said appeals.\n<\/p>\n<p>3.   The  application under Section 14(2), 17 and 29 of\t the<br \/>\nIndian Arbitration Act came up for hearing but on the prayer<br \/>\nof  Mr.G.S. Chatterjee, the learned counsel for\t M\/s  Bharat<br \/>\nCoking\tCoal  Ltd.,  a direction was given  to\tissue  fresh<br \/>\nnotice\ton M\/s Bharat Coking Coal Ltd. about the  filing  of<br \/>\nthe  award.   Such  notice,  however,  was  issued   without<br \/>\nprejudice to the contentions of learned counsel for M\/s C.K.<br \/>\nAhuja and<br \/>\n<span class=\"hidden_text\">134<\/span><br \/>\nanother\t that the period for filing objections\twas  already<br \/>\nbarred\tby limitations.\t The objections to the\taward  have,<br \/>\nhowever, been filed on November 20, 1994.\n<\/p>\n<p>4.   He said applications under Section 14(2), 17 and 29  of<br \/>\nthe  Indian Arbitration Act have been numbered as I.A.\tNos.<br \/>\n912  of 1994 in Civil Appeal Nos. 3882-85 of 1990.   At\t the<br \/>\nhearing of the said applications, learned counsel  appearing<br \/>\nfor  M\/s Bharat Coking Coal Ltd. has contended that  as\t the<br \/>\naward  was not filed and signed in proper manner,  the\tsame<br \/>\nshould\tnot be taken into consideration.  It was  also\tcon-<br \/>\ntended\tthat  the  copy\t of the award  was  required  to  be<br \/>\nsupplied to the parties and since copy of the award was\t not<br \/>\ngiven to Ws Bharat Coking Coal Ltd., the question of  filing<br \/>\nobjections  did\t not arise. it was also contended  that\t the<br \/>\nsaid  award  was not filed in  proper  court.\tAccordingly,<br \/>\nthere was no question of limitation running from the date of<br \/>\nfiling\tthe award.  In support of the contention that  there<br \/>\nwill be no question of limitation if the award is not  filed<br \/>\nin proper court reliance is made to a decision of this Court<br \/>\nin  Slate  Madhya  Pradesh M\/s Saith and  Skelton  (P)\tLtd.<br \/>\n(1972(1)  SCC 702).  It may be stated here that the  learned<br \/>\ncounsel for s Bharat Coking Coal Ltd. took inspection of the<br \/>\naward on October 3, 1994 but the objection to the award\t was<br \/>\nnot filed within thirty days from such inspection.   Disput-<br \/>\ning the said contentions, Mr. Bhandare, the learned  counsel<br \/>\nappearing for Ws C.K. Ahuja and another. has contended\tthat<br \/>\nthe reference to arbitration has been -made by this Court on<br \/>\nthe  prayer  of the parties.  Accordingly,  the\t arbitration<br \/>\nproceedings  have originated in this Court.   Therefore\t the<br \/>\naward\tis   required  to  be  filed  before   this   Court.<br \/>\nConsequently,  the  objection if any to the  award  is\talso<br \/>\nrequired  to  be  filed\t before this  Court,  Ile  has\talso<br \/>\nsubmitted that at no point of time, any objection was raised<br \/>\nby M\/s Bharat Coking Coal Ltd. about the alleged impropriety<br \/>\nin filing the award before this Court even though the notice<br \/>\nof the counsel was drawn about filing of the award in April,<br \/>\n1994.\tEven in the petition of objection filed before\tthis<br \/>\nCourt, no objection has been taken by Ws Bharat Coking\tCoal<br \/>\nLtd.  that the award should not have been filed before\tthis<br \/>\nCourt.\t Accordingly, such contention should not be  allowed<br \/>\nto  be\traised at the hearing of  these\t applications.\t Mr.<br \/>\nBhandare  has  also contended that when the award  has\tbeen<br \/>\nfiled in the Court and the attention of the learned  counsel<br \/>\nof the parties drawn by the Registry of this Court about the<br \/>\nfiling\tof  the award, the period of limitation\t for  filing<br \/>\nobjection  to  such  award will run from  the  date  of\t the<br \/>\nnotice,\t Although on the prayer of the learned\tcounsel\t for<br \/>\nthe  objector,\ta  fresh notice was  issued  later  on,\t the<br \/>\nlimitation  for\t filing\t objection to the  award  cannot  be<br \/>\ncounted from the date of such notice issued subsequently  by<br \/>\nthis  Court at the instance of the learned counsel  for\t M\/s<br \/>\nBharat\tCoking Coal Ltd.  In support of this contention\t Mr.<br \/>\nBhandare  has referred to a decision of this Court  in\tFood<br \/>\nCorporation  of India and others v.E.Kuttappan (JT 1993\t (4)<br \/>\nSC  90).   In  the said decision reference was\tmade  to  an<br \/>\nearlier\t decision  of this Court  in  <a href=\"\/doc\/769322\/\">Nilkantha\t Shidramappa<br \/>\nNinoashetti  v.\t Kashinath Somanna  Ninoashetti\t and  others<\/a><br \/>\n(1962  (2)  SCR 55 1) and <a href=\"\/doc\/1904545\/\">Indian Rayon Corporation  Ltd.  v.<br \/>\nRaunod and Company Pvt. Ltd.<\/a> (1988 (4) SCC 31 ). It has been<br \/>\nheld  in  the decision in Food Corporation of  India&#8217;s\tcase<br \/>\n(supra) that the obligation of filing the award in Court  is<br \/>\na legal imperative on the arbitrator and when<br \/>\n<span class=\"hidden_text\">135<\/span><br \/>\nthe  award was filed in Court and the parties were aware  of<br \/>\nsuch  filing of the award in Court, the limitation  to\tfile<br \/>\nobjection would run from the date of filing the award  being<br \/>\nmade known to the parties, and not from any subsequent\tdate<br \/>\nwhen  a\t notice\t of filing of such  award  was\tsubsequently<br \/>\nissued to the parties concerned.\n<\/p>\n<p>5.   Mr. Bhandare has contended that in the instant case the<br \/>\nRegistry  of this Court specifically drew the  attention  of<br \/>\nthe counsel in April, 1994 about the filing of the award but<br \/>\ndespite\t such  knowledge, the appellant, M\/s  Bharat  Coking<br \/>\nCoal  Ltd. did not choose to file any objection to the\tsaid<br \/>\naward.\tEven after taking inspection of the award on October<br \/>\n3, 1994, the objection has not been filed within a period of<br \/>\nthirty days from such inspection but the objection has\tbeen<br \/>\nfiled only on November 20, 1994.  Accordingly, the objection<br \/>\nto  the\t award\tshould\tnot be considered  as  the  same  is<br \/>\nhopelessly barred by limitation.\n<\/p>\n<p>6.   In\t our view, the contention raised by Mr. Bhandare  in<br \/>\nwhollyjustified.  The Registry of this Court gave notice  to<br \/>\nthe learned counsel for the parties about the filing of\t the<br \/>\naward in April, 1994.  It is nobody&#8217;s case that counsel\t had<br \/>\nan authority to take such notice on behalf of either of\t the<br \/>\nparty.\t It was also open to the counsel to take  inspection<br \/>\nof the award.  As a matter of fact, such inspection was also<br \/>\ntaken  on October 3, 1994 but no objection was filed  within<br \/>\nthirty days either from the notice given by the Registry  in<br \/>\nApril,\t1994 or from the date of inspection of the award  on<br \/>\nOctober 3, 1994.  It has been held by this Court in <a href=\"\/doc\/1679718\/\">State of<br \/>\nMadhya\tPradesh v. M\/s Saith and Skelton (P) Ltd.<\/a> (1972\t (1)<br \/>\nSCC  702)  that where the Arbitrator was  appointed  by\t the<br \/>\nSupreme\t  Court\t by  consent  of  parties  and\tno   further<br \/>\ndirections were given in the said order which would indicate<br \/>\nthat  the  Supreme  Court had not  divested  itself  of\t its<br \/>\njurisdiction  to deal with the award or matters arising\t out<br \/>\nof award, the forum for taking further action is the Supreme<br \/>\nCourt.\t It has also been held in the said decision that  in<br \/>\nthe  absence  of any other court having been  invested\twith<br \/>\nsuch  jurisdiction, the only conclusion that is possible  is<br \/>\nthat  further orders must be passed only by the\t Court\tthat<br \/>\npassed\tthe order, namely, the Supreme Court.  Mr.  Bhandare<br \/>\nhas relied on a later decision of this Court in <a href=\"\/doc\/164087\/\">Punjab State<br \/>\nElectricity Board v. Ludhiana Steels Private Ltd.<\/a> (1993\t (1)<br \/>\nSCC 205)in support of his contention that when reference  to<br \/>\narbitration was made by this Court, the award is to be filed<br \/>\nin  this  Court only.  We may only indicate  that  the\tsaid<br \/>\ndecision  has a distinguishing feature inasmuch as  in\tthat<br \/>\ncase  after  making  reference to  arbitration,\t this  Court<br \/>\nspecifically  directed\tthat  the award\t would\tbe  sent  to<br \/>\nRegistry of this Court.\t In any event, even if it is assumed<br \/>\nthat  the  award  should be filed in other  Court  when\t the<br \/>\nnotice\tof filing of the award was given by the Registry  of<br \/>\nthis Court, objection as to the award including objection as<br \/>\nto forum ought to have to been raised before this Court\t and<br \/>\nit will not be open to the parties to altogether ignore\t the<br \/>\nnotice\tof  filing the award given by the Registry  of\tthis<br \/>\nCourt.\t We may also indicate here that in the\tpetition  of<br \/>\nobjection  it  has not been urged that there  has  been\t any<br \/>\nimpropriety in filing the award in this Court.\tAccordingly,<br \/>\nsuch objection should not be permitted to be raised at\tthis<br \/>\nstage  as  the objection to the award has  been\t filed\tlong<br \/>\nafter\tthe  period  of\t limitation,  the  same\t should\t  be<br \/>\ndismissed.  We may also indicate here that even on merit, we<br \/>\n<span class=\"hidden_text\">136<\/span><br \/>\ndo not think that any interference is called for against the<br \/>\naward.\t We, therefore, allow the Interlocutory\t Application<br \/>\nNos. 9 to 12 of 1994 and direct the award to be made rule of<br \/>\nCourt.\tIt also appears to us that in the facts of the case,<br \/>\nthe applicants M\/s.  C.K. Ahuja and another, are entitled to<br \/>\nget  an award of interest @ 12% from the date of  the  award<br \/>\ntill   realisation.   The  Interlocutory  applications\t are<br \/>\naccordingly disposed of There will be no order as to costs.\n<\/p>\n<p><span class=\"hidden_text\">138<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India M\/S.
