Justice M.SASIDHARAN NAMBIAR\n\n Dated :03\/11\/2009\n\n O R D E R\n              M.SASIDHARAN NAMBIAR,J.\n\n              ------------------------------------------\n               CRL.M.C.NO.3524 OF 2009\n              ------------------------------------------\n\n              Dated      3rd    November 2009\n\n\n                           O R D E R\n<\/pre>\n<p>          Petitioner is the accused in C.C.467\/2008 on<\/p>\n<p>the file of Judicial First Class Magistrate-I, Kannur<\/p>\n<p>taken cognizance for the offence under Sections 323,<\/p>\n<p>324, 427 of Indian Penal Code. Prosecution case is<\/p>\n<p>that petitioner who is a guard attached to KSRTC,<\/p>\n<p>Kannur depot manhandled second respondent in front of<\/p>\n<p>the Station Master&#8217;s office           and inflicted injury with<\/p>\n<p>a dangerous weapon and also caused damages to the<\/p>\n<p>counter  of  the   office        of     the     Station   Master by<\/p>\n<p>breaking glass sheet and committed offences under<\/p>\n<p>Sections 323, 324 and 427 of Indian Penal Code. First<\/p>\n<p>respondent in his capacity as                Controlling Inspector<\/p>\n<p>of   KSRTC lodged the FIR. Petitioner along with<\/p>\n<p>respondents 1 and 2 filed Annexure-1 petition to<\/p>\n<p>compound  the offence and sought permission                  of the<\/p>\n<p>court. By Annexure-2 order, learned Magistrate posted<\/p>\n<p>Annexure-I petition stating that witness who is having<\/p>\n<p>interest over the property to compound the offence<\/p>\n<p>Crmc 3524\/09<br \/>\n<span class=\"hidden_text\">                              2<\/span><\/p>\n<p>under Section 427 is to be   produced.  This petition is<\/p>\n<p>filed under Section 482 of Code of Criminal Procedure<\/p>\n<p>directing    the  learned  Magistrate   to  record   the<\/p>\n<p>composition.\n<\/p>\n<p>            2.  Learned  counsel   appearing   for   the<\/p>\n<p>petitioner and learned Public Prosecutor were heard.<\/p>\n<p>            3.  Offence  under  Section  427  of  Indian<\/p>\n<p>Penal Code    is compoundable, even without   permission<\/p>\n<p>of the court   by the person  to whom the loss or damage<\/p>\n<p>is caused as provided under Sub Section 1 of Section<\/p>\n<p>320 of Code of Criminal Procedure. So also offence<\/p>\n<p>under Section 323 of Indian Penal Code is compoundable<\/p>\n<p>without permission of the court, by the person to whom<\/p>\n<p>hurt is caused. As the amendment to Sub Section 2     of<\/p>\n<p>Section 320 of Code of Criminal Procedure deleting<\/p>\n<p>offence under Section 324 of Indian Penal Code is not<\/p>\n<p>notified, offence under Section 324       could also be<\/p>\n<p>permitted to be compounded, if sought       for by the<\/p>\n<p>person whom hurt is caused.\n<\/p>\n<p>            4.  Offence under Sections 323 and 324 could<\/p>\n<p>thus be permitted to be compounded as sought for in<\/p>\n<p>Annexure-A1 petition. But offence under Section 427<\/p>\n<p>could be compounded only by the person to whom loss or<\/p>\n<p>Crmc 3524\/09<br \/>\n<span class=\"hidden_text\">                               3<\/span><\/p>\n<p>damage    is  caused  which  could  only by   the  KSRTC.<\/p>\n<p>Therefore, unless a    composition  is sought for by the<\/p>\n<p>Managing Director of KSRTC or on his    directions by the<\/p>\n<p>appropriate    officer,  offence  under Section   427  of<\/p>\n<p>Indian Penal Code cannot be allowed to be compounded.<\/p>\n<p>Learned Magistrate can therefore     grant permission to<\/p>\n<p>compound the offences under Sections 323 and 324 and<\/p>\n<p>proceed with the case       under Section 427 of Indian<\/p>\n<p>Penal Code, if it is not compounded.\n<\/p>\n<p>            Petition is disposed.\n<\/p>\n<\/p>\n<p>                                   M.SASIDHARAN NAMBIAR,<br \/>\n                                               JUDGE.\n<\/p>\n<p>\nuj.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court T.V.Sukumar vs P.K.Vasudevan on 3 November, 2009 IN THE HIGH COURT OF KERALA AT ERNAKULAM Crl.MC.No. 3524 of 2009() 1.
