APPEAL NO.4416\/2008.\nKajod Mal Yadav and Others.\nVERSUS\nBhawani Singh Nathawat and Others.\n\n18.01.2010.\n\nHON'BLE MR.JUSTICE DALIP SINGH\n\nMr.Ashok Singh, for the appellants.\nMr.Amit Gupta, for the respondents.\n*****\n<\/pre>\n<p>\tHeard learned counsel for the parties and perused the impugned order.\n<\/p>\n<p>\tBy the impugned order, the learned trial court has passed an order of temporary injunction accepting the application submitted by the plaintiff-respondent and restraining the defendant-appellants from alienating and raising construction over the land in dispute.\n<\/p>\n<p>\tThe suit is of the year 2007 filed for specific performance of the contract and an order of temporary injunction has remained in force since then and no useful purpose would be served by altering the status quo at this stage.\n<\/p>\n<p>\tIn the facts and circumstances, while dismissing the appeal, I deem it just and proper to direct the learned trial court to expedite the hearing of the suit with the cooperation of both the parties.\n<\/p>\n<p>\tConsequently, the appeal as well as the stay application stand dismissed.\n<\/p>\n<p>\t\t\t\t \t\t(DALIP SINGH),J.\n<\/p>\n<p>Solanki DS, Jr.P.A<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Rajasthan High Court Kajod Mal Yadav vs Bhawani Singh on 18 January, 2010 IN THE HIGH COURT OF JUDICATURE FOR RAJASTHAN AT JAIPUR BENCH, JAIPUR ORDER S.B.CIVIL MISC.
