4. Based on the teiephonic message the S,H.O., he<\/p>\n
rushed to the place of occurrence and accepted the ‘report<\/p>\n
submitted by one Nagaraju regarding the occurrence,,’u’In_:’ <\/p>\n
report, Nagaraju spelt out that at 9.30 a.rh_…<\/p>\n
while he was along side of the road,  saw  <\/p>\n
driving the tempo in questionin a\u00a2_rash a_n7cr..ne’gli’QenitV”g<\/p>\n
manner and having traversedlvlitininindfuitytion  road
\njunction, hit against  to the
\nimpact, several  died and
\nseveral were  was taken
\nup by   the injured to the
\nhospital\ufb01\ufb02on  witnesses to occurrence,<\/p>\n
spot mahazar.wasV”p,rep’a’red:and countersigned by two<\/p>\n
witnesses and d’e_ad’ bodies were shifted to the hospital for<\/p>\n
  ithe\ufb02investigation officer found 10 dead bodies and<\/p>\n
severalrxpe:’rsoras:f.i*njured. During further investigation, the<\/p>\n
 _close””‘–.relativ~e\u00abs of the victims were informed and their<\/p>\n

  PW.31, the Motor Vehicle Inspector examined the<\/p>\n
it Ipfveffiiicle, and certified that the accident was not due to any<\/p>\n
r\u00a7’@”‘<\/p>\n
mechanical fault. Consequently charge sheet was filed<\/p>\n
against the petitioner for offences punishable under<\/p>\n
Sections 279, 337, 338 and 304–A of1.P.C. and the<\/p>\n
was put to trial. He pieaded not guilty.\n<\/p>\n

appellate Court. Assailing the judgments of both the Courts,<\/p>\n

adniitted th.atj_’t:here was loud sound before the accident<\/p>\n
 _ ‘vo_’ccurred.V”‘I;_t supports the version of the accused that the<\/p>\n
   was due to mechanical fauit. Reference is aiso<\/p>\n
 ____”‘.’made to the evidence of PW.31~Motor Vehicle Inspector who<\/p>\n
‘ijadmits that he examined oniy the exterior portion of the<\/p>\n

vehicle and did not find out about the mechanical fault.<\/p>\n
Such evidence supports the case of the accused.<\/p>\n
8. Lastly, he submits that the accused  _<\/p>\n
passengers 10 minutes prior to the accident “ani:lifhen:ce he: .4 “~ it<\/p>\n
could not have reached the high..:4sp_-ee.d.’4”–3n<\/p>\n
Contention is that evidence fafiVs’\u00ab.suhort’roi’ leVgai’v:’e’;{idienVce:\u00e9 to <\/p>\n
sustain a charge for the offence’u:ndser Section 304-A of<\/p>\n
I.P.C.\n<\/p>\n

it  the accused has driven the vehicle in a rash _and<\/p>\n
negligent manner at a piace where one wouid expect
\nreasonabie traffic and also movements of the persons. The<\/p>\n
accident occurred within the iimits of the viilage an'ri:.""the<\/p>\n
accused should have been cautious and alert. He   <\/p>\n
so. He therefore seeks confirmation of the two__Qrders_i.:as_ we'<\/p>\n

 high speed, which hit a roadside tree, and the impact<\/p>\n
  ‘~g_”ener”a~ted was of severe intensity. It had the effect of<\/p>\n
‘V”-____””.\u00e95niVffing life of 16 passengers and render several other<\/p>\n
\ufb02passengers crippied. The accused has unfortunateiy escaped<\/p>\n

may not be strictiy applicable to the charge for which the<\/p>\n
petitioner is subjected to trial. But, it is an ‘.aiVd’.g4_”for<\/p>\n
appreciation of evidence, which is mandate of <\/p>\n
the Evidence Act. Keeping in mind the evidei~’i’ce:i:on”i<\u00e9C'oVrd;:u <\/p>\n
we find that the evidence spelles out the'a,cts"reQriom\u00e9sslion  at<\/p>\n
driving of vehicie by the petitior:e.r–accu,_sedVai'id"i'CgQnstitiiteVs <\/p>\n
rashness and negligence,   from
\nactionable negligence to   V<\/p>\n
