No. 3053 of 2008\n<\/p>\n<p>            &#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;-<br \/>\n         Dated this the 13th day of August, 2008<\/p>\n<p>                               ORDER<\/p>\n<p>      The petitioner faces indictment as 3rd accused in a<\/p>\n<p>prosecution for offences punishable, inter alia, under Sec.324<\/p>\n<p>read with Sec.34 IPC. The petitioner was not arrested at the<\/p>\n<p>crime stage. No notice, processes or summons from court was<\/p>\n<p>ever served on him, it is submitted.               But reckoning the<\/p>\n<p>petitioner as an absconding accused, coercive processes have<\/p>\n<p>been issued against the petitioner by the learned Magistrate.<\/p>\n<p>Such processes are chasing the petitioner now. The petitioner<\/p>\n<p>apprehends imminent arrest.\n<\/p>\n<p>      2. According to the petitioner, he is absolutely innocent.<\/p>\n<p>His absence earlier was not wilful or deliberate.               The<\/p>\n<p>petitioner, in these circumstances, wants to surrender before<\/p>\n<p>the learned Magistrate and seek regular bail. The petitioner<\/p>\n<p><span class=\"hidden_text\"> Crl.M.C. No. 3053 of 2008 -: 2 :-<\/span><\/p>\n<p>apprehends that his application for regular bail may not be<\/p>\n<p>considered by the learned Magistrate on merits, in accordance<\/p>\n<p>with law and expeditiously. It is, in these circumstances, that<\/p>\n<p>the petitioner has come to this Court for a direction to the<\/p>\n<p>learned Magistrate to release him on bail when he appears<\/p>\n<p>before the learned Magistrate.\n<\/p>\n<p>       3.   It is for the petitioner to appear before the learned<\/p>\n<p>Magistrate   and    explain   to  the   learned   Magistrate   the<\/p>\n<p>circumstances under which he could not earlier appear before<\/p>\n<p>the learned Magistrate. I have no reason to assume that the<\/p>\n<p>learned   Magistrate    would    not  consider   the   petitioner&#8217;s<\/p>\n<p>application for regular bail on merits, in accordance with law<\/p>\n<p>and expeditiously.     No special or specific directions appear to<\/p>\n<p>be necessary. Every court must do the same. Sufficient general<\/p>\n<p>directions on this aspect have already been issued in the decision<\/p>\n<p>reported in <a href=\"\/doc\/1516775\/\">Alice George v. Deputy Superintendent of Police<\/a><\/p>\n<p>(2003 (1) KLT 339).\n<\/p>\n<p>      4.   In the result, this Crl.M.C. is dismissed; but with the<\/p>\n<p>observation that if the petitioner surrenders before the learned<\/p>\n<p>Magistrate and seeks bail, after giving sufficient prior notice to<\/p>\n<p>the Prosecutor in charge of the case, the learned Magistrate<\/p>\n<p><span class=\"hidden_text\">Crl.M.C. No. 3053 of 2008 -: 3 :-<\/span><\/p>\n<p>must proceed to pass appropriate orders on merits and<\/p>\n<p>expeditiously &#8211; on the date of surrender itself.<\/p>\n<p>     5.
