Justice K.K.DENESAN\n\n Dated :23\/02\/2007\n\n O R D E R\n                              K.K.DENESAN, J\n\n                       -----------------------------------------\n\n                        W.P.(C)NO.5504  of 2007\n\n                       -----------------------------------------\n\n\n\n           Dated this the 23rd    day  of  February, 2007\n\n\n\n                                  JUDGMENT\n<\/pre>\n<p>      The   petitioner   who   has   been   suffered   five   consecutive<\/p>\n<p>transfers within a span of five months, the last one issued within<\/p>\n<p>an   interval   of   five   days,   has   approached   this   Court   challenging<\/p>\n<p>the   arbitrary   order   passed   by     the   second   respondent     on<\/p>\n<p>9.2.2007.   The   impugned   proceedings   of   the   second   respondent<\/p>\n<p>are   the   continuation   of   a   series   of   orders   of   transfers   and<\/p>\n<p>postings  issued within a period of five or six months and what is<\/p>\n<p>seen from  Ext.P3 order dated   9.2.2007  is that    dislocation has<\/p>\n<p>been  caused  to   118   employees    who   belong   to   the   category  of<\/p>\n<p>Upper Division Clerks.\n<\/p>\n<p>      2. The petitioner was transferred and posted in the Station<\/p>\n<p>where   he   was   working   as   on   9\/2\/2007   by   proceedings   dated<\/p>\n<p>2.2.2007.   Ext.P2   proceedings   dated   2.2.2007   itself   refers   to<\/p>\n<p>another   order   of   the   same   kind   issued   on   25.1.2007.   The<\/p>\n<p><span class=\"hidden_text\">W.P.(C)No.5504\/2007                                            :2:<\/span><\/p>\n<p>petitioner,   prima  facie,  seems   to   be  justified  in   contending   that<\/p>\n<p>human   problems   involved   in   such   frequent   orders   of   transfers<\/p>\n<p>and postings have been totally disregarded and that   the second<\/p>\n<p>respondent   has   been   passing   orders   of   transfers   one   after<\/p>\n<p>another causing heart-burn and hardships to  a major section  of<\/p>\n<p>the   employees   of   the   Panchayat   Department,   just   to   please   a<\/p>\n<p>favoured group whose dictates are translated into action by that<\/p>\n<p>respondent.   Needless   to   state   that   such   transfers   and   postings<\/p>\n<p>will   not   do   any   good   to   the   administration.   It   will   only   cause<\/p>\n<p>unnecessary expenditure to the public exchequer because orders<\/p>\n<p>of   transfers   and   postings   ordered   not   at   the   request   of   the<\/p>\n<p>employees will invite claims for   travelling allowances and other<\/p>\n<p>expenditure. The state machinery will have to spend time, energy<\/p>\n<p>and money to defend those orders when questioned before Court.\n<\/p>\n<p>        3.     This   Court   had       to   pass   an   interim   order   staying   the<\/p>\n<p>operation  of  Ext.P3  in a writ petition filed by another  aggrieved<\/p>\n<p>Upper Division Clerk in W.P.(C)4788\/2007.\n<\/p>\n<p>        4.  The petitioner was relieved before the order of stay was<\/p>\n<p>served on the  concerned authorities. Respondent  No.4 who  was<\/p>\n<p><span class=\"hidden_text\">W.P.(C)No.5504\/2007                                            :3:<\/span><\/p>\n<p>posted   as   substitute   in   the   place   of   the   petitioner   also   got<\/p>\n<p>relieved from the Grama Panchayat where  he was working as on<\/p>\n<p>9.2.2007.\n<\/p>\n<p>        5.   Learned   counsel   for   the   petitioner,   in   the   above<\/p>\n<p>circumstances,  submits   that   the     petitioner   will   be  satisfied,   for<\/p>\n<p>the time being, if     this Court directs the first respondent before<\/p>\n<p>whom   Ext.P4   representation   filed   by   him   is   pending,   to   pass<\/p>\n<p>appropriate  orders, as expeditiously as possible. I am inclined to<\/p>\n<p>grant   the   above   prayer.   Accordingly,   after   hearing   the<\/p>\n<p>Government   Pleader   also   and   without   issuing   notice   to   the   4th<\/p>\n<p>respondent,   this   writ   petition   is   disposed   of   directing   the   first<\/p>\n<p>respondent to consider Ext.P4, having  regard to all relevant facts<\/p>\n<p>and circumstances and to dispose of the same within three weeks<\/p>\n<p>from the date of receipt of a copy of the judgment.
