1.\tThe
\npetitioner has taken out present petition seeking below mentioned
\nrelief(s):-\n<\/p>\n
\t“8.(A)
\nThis Hon’ble Court may be pleased to admit and allow this petition.\n<\/p>\n
(B)
\nThis Hon’ble Court may be pleased to issue a writ of certiorari or a
\nwrit of mandamus or a writ in the nature of mandamus or any other
\nappropriate writ, order or direction, directing the respondent No.1
\nto hear the complaint dated 18.1.2011 within a short period.\n<\/p>\n
(C)\tDuring
\nthe pendency and final disposal of the present petition, this Hon’ble
\nCourt may be pleased to direct the concerned authority to inquire
\ninto the matter and to initiate disciplinary action against the
\nerring officer(s), directing the respondents to provide information
\nto the petitioner which he asked in his application dated 14.7.2010.”\n<\/p>\n
2.\tHeard
\nMs.Bora, learned advocate for the petitioner.\n<\/p>\n
3.\tIt
\nappears that the petitioner herein had made application before the
\nrespondent no.3 seeking certain information which would fall within
\nthe meaning of the term information
\nas defined and contemplated under Clause-2(f) of the Right to
\nInformation Act, 2005.\n<\/p>\n
4.\tIt
\nfurther appears that such request was not considered and\/or granted
\nby the respondent no.3. Ultimately, the petitioner was constrained to
\napproach the respondent no.1 and also the respondent no.2.\n<\/p>\n
5.\tIt
\ncomes out from the record that on 22nd December, 2010, the
\nrespondent no.1 passed certain order and directed the respondent no.2
\ni.e. present respondent no.3 to furnish, on
\npayment of fee, the information mentioned at Point Nos.1 to 5 in the
\nsaid order.\n<\/p>\n
5.1\tThe
\nsaid order was passed under the provisions of Sections 18(1) and
\n18(2) of the Right to Information Act.\n<\/p>\n
5.2\tThe
\npetitioner has approached the Court with the grievance that despite
\nthe said order, the information has not been supplied to the
\npetitioner. The petitioner, therefore, says that this Court should
\nact as executing Authority\/Court and implement and execute the order
\npassed by an authority created under an Act i.e. the respondent nos.1
\nand 2 for not complying with the directions issued by virtue of the
\norder dated 22.12.2010. It appears that the petitioner has, on this
\ncount, made complaint dated 18.01.2011 and the same did not yield any
\nresult. Therefore, present petition.\n<\/p>\n
6.\tMs.Bora,
\nlearned advocate for the petitioner, has heavily relied upon
\nthe provisions of Section 18 of the Right to Information Act and
\nsubmitted that it is the
\nduty of the respondents to supply the information as directed by the
\nrespondent no.1. To that extent the submission by Ms.Bora, learned
\nadvocate for the petitioner, is justified.\n<\/p>\n
7.\tHowever,
\nthe petitioner is not justified in contending that the High Court
\nshould take action for execution of the order passed by the authority
\nunder the Act.\n<\/p>\n
8.\tThis
\nCourt is of the view that the powers under Article 226 of the
\nConstitution of India ought not to be exercised for  execution of the
\norder passed by an Authority constituted under any Statute. The
\nStatute of the prerogative writ of mandamus command by this Court in
\nexercise of the  jurisdiction under Article 226 of the Constitution
\nof India would not be issued for execution of subordinate authority’s
\norders against some other party. The judgment holder is supposed to
\nand required to take out appropriate proceedings before appropriate
\nforum – Court for execution and enforcement of subordinate
\nauthority’s orders.\n<\/p>\n
9.\tThe
\npetitioner ought to take appropriate action under the provisions of
\nthe Right to Information Act,2005 or any other appropriate
\nprovisions, as may be relevant and applicable to enforce and execute
\nthe directions passed by respondent No.1 and get the order duly
\nexecuted.\n<\/p>\n
10.\tFor
\nthe purpose of implementation and execution of the order in question,
\nthe petitioner may take appropriate steps and action as may be
\navailable under law including Section 20 of the Act, however, the
\nprerogative writ and powers under Article 226 of the Constitution of
\nIndia cannot be permitted to be invoked for implementing the order
\npassed by the authority under the Act. Hence, the petition is not
\nentertained.\n<\/p>\n
11.\tIt
\nis, however, clarified that present order will not stand in the way
\nof the petitioner in any manner whatsoever if the petitioner takes
\nout any appropriate proceedings against the erring
\nrespondent\/officer in any Court or Forum including Section 20 and
\nSection 17 of the Act for not implementing the order passed by the
\nrespondent no.1. If and when such proceedings are taken out by the
\npetitioner, the same will be decided in accordance with law.\n<\/p>\n
\tWith
\nthe aforesaid clarifications and observations, the petition is
\ndisposed of.  Rule discharged. No costs.\n<\/p>\n
