     This appeal is preferred under Section 30 of the Workmen’s<\/p>\n
Compensation Act by the 4th respondent before the Workmen’s<\/p>\n
Compensation Commission.        Claimant is the mother of a<\/p>\n
deceased workman. The claimant initiated proceedings arraying<\/p>\n
the appellant as the 4th opposite party.    The claim has been<\/p>\n
allowed. Direction has been issued to deposit the amount. The<\/p>\n
appellant has no dispute about the quantum of money ordered to<\/p>\n
be paid. Her only grievance is that there has been no specific<\/p>\n
direction about the amount which the appellant\/4th opposite<\/p>\n
party\/mother of the deceased is entitled to. She is a dependent<\/p>\n
of the deceased. She is also entitled to compensation. This is<\/p>\n
her short grievance.\n<\/p>\n
     2.   The   appellant,  realising   that  no   direction for<\/p>\n
apportionment is made in the impugned order, had approached<\/p>\n
the Commissioner for Workmen’s Compensation with a petition<\/p>\n
to review the award passed by the Commissioner. By Annexure-<\/p>\n
M.F.A No.247 of 2010-D            2<\/span><\/p>\n
B order, the Commissioner has rejected the said prayer with the<\/p>\n
observation that the appellant can lodge her grievance, if any,<\/p>\n
when enquiry is initiated for apportioning the amount to the<\/p>\n
dependents of the deceased.\n<\/p>\n
      3.    Still claiming to be aggrieved by the impugned award,<\/p>\n
the appellant has come to this Court with this appeal. We must<\/p>\n
remind ourselves that under Section 30 of the Workmen’s<\/p>\n
Compensation Act, an appeal can lie only if a question of law is<\/p>\n
involved.       There is no contention that the Workmen’s<\/p>\n
Compensation Commissioner is obliged to pass an award<\/p>\n
apportioning the amount payable by the employer. The award of<\/p>\n
the Workmen’s Compensation Commissioner can only direct<\/p>\n
deposit of the amount and thereupon under Section 8 of the<\/p>\n
Workmen’s Compensation Act, the Commissioner must take<\/p>\n
steps for distribution of compensation.      A dispute regarding<\/p>\n
apportionment can certainly be raised at the stage of distribution<\/p>\n
of compensation under Section 8 of the Act. In fact, we find that<\/p>\n
in Annexure-B order, the Commissioner has clearly referred to<\/p>\n
that option available to the appellant.\n<\/p>\n
      4.    If the Commissioner chooses to issue directions<\/p>\n
regarding apportionment in the award itself, that may not be an<\/p>\n
illegality. But the fact that direction for apportionment has not<\/p>\n

been issued in the award, cannot by itself be reckoned as<\/p>\n
vitiating the award.\n<\/p>\n
      5.    We are further satisfied that the appellant can be<\/p>\n
saved of the unnecessary expenditure and wastage of resources<\/p>\n
by our issuing a direction to the Commissioner of Workmen’s<\/p>\n
Compensation, Thiruvananthapuram that after the compensation<\/p>\n
amount     is    deposited, while  considering    distribution of<\/p>\n
compensation, notice must be ordered specifically to the<\/p>\n
appellant herein and an order regarding apportionment can and<\/p>\n
ought to be issued only after hearing the appellant herein.<\/p>\n
      6.    Communicate a copy of this judgment to the<\/p>\n
Workmen’s Compensation Commissioner immediately.<\/p>\n
      7.    Hand over a copy of this judgment to the learned<\/p>\n
counsel for the appellant.\n<\/p>\n
      8.    We do not, in these circumstances, perceive the need<\/p>\n
to admit this appeal.     This appeal is, in these circumstances,<\/p>\n
dismissed, but subject to the above specific directions.<\/p>\n
