No. 2423 of 2008\n          -------------------------------------------------\n       Dated this the 26th day of November, 2008\n\n                             ORDER\n<\/pre>\n<p>     The petitioners are accused 1 and 2 and they face<\/p>\n<p>allegation in a crime for offences punishable, inter alia,<\/p>\n<p>under Secs.420, 465 and 471 IPC.             Some of the offences<\/p>\n<p>are not compoundable.            The crux of the allegations<\/p>\n<p>against the petitioners is that they availed a loan from the<\/p>\n<p>3rd respondent &#8211; a Co-operative Bank.                 The loan was<\/p>\n<p>availed offering certain sureties who produced their<\/p>\n<p>documents as security.         Those documents were of the<\/p>\n<p>properties of respondents 4 and 5 herein.                    Those<\/p>\n<p>documents were pledged before the bank in the name of<\/p>\n<p>the sureties.  The loan was advanced and amounts were<\/p>\n<p>availed by the accused.       There was default in repayment<\/p>\n<p><span class=\"hidden_text\">Crl.M.C. No. 2423 of 2008 -: 2 :-<\/span><\/p>\n<p>and arbitration proceedings were initiated before the<\/p>\n<p>authority (R2) under the Kerala Co-operative Societies Act.<\/p>\n<p>In the course of that proceedings, it was contended by<\/p>\n<p>respondents 4 and 5 that they were not the ones who<\/p>\n<p>executed the documents. Some persons had impersonated<\/p>\n<p>them and had executed the documents as sureties in their<\/p>\n<p>absence. They were not available in India and did not and<\/p>\n<p>could not have executed the relevant documents, it was<\/p>\n<p>contended.\n<\/p>\n<p>     2. Respondent No.2, on being satisfied about the<\/p>\n<p>allegations raised, filed a complaint before the police. The<\/p>\n<p>crux of the complaint is that the bank has been defrauded<\/p>\n<p>and the funds have been siphoned out from the coffers of<\/p>\n<p>the Bank fraudulently and dishonestly. The petitioners have<\/p>\n<p>now come before this Court. It is submitted that the 3rd<\/p>\n<p>respondent &#8211; Bank, or respondents 4 and 5 &#8211; the alleged<\/p>\n<p>sureties, have no grievance now and they have compounded<\/p>\n<p>the offences allegedly committed by the petitioners.<\/p>\n<p>Inasmuch as they have compounded the offences, the<\/p>\n<p>powers under Sec.482 Cr.P.C. may be invoked and the<\/p>\n<p><span class=\"hidden_text\"> Crl.M.C. No. 2423 of 2008 -: 3 :-<\/span><\/p>\n<p>proceedings may be brought to premature termination,<\/p>\n<p>contends the learned counsel for the petitioners.<\/p>\n<p>     3. Respondents 3, 4 and 5 have entered appearance<\/p>\n<p>and have confirmed that they have no objection against the<\/p>\n<p>quashing of the proceedings accepting the composition.<\/p>\n<p>     4. In the nature of the allegations raised, it was felt by<\/p>\n<p>this Court that the response of the 2nd respondent must be<\/p>\n<p>ascertained.    The learned Public Prosecutor, after taking<\/p>\n<p>instructions, reports that the 2nd respondent is not willing<\/p>\n<p>to compound the proceedings and to get the proceedings<\/p>\n<p>quashed.    The learned Public Prosecutor submits that this<\/p>\n<p>cannot be reckoned as an offence which is personal and<\/p>\n<p>private between the petitioners herein and respondents 3<\/p>\n<p>to 5.   The Bank functions under the Kerala Co-operative<\/p>\n<p>Societies Act.   The offence has been committed in respect<\/p>\n<p>of the affairs of the Co-operative Bank.   Larger issues are<\/p>\n<p>involved.   Money belonging to the members of the Co-<\/p>\n<p>operative Society have been fraudulently siphoned out from<\/p>\n<p>the coffers of the Bank by the culpable acts of the<\/p>\n<p>petitioners and respondents 3 to 5.   Serious view is bound<\/p>\n<p><span class=\"hidden_text\">Crl.M.C. No. 2423 of 2008 -: 4 :-<\/span><\/p>\n<p>to be taken.     In any view of the matter, it cannot be<\/p>\n<p>assumed that the dispute is one which is private and<\/p>\n<p>personal between the parties.      The 2nd respondent has a<\/p>\n<p>duty as an official of the Co-operative Societies to safeguard<\/p>\n<p>the true interests of the Co-operative Bank including the 3rd<\/p>\n<p>respondent and the fact that the 3rd respondent has<\/p>\n<p>compounded the non-compoundable offences may not be<\/p>\n<p>reckoned as a sufficient justification to quash the<\/p>\n<p>prosecution for the offences punishable under Secs.465 and<\/p>\n<p>471 IPC. The learned Public Prosecutor submits that, in<\/p>\n<p>these circumstances, the invocation of the jurisdiction<\/p>\n<p>under Sec.482 Cr.P.C. is totally unjustified.<\/p>\n<p>     5. I find merit in the opposition raised by the learned<\/p>\n<p>Public Prosecutor on behalf of the State and the 2nd<\/p>\n<p>respondent &#8211; the official of the Co-operative Department. I<\/p>\n<p>am satisfied in the nature of the allegations that the mere<\/p>\n<p>fact that the petitioners as also respondents 3 to 5 have<\/p>\n<p>chosen to come to terms is not sufficient reason to accept<\/p>\n<p>the composition and invoke the jurisdiction under Sec.482<\/p>\n<p>Cr.P.C. I find merit in the contention that the Bank and its<\/p>\n<p><span class=\"hidden_text\">Crl.M.C. No. 2423 of 2008 -: 5 :-<\/span><\/p>\n<p>officials if they were knowingly parties to the fraud may<\/p>\n<p>themselves be liable to face prosecutions as they may have<\/p>\n<p>committed the dishonest acts in respect of the affairs of the<\/p>\n<p>Bank.    It is not necessary for me to delve deeper into that<\/p>\n<p>aspect. Suffice it to say that I am not persuaded to invoke<\/p>\n<p>the extraordinary inherent jurisdiction under Sec.482<\/p>\n<p>Cr.P.C.\n<\/p>\n<p>     6. The learned counsel for the petitioners submits that<\/p>\n<p>the investigation though commenced as early as in 1998,<\/p>\n<p>final report has not been filed.     I am satisfied that the<\/p>\n<p>Investigating Officer must complete the investigation as<\/p>\n<p>expeditiously as possible.\n<\/p>\n<p>     7. State of<\/p>\n<p>Punjab<\/a> (2008 AIR SCW 2287).              The learned counsel for the<\/p>\n<p>respondent\/complainant has entered appearance and confirms<\/p>\n<p>settlement\/composition.      Notice given and the learned Public<\/p>\n<p>Prosecutor shall take instructions.          Call on 7\/10\/08.   The<\/p>\n<p>learned Public Prosecutor undertakes that the petitioners shall<\/p>\n<p>not be arrested till that date.
