Justice P.BHAVADASAN\n\n Dated :08\/11\/2010\n\n O R D E R\n<\/pre>\n<p>            Thottathil B.Radhakrishnan<\/p>\n<p>               &amp; P.Bhavadasan, JJ.\n<\/p>\n<p>  = = = = = = = = = = = = = = = = = = = = = = = =<\/p>\n<p>              R.F.A.No.521 of 2008-E<\/p>\n<p>  = = = = = = = = = = = = = = = = = = = = = = = =<\/p>\n<p>      Dated this the 8th day of November, 2010.<\/p>\n<p>                     Judgment<\/p>\n<p>  Thottathil B.Radhakrishnan, J.<\/p>\n<p>1.Defendant  in  a  suit    for  partition  is   the<\/p>\n<p> appellant. He is the son of the plaintiff.<\/p>\n<p>2.Late Sankaran and the plaintiff had two children;<\/p>\n<p> defendant   and  daughter   Bindu.  Sankaran   died<\/p>\n<p> intestate.   Suit   property    devolved   on   the<\/p>\n<p> plaintiff, defendant and Bindu in equal shares.<\/p>\n<p> The daughter Bindu released her share in favour<\/p>\n<p> of the plaintiff and defendant. Thus, the mother<\/p>\n<p> and son became the co-owners. The mother had to<\/p>\n<p> sue for partition, claiming equal rights.<\/p>\n<p>3.Defendant  pleaded  that   building  was   put  up<\/p>\n<p> spending his funds and that the plaintiff was<\/p>\n<p> residing   with  the   defendant  and   the  income<\/p>\n<p><span class=\"hidden_text\">RFA521\/08               -: 2 :-<\/span><\/p>\n<p>  derived from the building was being given to the<\/p>\n<p>  plaintiff. There is no cogent evidence regarding<\/p>\n<p>  any loan availed or of expenditure incurred in<\/p>\n<p>  that    regard  by  the      defendant.  Under such<\/p>\n<p>  circumstances, the title being not disputed, the<\/p>\n<p>  suit for partition stands.\n<\/p>\n<\/p>\n<p>4.According to the appellant-defendant, even after<\/p>\n<p>  the    preliminary decree,     there  were  distress<\/p>\n<p>  actions by the financing institutions against the<\/p>\n<p>  property and the defendant had paid off amounts<\/p>\n<p>  to   save   the  property    from  distress  action.<\/p>\n<p>  Obviously, this is a matter that could be taken<\/p>\n<p>  care of in the final decree proceedings. The<\/p>\n<p>  plaintiff&#8217;s counsel also states that his client<\/p>\n<p>  had   also  paid  off   amounts    to  the financing<\/p>\n<p>  institutions. Obviously, therefore, both sides<\/p>\n<p>  have claims of having spent funds to preserve the<\/p>\n<p>  suit property pending the litigation.<\/p>\n<p>5.In the aforesaid circumstances, while affirming<\/p>\n<p>  the   preliminary  decree,     we  direct  that the<\/p>\n<p><span class=\"hidden_text\">RFA521\/08              -: 3 :-<\/span><\/p>\n<p>  parties will be at liberty to move in the final<\/p>\n<p>  decree  proceedings  for     appropriate  accounting<\/p>\n<p>  regarding the expenditure incurred by either side<\/p>\n<p>  to clear off the debts and preserve the suit<\/p>\n<p>  property. The payments so made would also be<\/p>\n<p>  reckoned  by  the  court     below  for  appropriate<\/p>\n<p>  adjustments  and  orders      to  provide  equitable<\/p>\n<p>  allotment in the final decree proceedings.<\/p>\n<p>  In   the result,  this      appeal  as  against the<\/p>\n<p>  preliminary decree is dismissed, subject to the<\/p>\n<p>  directions issued herein above as regards the<\/p>\n<p>  final decree proceedings.      The court below will<\/p>\n<p>  consider  expediting     the    proceedings,  having<\/p>\n<p>  regard to the age of the plaintiff.
