Choksi for petitioner and learned AGP<br \/>\nMr.A.L.Sharma for respondent No.1.\n<\/p>\n<p>2.\tIn<br \/>\nthis matter, the Dy. Collector has passed an order on 15.12.2000.<br \/>\nBefore that, on 15.11.2000, a registered notice was served to<br \/>\npetitioner and after hearing the petitioner, order has been passed by<br \/>\nDy. Collector.\n<\/p>\n<p>3.\tThe<br \/>\ncontention raised by learned advocate Mr.Choksi that reply filed by<br \/>\npetitioner was not considered by Dy. Collector. Therefore, against<br \/>\nthe aforesaid order passed by Dy. Collector dated 15.12.2000, appeal<br \/>\nwas preferred by petitioner on 26.2.2001 and on the same day, 25%<br \/>\namount is also deposited by petitioner. He also submitted that till<br \/>\ndate, said appeal is not decided by respondent   Chief Controlling<br \/>\nRevenue Authority and is pending before the said authority. He also<br \/>\nsubmitted that petitioner has not received any intimation from<br \/>\nrespondent authorities in respect to fixing of hearing of appeal.<br \/>\nTherefore, according to his submission, this appeal is still pending<br \/>\nbefore respondent   Chief Controlling Revenue Authority.\n<\/p>\n<p>4.\tIn<br \/>\nlight of this background, if so far aforesaid appeal preferred on<br \/>\n26.2.2001 by petitioner is not decided and if it is pending, then it<br \/>\nis directed to respondent   Chief Controlling Revenue Authority to<br \/>\ndecide appeal preferred by petitioner on 26.2.2001 (Annexure-E,<br \/>\nPage-13) after giving reasonable opportunity of hearing to petitioner<br \/>\nand then,  to pass appropriate reasoned order in accordance with law,<br \/>\nwithin a period of four months from date of receiving copy of present<br \/>\norder and communicate the decision to petitioner immediately.\n<\/p>\n<p>5.\tIn<br \/>\nview of aforesaid observations and directions, present petition is<br \/>\ndisposed of without expressing any opinion on merits.
