No. 10641-C of 2008:\n<\/p>\n<p>                  For the reasons mentioned in the application, the prayer<br \/>\nmade therein is allowed. Applicant-appellant is permitted to file the present<br \/>\nappeal as an indigent person. CM stands disposed of accordingly.\n<\/p>\n<p>RSA No. 3581 of 2008:\n<\/p>\n<p>                  Appellant before this Court was the plaintiff who has<br \/>\nbeen non-suited by the Courts below in a suit for recovery of Rs.10 lakhs as<br \/>\ndamages, expenses etc.<br \/>\n                  The case of the plaintiff as set out in the plaint, was that<br \/>\non 18.9.1995, she had undergone Tubectomy operation at Lala Lajpat Rai<br \/>\nHospital, Railway Coach Factory, Kapurthala, so performed by Dr. Raj<br \/>\nKumar who assured that it is fool-proof method and is fully successful.<br \/>\nHowever, she became pregnant thereafter and therefore, it was alleged that<br \/>\nthe operation had been conducted with negligence and carelessness. The<br \/>\npresent suit has been filed claiming compensation\/damages against the<br \/>\ndoctor and the Union of India etc. The stand of the defendants is that she<br \/>\nwas never assured that the operation is fool-proof method or is 100 per cent<br \/>\nsuccessful but the assurance was given that the operation will be done with<br \/>\nall reasonable care and caution. It was conveyed that such like operations<br \/>\nare not always fool-proof and the consent of plaintiff&#8217;s husband was also<br \/>\ntaken.\n<\/p>\n<p>                    Dr.Raj Kumar who had conducted the operation is<br \/>\n<span class=\"hidden_text\"> RSA No. 3581 of 2008                                                   -2-<\/span><br \/>\nMBBS         and MS in general surgery.       Both the Courts below upon<br \/>\nappreciation of evidence adduced by the parties, have concurrently found<br \/>\nthat the plaintiff has failed to prove negligence on the part of the doctors in<br \/>\nperforming the operation.     The sheet-anchor of the case is consent form,<br \/>\nExhibit D-2, which pertains to the plaintiff. This consent form bears the<br \/>\nsignatures of Gurdip Singh, the husband of the plaintiff.       The said form<br \/>\nhas been proved by DW-2, Harminder Kaur, Nursing Sister, who filled it<br \/>\nand it was also proved by Dr. Raj Kumar who had also signed it.              The<br \/>\nCourts below have concurrently found that there is stipulation in this form<br \/>\nthat there are some chances of failure of the operation. Plaintiff has not<br \/>\nexamined her husband to deny his signatures on the consent form, Exhibit<br \/>\nD-2, nor any expert has been examined to show that the signatures of her<br \/>\nhusband on the said form were forged by the defendants. This led the<br \/>\nCourts below to hold that the plaintiff had already been apprised prior to the<br \/>\noperation that it is not fool-proof method.    The judgment of the Hon&#8217;ble<br \/>\nSupreme Court in <a href=\"\/doc\/811884\/\">State of Haryana v. Smt. Santra,<\/a> 2000(2) RCR(Civil)<br \/>\n739(SC), is of no help to the appellant as the facts therein were altogether<br \/>\ndifferent.    A 3-Judge Bench of the Hon&#8217;ble Supreme Court in <a href=\"\/doc\/1599759\/\">State of<br \/>\nPunjab v. Shiv Ram and others<\/a>, 2005(4) RCR (Civil)100, has observed as<br \/>\nfollows:-\n<\/p>\n<blockquote><p>                        &#8221; 21. We are, therefore, clearly of the opinion that<br \/>\n                        merely because a woman having undergone a<br \/>\n                        sterilization   operation   became     pregnant      and<br \/>\n                        delivered a child, the operating surgeon or his<br \/>\n                        employer cannot be held liable for compensation on<br \/>\n                        account of unwanted pregnancy or unwanted child.<br \/>\n                        The claim in tort can be sustained only if there was<br \/>\n                        negligence on the part of the surgeon in performing<br \/>\n                        the surgery. The proof of negligence shall have to<br \/>\n                        satisfy Bolam&#8217;s test. So also, the surgeon cannot be<br \/>\n                        held liable in contract unless the plaintiff alleges<br \/>\n                        and proves that the surgeon had assured 100%<br \/>\n                        exclusion of pregnancy after the surgery and was<br \/>\n                        only on the basis of such assurance that the plaintiff<br \/>\n                        was persuaded to undergo surgery.        As noted in<br \/>\n<span class=\"hidden_text\"> RSA No. 3581 of 2008                                              -3-<\/span><br \/>\n                         various decisions   which we have referred     to<br \/>\n                         hereinabove, ordinarily a surgeon does not offer<br \/>\n                         such guarantee.&#8221;\n<\/p><\/blockquote>\n<p>The judgment in Shiv Ram&#8217;s case(supra) has also been followed by the<br \/>\nHon&#8217;ble Supreme Court in another judgment in <a href=\"\/doc\/37068\/\">State of Haryana and<br \/>\nothers v. Raj Rani,<\/a> 2005(4) RCR(Civil) 169. Nothing has been shown that<br \/>\nthe findings of fact so recorded by the Courts below suffer from any<br \/>\ninfirmity or are contrary to the record.
