DENESAN, J.\n\n\n\n                 = = = = = = = = = = = = = = =\n\n                   W.P.(C) No. 2490 OF 2007 U\n\n                 = = = = = = = = = = = = = = =\n\n\n\n               Dated this the 22nd January, 2007\n\n\n\n                          J U D G M E N T\n<\/pre>\n<p>     The   petitioner   is   working   as   Range   Officer   in   the<\/p>\n<p>Forest   Department.     It   is   contended   that   he   is   duly<\/p>\n<p>qualified   and   eligible   to   be   considered   for   promotion<\/p>\n<p>to   the   post   of   Assistant   Conservator   of   Forests,   but<\/p>\n<p>his name is likely to be eschewed from consideration by<\/p>\n<p>the Departmental Promotion Committee on the ground that<\/p>\n<p>disciplinary   proceedings   are   pending   against   him.\n<\/p>\n<p>Counsel   for   the   petitioner   submits   that   the   rules   do<\/p>\n<p>not   permit   the   D.P.C.   to   exclude   persons   who   are<\/p>\n<p>otherwise   qualified   and   eligible   for   consideration   by<\/p>\n<p>the   D.P.C.   on   the   ground   of   pendency   of   disciplinary<\/p>\n<p>proceedings.\n<\/p>\n<p>     2.   There   is   substance   in   the   above   contention.\n<\/p>\n<p>Ext.   P4   representation   filed   by   the   petitioner   before<\/p>\n<p>respondents   1   and   2   is   pending   consideration.     Hence,<\/p>\n<p>there shall be an order directing the 1st  respondent to<\/p>\n<p>consider   Ext.   P4   and   take   appropriate   decision   as   per<\/p>\n<p>rules   within   one   month   from   the   date   of   receipt   of   a<\/p>\n<p>copy of the judgment.   If, in the meantime, the D.P.C.\n<\/p>\n<p><span class=\"hidden_text\">WPC No. 2490\/2007               -2-<\/span><\/p>\n<p>holds   its   meeting,   the   records   relating   to   he<\/p>\n<p>petitioner   shall  also  be  placed  before  that  D.P.C.  and<\/p>\n<p>his   case   also   considered   provisionally   subject   to<\/p>\n<p>further orders to be passed on Ext. P4.\n<\/p>\n<p>        The   petitioner   shall   produce   a   copy   of   the<\/p>\n<p>judgment along with a copy of the writ petition before<\/p>\n<p>the 1st respondent for due compliance.\n<\/p>\n<p>                                               K.K.
