Justice M.SASIDHARAN NAMBIAR\n\n Dated :20\/09\/2010\n\n O R D E R\n          M.SASIDHARAN NAMBIAR,J.\n\n           ---------------------------------------------\n             W.P.C.NO.26278 OF 2010\n           ---------------------------------------------\n           Dated 20th          September, 2010\n\n\n                         JUDGMENT\n<\/pre>\n<p>          Petitioner, the second accused in<\/p>\n<p>C.C.193\/2008     on the file of Judicial First<\/p>\n<p>Class Magistrate&#8217;s Court-II, Kottayam filed<\/p>\n<p>this  petition           under           Article          227   of<\/p>\n<p>Constitution     of      India          for        a    writ   of<\/p>\n<p>certiorari      to quash                   C.C.193\/2008 and<\/p>\n<p>C.C.222\/2008     and permit                the petitioner to<\/p>\n<p>deposit Rs.12,150\/- being the loss suffered<\/p>\n<p>by the K.S.E.B or in the alternative to<\/p>\n<p>direct the      learned Magistrate                       to accept<\/p>\n<p>the  deposit        of        Rs.12,150\/0               from   the<\/p>\n<p>petitioner and to take steps                       in accordance<\/p>\n<p>with the compromise or to direct the second<\/p>\n<p>respondent to accept the loss quantified<\/p>\n<p>at Rs.12,150\/-, evidenced by Ext.P8 and<\/p>\n<p>Wpc 26278\/10<br \/>\n<span class=\"hidden_text\">                          2<\/span><\/p>\n<p>allow      the learned Magistrate  to take further<\/p>\n<p>steps. C.C.193\/2008      was taken cognizance for<\/p>\n<p>the offences under Sections 451, 332, 341 and<\/p>\n<p>506(i) read with Section 34 of Indian Penal<\/p>\n<p>Code and Section 3(2)(a) of P.D.P.P Act, 1984<\/p>\n<p>on Ext.P1 final report. C.C.222\/2008 was taken<\/p>\n<p>cognizance against fourth respondent in Ext.P3<\/p>\n<p>final report, for the offence under Section 324<\/p>\n<p>of Indian Penal Code. Ext.P1 final report shows<\/p>\n<p>that prosecution case is that on 4\/3\/2008 at<\/p>\n<p>about 3 p.m      due to previous enmity of     the<\/p>\n<p>three accused against fourth respondent, they<\/p>\n<p>in    furtherance   of   their  common   intention<\/p>\n<p>trespassed into K.S.E.B office and threatened<\/p>\n<p>fourth      respondent  and    caused  hurt   and<\/p>\n<p>obstructed fourth respondent from discharging<\/p>\n<p>his    duty   as   Assistant  Engineer  and   also<\/p>\n<p>damaged the furniture and records of K.S.E.B<\/p>\n<p>Wpc 26278\/10<br \/>\n<span class=\"hidden_text\">                          3<\/span><\/p>\n<p>office and thereby committed the offences under<\/p>\n<p>Sections 451, 332, 341 and 506(i) read with<\/p>\n<p>Section 34 of Indian Penal Code and Section 3<\/p>\n<p>(2)(a)      of  P.D.P.P.Act.  On   the   materials<\/p>\n<p>furnished,    cognizance   taken  in  C.C.193\/2008<\/p>\n<p>cannot be quashed as sought for. So also there<\/p>\n<p>cannot      be a   direction  to   the     learned<\/p>\n<p>Magistrate to accept the damages and to settle<\/p>\n<p>the dispute.\n<\/p>\n<p>           2. Learned   counsel appearing for the<\/p>\n<p>petitioner     then  submitted   that  by   Ext.P8<\/p>\n<p>Assistant Executive Engineer, Manarcad      sought<\/p>\n<p>directions of second respondent, Secretary      of<\/p>\n<p>K.S.E.B     intimating  the  willingness  of   the<\/p>\n<p>petitioner     to  pay   damages  of   Rs.12,150\/-<\/p>\n<p>sustained by K.S.E.B and no order has been<\/p>\n<p>passed in Ext.P8 and a direction be issued to<\/p>\n<p>pass    orders  in   Ext.P8.
