Justice ANTONY DOMINIC\n\n Dated :15\/01\/2008\n\n O R D E R\n                         ANTONY DOMINIC, J.\n             ------------------------------------\n                        W.P.(C) 1753 of 2008\n             -------------------------------------\n                       Dated: January 15, 2008\n\n                               JUDGMENT\n<\/pre>\n<p>      Petitioner&#8217;s team had participated in Margamkali in the district<\/p>\n<p>level higher secondary youth festival. They were given 6th prize.<\/p>\n<p>They had filed Ext.P3 appeal and that too has been rejected by<\/p>\n<p>Ext.P4.  It is stated in Ext.P3 that the stage was in a very poor<\/p>\n<p>condition and that had affected their performance. It is also stated<\/p>\n<p>that one of the participants had suffered a serious injury and<\/p>\n<p>according to the petitioner, all these have contributed for the poor<\/p>\n<p>performance.\n<\/p>\n<p>      2. Irrespective of all these, the fact remains that the petitioner<\/p>\n<p>has got 6th place in the ranking. If that be so, it will be too unfair to<\/p>\n<p>direct that the petitioner be allowed to participate in the State level<\/p>\n<p>competition.    It is also to be remembered that others too had<\/p>\n<p>performed in the same stage. If that be so, the stage condition,<\/p>\n<p>though not of the desired level, could not have caused any special<\/p>\n<p>prejudice to the petitioner.
