DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 30\/04\/2010 \n\n \n\nORAL\nORDER<\/pre>\n<p>\tOn<br \/>\n24.2.2010, learned Single Judge (Corma: Hon&#8217;ble Mr. Justice Akil<br \/>\nKureshi) passed following order in Special Criminal Application<br \/>\nNo.278 of 2010:\n<\/p>\n<p> This<br \/>\npetition is filed by the wife of the respondent no.2 for enhancement<br \/>\nin the interim maintenance fixed by the Family Court at Rs.5,000\/-<br \/>\nper month. It is the case of the petitioner that the husband earns<br \/>\nincome to the tune of Rs.20.00 lacs per year. Counsel drew my<br \/>\nattention to the documents produced at Annexures-C &amp; D to the<br \/>\npetition. He, however, submitted that the respondent has not<br \/>\ndisclosed his present status of employment and related details.\n<\/p>\n<p>\tRule<br \/>\nreturnable on 18th March, 2010. Learned A.P.P., Mr.Kartik<br \/>\nPandya waives service of notice of rule on behalf of the respondent<br \/>\nno.1-State.\n<\/p>\n<p>\tTo<br \/>\nbe placed in admission board.\n<\/p>\n<p>\tThe<br \/>\nrespondent no.2 shall file an affidavit disclosing his earning and<br \/>\nemployment details including the current income. If he is employed by<br \/>\nany Company, details of such Company along with the documentary proof<br \/>\nof salary and if he claims to be self-employed, he shall state the<br \/>\nsource of income and shall produce income tax returns of last three<br \/>\nyears along with the affidavit.\n<\/p>\n<p>\tDirect<br \/>\nservice is permitted.\n<\/p>\n<p>\tOn<br \/>\n19.4.2010, this Court passed the following order in Special Criminal<br \/>\nApplication No. 278 of 2010:\n<\/p>\n<p> Mr.\n<\/p>\n<p>Saurabh Mehta, learned advocate appearing for Ms. Anuja S. Nanavaty,<br \/>\nlearned advocate appearing for respondent No.2 submits that to comply<br \/>\nwith the order dated 24th February 2010, time be granted.\n<\/p>\n<p>\tShri<br \/>\nP.M. Thakkar, learned senior counsel for Mr. T.S. Nanavati, learned<br \/>\nadvocate for the applicant submits that the above order was passed on<br \/>\n24th February 2010 and the same remains not complied with<br \/>\nand therefore, appropriate directions be given.\n<\/p>\n<p>\tIf<br \/>\nno reply as directed in the order dated 24th February 2010<br \/>\nis filed, on or before 26th April 2010, the matter will be<br \/>\nheard on its own merits.\n<\/p>\n<p>\tCopy<br \/>\nof the reply, if any, be given to the learned counsel appearing for<br \/>\nthe respondent No.2 on 23rd April 2010.\n<\/p>\n<p>\tTo<br \/>\nbe heard with Special Criminal Application Nos.2429\/2009 and<br \/>\n2430\/2009.\n<\/p>\n<p>\tAnd<br \/>\non 26.4.2010, this Court in Special Criminal Application No.2429\/2009<br \/>\nwith Special Criminal Application No.278\/2010 and Special Criminal<br \/>\nApplication No.2430\/2009 passed following order:\n<\/p>\n<p> When<br \/>\nthe matters are called out for hearing, Mr.S.I.Nanavati, learned<br \/>\nSenior Advocate appearing with Mr.Saurabh Mehta for<br \/>\nrespondent-husband, submitted that he has already retired from the<br \/>\nproceedings as per the instructions received from his client.\n<\/p>\n<p>\tLearned<br \/>\nadvocate Mr.B.P.Gupta states that he would file vakalatnama during<br \/>\nthe course of day and also places on record affidavit in reply filed<br \/>\nby respondent No.2<\/p>\n<p>\tMr.P.M.Thakkar,<br \/>\nlearned Senior Advocate, appearing with Mr.T.S.Nanavati for the<br \/>\npetitioner submits that by orders dated 24.02.2010 and 19.04.2010 the<br \/>\nrespondent No.2 was directed to produce source of income and Income<br \/>\nTax Returns of last three years along with affidavit, however, the<br \/>\nrespondent No.2 has not produced such details, and therefore, orders<br \/>\ndated 24.02.2010 and 19.04.2010 remained not complied with.\n<\/p>\n<p>\tIn<br \/>\nview of the above, time is granted till 30.04.2010  to respondent<br \/>\nNo.2 to comply with the above orders, failing which appropriate<br \/>\norders will be passed on that day.\n<\/p>\n<p>\tS.O.\n<\/p>\n<p>To 30.04.2010.\n<\/p>\n<p>\tOn<br \/>\nperusal of the affidavit filed by respondent No.2 dated 30th<br \/>\nApril, 2010, according to this Court, the orders above passed by,<br \/>\nhave remained non-complied with as Income Tax Returns are not<br \/>\nproduced on record.   Therefore, issue bailable warrant for sum of<br \/>\nRs.5,000\/- today and further hearing of all the above cases will take<br \/>\nplace on 4.5.2010.\n<\/p>\n<p>\tDirect<br \/>\nservice is permitted.\n<\/p>\n<p>[ANANT<br \/>\nS.
