Moreover, from the averments<br \/>\nmade in the application it is apparent there is no deliberate or<br \/>\nintentional delay on the part of the applicants nor have they ever<br \/>\ngiven up the cause. In the circumstances, the delay deserves to be<br \/>\ncondoned.\n<\/p>\n<p>4.\t\tFor the<br \/>\nforegoing reasons, the application succeeds and is accordingly<br \/>\nALLOWED. The delay of 180 days caused in filing second<br \/>\nappeal No.145 of 2011 is hereby condoned.
