{"id":28957,"date":"2010-06-22T00:00:00","date_gmt":"2010-06-21T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/vishwesh-nath-vs-state-of-u-p-through-principal-on-22-june-2010"},"modified":"2016-12-02T15:34:51","modified_gmt":"2016-12-02T10:04:51","slug":"vishwesh-nath-vs-state-of-u-p-through-principal-on-22-june-2010","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/vishwesh-nath-vs-state-of-u-p-through-principal-on-22-june-2010","title":{"rendered":"Vishwesh Nath vs State Of U.P.Through Principal &#8230; on 22 June, 2010"},"content":{"rendered":"<div class=\"docsource_main\">Allahabad High Court<\/div>\n<div class=\"doc_title\">Vishwesh Nath vs State Of U.P.Through Principal &#8230; on 22 June, 2010<\/div>\n<pre>                                   1\n\n                                                            Court No.3\n                 Writ Petition No.5648 (MB) of 2010\n\nVishwesh Nath                                      ...Petitioner\n                                Versus\nState of U.P. and others                           ...Opp.parties.\n                                 ***\nHon'ble Shri Narayan Shukla,J.\n<\/pre>\n<p>Hon&#8217;ble Devendra Kumar Arora,J.\n<\/p>\n<p>     Counter affidavit filed by the State is taken on record.<\/p>\n<p>      Heard Mr.Raghvendra Kumar Singh, Senior Advocate assisted<\/p>\n<p>by Mr.Anurag Kumar Singh, learned counsel for the petitioner,<\/p>\n<p>Mr.Sanjay Bhasin, learned Additional Chief Standing Counsel for the<\/p>\n<p>State, Mr.Vinod Kumar Singh, Senior Advocate assisted by Mr.Ashok<\/p>\n<p>Kumar Shukla, learned counsel for opposite party No.4.<\/p>\n<p>      The petitioner has challenged the order dated 8th of June, 2010,<\/p>\n<p>issued by the State Government, whereby in exercise of power<\/p>\n<p>provided under Section 21-A of U.P.Kshettra Panchayat and Zila<\/p>\n<p>Panchayat Adhiniyam, 1961 (hereinafter referred to as the &#8216;Act&#8217;) the<\/p>\n<p>State Government has appointed a three member committee to<\/p>\n<p>discharge the functions of Adhyaksha of Zila Panchayat.<\/p>\n<p>      The learned counsel for the petitioner submits that earlier three<\/p>\n<p>member committee was appointed to discharge the function of<\/p>\n<p>Adhyaksha of Zila Panchayat in exercise of power provided under<\/p>\n<p>Section 29 of the Act during the course of enquiry. Though on the<\/p>\n<p>result of enquiry the Adhyaksha Smt. Malti Singh, has been removed<\/p>\n<p>from the office, but since no election has taken place, the Committee<\/p>\n<p>appointed to discharge the function of Adhyaksha is still entitled to<br \/>\n<span class=\"hidden_text\">                                     2<\/span><\/p>\n<p>continue till the next election takes place. He further submits that it is<\/p>\n<p>not the new committee, but one member of the earlier committee has<\/p>\n<p>been replaced and in place of one Shri Vishwesh Nath, Smt. Malti<\/p>\n<p>Devi, the opposite party No.4, has been appointed as member of the<\/p>\n<p>committee at the behest of one local M.L.A., who recommended her<\/p>\n<p>name. The letter of M.L.A. has also been brought on record as<\/p>\n<p>Annexure No.5. Thus he submits that the change in the Committee is<\/p>\n<p>absolutely political in nature and that vitiates the appointment of the<\/p>\n<p>Committee itself.\n<\/p>\n<p>      On the other hand Mr.Vinod Kumar Singh, learned counsel for<\/p>\n<p>the opposite party No.4 submits that as soon as the enquiry is over<\/p>\n<p>and the Adhyaksha of the Zila Panchayat is removed, the operation<\/p>\n<p>of the provisions of Section 29 of the Act also becomes over and<\/p>\n<p>immediately thereafter the role of provisions of Section 21-A comes<\/p>\n<p>into play, in exercise of which the State Government can make an<\/p>\n<p>arrangement as it thinks fit for discharge of function of said<\/p>\n<p>Adhyaksha.      Section 21-A of the Act provides for temporary<\/p>\n<p>arrangement when the office of Adhyaksha is vacant or he is unable<\/p>\n<p>to discharge his functions owing to absence, illness or any other<\/p>\n<p>cause. Here in the present case it is not in dispute that after removal<\/p>\n<p>of the Adhyaksha, Smt. Malti Singh, the office of Adhyaksha of Zila<\/p>\n<p>Panchayat has become vacant.\n<\/p>\n<p>      In the light of the aforesaid provisions as well as backdrop of<\/p>\n<p>the facts, he submits that there is no error in appointment of another<br \/>\n<span class=\"hidden_text\">                                     3<\/span><\/p>\n<p>Committee in exercise of power provided under Section 21-A of the<\/p>\n<p>Act and that is entitled to discharge the function of Adhyaksha till<\/p>\n<p>the next election takes place, thus he supports the action of the State<\/p>\n<p>Government in issuing the order impugned.\n<\/p>\n<p>       As per direction of this court the learned Additional Chief<\/p>\n<p>Standing Counsel also produced the relevant record, which reveals<\/p>\n<p>that the conduct of Mr.Vishwesh Nath, one member of the earlier<\/p>\n<p>Committee has been found against the interest of the Government,<\/p>\n<p>therefore, his replacement became necessary resulting to which he has<\/p>\n<p>been replaced by Smt. Malti Devi.\n<\/p>\n<p>      Before making any discussion on the arguments raised by the<\/p>\n<p>parties, we feel it appropriate to reproduce the provisions of Section<\/p>\n<p>29 as well as provisions of Section 21-A of the Act, which are<\/p>\n<p>reproduced hereunder:-\n<\/p>\n<blockquote><p>      29. Removal of Adhyaksha or (xxx)-(1) If in the opinion<br \/>\n      of the State Government the Adhyaksha or the (xxx)<br \/>\n      while acting in place of Adhyaksha wilfully omits or<br \/>\n      refuses to perform his duties or functions under this Act<br \/>\n      or abuses the powers vested in him or is found to be<br \/>\n      guilty of misconduct in the discharge of his duties, [or<br \/>\n      because     physically   or   mentally   incapacitated   for<br \/>\n      performing his duties] the        State Government, after<br \/>\n      giving the Adhyaksha or (xxx), as the case may be, a<br \/>\n      reasonable opportunity for explanation may by order<br \/>\n      remove him from office [and such order shall be final<br \/>\n      and not open to be questioned in a Court of law]:\n<\/p><\/blockquote>\n<blockquote><p>                [Provided that where in an enquiry held by such<br \/>\n<span class=\"hidden_text\">                                    4<\/span><\/p>\n<p>      person and in such manner as may be prescribed, an<br \/>\n      Adhyaksha or (xxx) is prima facie found to have<br \/>\n      committed financial and other irregularities such<br \/>\n      Adhyaksha or (xxx) shall cease to exercise and perform<br \/>\n      the financial and administrative powers and functions,<br \/>\n      which shall, until he is exonerated of the charges in the<br \/>\n      final enquiry, be exercised and performed by a committee<br \/>\n      consisting of three elected members of the Zila<br \/>\n      Panchayat appointed in this behalf by the State<br \/>\n      Government.]<br \/>\n      (2) [xxx]<br \/>\n      (3) An Adhyaksha or [xxx], removed from his office<br \/>\n      under this section, shall not be eligible for election as<br \/>\n      Adhyaksha or [xxx] for a period of three years from the<br \/>\n      date of his removal.\n<\/p><\/blockquote>\n<blockquote><p>      Section 21-A of the Act is reproduced hereunder:-<br \/>\n      21-A. Temporary arrangement in certain cases.- When<br \/>\n      the office of the Adhyaksha is vacant or he is unable to<br \/>\n      discharge his functions owing to absence, illness or any<br \/>\n      other cause, the State Government may by order, make<br \/>\n      such arrangement, as it thinks fit, for the discharge of the<br \/>\n      functions of such Adhyaksha until the date on which the<br \/>\n      Adhyaksha resumes his duties.]&#8221;<\/p><\/blockquote>\n<p>      Upon perusal of the provisions of Section 29 of the Act we find<\/p>\n<p>that the provisions of Section 29 of the Act, so far as it relates to<\/p>\n<p>appointment of Committee consisting of three elected members of<\/p>\n<p>Zila Panchayat to discharge the function of Adhyaksha is concerned,<\/p>\n<p>that remains operative till final decision is taken in the matter and as<\/p>\n<p>soon as the enquiry is concluded with the result in either way, the role<br \/>\n<span class=\"hidden_text\">                                     5<\/span><\/p>\n<p>of this provision comes to an end.        Therefore, the argument of<\/p>\n<p>Mr.Raghvendra Kumar Singh, Senior Advocate that the role of<\/p>\n<p>Section 29 of the Act comes to an end only on the event of<\/p>\n<p>exoneration of the President from the charges in dispute does not<\/p>\n<p>convince us to interfere in the matter.\n<\/p>\n<p>      In the present case on the result of enquiry i.e. removal of<\/p>\n<p>Adhyaksha of Zila Panchayat from the office of the Adhyaksha, the<\/p>\n<p>post became vacant. Thereafter the role of the State Government<\/p>\n<p>came into play to make an arrangement for discharge the functioning<\/p>\n<p>of Adhyaksha in exercise of power provided under Section 21-A of<\/p>\n<p>the Act in the nature of temporary arrangement, even State<\/p>\n<p>Government also took action accordingly, therefore, we find no error<\/p>\n<p>in appointment of three member committee in exercise of powers<\/p>\n<p>provided under Section 21-A of the Act by the State Government.<\/p>\n<p>      Only one fact which appeals to us to interfere in the order is the<\/p>\n<p>letter of the M.L.A. of Ruling Party, who through his letter<\/p>\n<p>recommended the replacement of Mr.Vishwesh Nath as his activity<\/p>\n<p>was against the interest of the Government by another member<\/p>\n<p>namely Smt. Malti Devi. Though the letter is not in the original<\/p>\n<p>record of the file, but noting in the file itself reveals that the said<\/p>\n<p>ground has been taken in notice for his replacement and that is only<\/p>\n<p>the ground for appointment of the opposite party No.4 as a member of<\/p>\n<p>the Committee.\n<\/p>\n<p><span class=\"hidden_text\">                                     6<\/span><\/p>\n<p>        The functioning of Zila Panchayat or the Committee in place<\/p>\n<p>there of, is a democratic functions and it should gain the faith of the<\/p>\n<p>public irrespective of interest of any political party either it is ruling<\/p>\n<p>or in opposition. In such a matter in order to maintain the rule of<\/p>\n<p>democracy and to avoid the misuse of power by the Ruling party to<\/p>\n<p>nominate its favourite persons as members of the Committee, it is<\/p>\n<p>advisable to the State Government to frame an appropriate Legislation<\/p>\n<p>in this regard to appoint the Members of Committee only with the<\/p>\n<p>consent\/resolution    of   the   majority    members      of   the   Zila<\/p>\n<p>Panchayat\/local body.\n<\/p>\n<p>      Keeping in view this fact as well as rule of democracy, we think<\/p>\n<p>it proper to hold that let a meeting of the members of the Zila<\/p>\n<p>Panchayat be called upon to hold the meeting and to elect three<\/p>\n<p>members amongst them to appoint as members of the Committee to<\/p>\n<p>discharge the function of the Adhyaksha. We are informed that all the<\/p>\n<p>members of the Zila Panchayat are also elected directly by the public,<\/p>\n<p>therefore, the opinion of the members of the Zila Panchayat shall be<\/p>\n<p>the opinion of the public and in such a manner             definitely the<\/p>\n<p>democracy shall prevail.     Therefore, we hereby provide, that the<\/p>\n<p>District Magistrate concerned shall proceed for holding of a meeting<\/p>\n<p>of the Zila Pancyayat within one month for the aforesaid exercise and<\/p>\n<p>he shall recommend the names of those three members in vavour of<\/p>\n<p>whom resolution of the majority of members of the Zila Panchayat<\/p>\n<p>are there for appointment as members of the Committee to the State<br \/>\n<span class=\"hidden_text\">                                     7<\/span><\/p>\n<p>Government. Thereafter very soon the State Government shall<\/p>\n<p>constitute a Committee accordingly to function as Adhyaksha of the<\/p>\n<p>Zila Panchayat.\n<\/p>\n<p>      In the meantime the District Magistrate shall have the control<\/p>\n<p>over the functioning of Zila Panchayat.\n<\/p>\n<p>      With the aforesaid observations and directions the order<\/p>\n<p>impugned dated 8.6.2010, passed by the State Government, is hereby<\/p>\n<p>quashed and the writ petition is disposed of finally.<\/p>\n<p>Dated:22.6.2010<br \/>\nBanswar\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Allahabad High Court Vishwesh Nath vs State Of U.P.Through Principal &#8230; on 22 June, 2010 1 Court No.3 Writ Petition No.5648 (MB) of 2010 Vishwesh Nath &#8230;Petitioner Versus State of U.P. and others &#8230;Opp.parties. *** Hon&#8217;ble Shri Narayan Shukla,J.
