Heard
\n\tlearned advocate Mr. SN Barot on behalf of petitioner, learned AGP
\n\tMr. Maulik Nanavati appearing for respondent.\n<\/p>\n
The
\n\tservice of petitioner has been terminated by order dated 23\/11\/2010
\n\tpage 13 Annexure A, against which petition has been preferred being
\n\tSCA no. 16544\/2010, which was decided by this Court on 4\/5\/2011 and
\n\tpassed following order:\n<\/p>\n
“1.\tThis
\npetition, under Article 226 of the Constitution of India, has been
\nfiled, with the following prayers :-\n<\/p>\n
“A)\tYOUR
\nLORDSHIPS be pleased to admit and allow the present petition of the
\npetitioner.\n<\/p>\n
B)
\nYOUR LORDSHIPS be pleased to issue appropriate writ of mandamus,
\ncertiorari, prohibition, or any other suitable writ, order or
\ndirection which the Hon’ble Court may deem fit and directed the
\nrespondent no.1 to 6 to take back present petitioner in service at
\nthe post from which present petitioner terminated i.e. “ANGANVADI
\nKENDRA JALSAN-12(JALSAN GAM)”.\n<\/p>\n
C)
\nYOUR LORDSHIPS be pleased to issue appropriate writ of mandamus,
\ncertiorari, prohibition, or any other suitable writ, order or
\ndirection which the Hon’ble Court may deem fit and be pleased to
\nquashed and set aside the termination letter dated: 23\/11\/2010 at
\nANNEXURE:A.\n<\/p>\n

\nimplementation of the recruitment proceeding initiated by way of

\nJALSAN-12(JALSAN GAM)”.\n<\/p>\n

\nthe representation of present petitioner dated:9\/12\/2010 at

\npetition may please be quantified suitable and be paid to the

2.\tThe
\npetitioner is Anganwadi Karyakar and has been appointed as such on
\n08.04.1991. By impugned order dated 20.11.2010, the petitioner has
\nbeen removed from the post of Anganwadi Karyakar pursuant to a
\nsurprise inspection that took place on 04.09.2010.\n<\/p>\n
3.\tThe
\nmain grievance of the petitioner, as voiced in the present petition,
\nis that the impugned order has been passed without affording her an
\nopportunity of hearing and also that the said order is not a reasoned
\none.\n<\/p>\n
4.\tWhen
\nthe matter is taken up for hearing today, Mr. H.S. Munshaw, learned
\nadvocate for respondent No.3 states, upon instructions from Ms.
\nAvantika Singh, District Development Officer, Anand that the
\ncompetent authority will issue a notice to the petitioner and the
\npetitioner shall be afforded an opportunity of personal hearing and
\nof filing a reply to the show-cause notice. After hearing the
\npetitioner and considering the reply, a fresh order shall be passed,
\nin accordance with law.\n<\/p>\n
5.\tIn
\nview of the above statement being made by the learned advocate for
\nrespondent No.3 and as there is no dispute to the fact that no
\nhearing has been given to the petitioner before passing the impugned
\norder, the said order dated 20.11.2010, passed by respondent No.3, is
\nquashed and set aside. The petitioner shall make herself available
\nfor the personal hearing and cooperate in the proceedings and
\nrespondent No.3 shall intimate the petitioner regarding the order,
\nwhen passed.\n<\/p>\n
\tIt
\nis clarified that the impugned order has been quashed and set aside
\non the ground that it has been passed without affording the
\npetitioner an opportunity of hearing and other grounds have not been
\ngone into.\n<\/p>\n
6.\tThe
\npetition is disposed of, in the above terms. Notice is discharged.”\n<\/p>\n
In
\n\trespect to above referred order, learned advocate Mr. Barot brought
\n\tto notice of this Court statement which has been made by learned
\n\tadvocate Mr. Munshaw for respondent no. 3 that competent authority
\n\twill issue notice to petitioner and petitioner shall be afforded an
\n\topportunity of personal hearing of filing reply to show cause
\n\tnotice.  Thereafter, fresh order shall be passed in accordance with
\n\tlaw.\n<\/p>\n
Therefore,
\n\tlearned advocate Mr. Barot submitted that personal visit made by
\n\tState Program Officer, ICDS, Woman and Child Development,
\n\tGandhinagar, in Jalsan village Taluka Khambat, Anganvadi Kendra No.\n<\/p>\n
\t12.  The State Program Officer has made report wherein at nos. 1 to
\n\t6 irregularities has been taken into account against present
\n\tpetitioner.  On that basis, by letter dated 13\/10\/2011, report was
\n\tsubmitted with recommendation to terminate service of petitioner.
\n\tAlong with notice issued to petitioner, letter in which allegations
\n\thave been made by State Program Officer has not been supplied to
\n\tpetitioner. Learned advocate Mr. Barot also pointed out that no show
\n\tcause notice in respect to  giving detail about allegations has been
\n\tserved to petitioner.\n<\/p>\n
Therefore,
\n\tit is directed to District Development Officer, Anand to supply
\n\treport of personal visit made by State Program Officer, ICDS, Woman
\n\tand Child Development,  village Jalsan, Taluka Khambhat, Anganvadi
\n\tKendra No. 12 and also issue show cause notice giving details about
\n\tallegation which was made against petitioner within a period of
\n\tfifteen days from date of receiving copy of present order.\n<\/p>\n
Let
\n\tsuch show cause notice is to be served to petitioner. Thereafter,
\n\trespondent is directed to give an opportunity of hearing and to file
\n\treply against show cause notice to petitioner.  Then to pass
\n\tappropriate reasoned order after considering reply submitted by
\n\tpetitioner within a period of two months from date of receiving copy
\n\tof present order and communicate decision to petitioner immediately.\n<\/p>\n
It
\n\tis made clear by this Court that while taking fresh decision as per
\n\tdirection issued by this Court earlier decision which has been taken
\n\tby respondent may not be taken into account and not to be influenced
\n\tby that.\n<\/p>\n
In
\n\tview of above observation and directions, present petition is
\n\tdisposed of by this Court, without expressing any opinion on merits.\n<\/p>\n
