It is also stated in the<br \/>\naffidavit-in-reply that this Court may pass appropriate order as deem<br \/>\nfit and proper in best interest of justice.\n<\/p>\n<p>4.\t\tThe<br \/>\nrespondent No.2 &#8211; Chief Branch Manager, Bank of Baroda, lodged<br \/>\ncomplaint against present petitioners for the offences punishable<br \/>\nunder Sections 409, 420, 120B and 114 of IPC. From the plain reading<br \/>\nof the complaint, there is no allegation of creating forged documents<br \/>\nor forged signature in the documents. As the present petitioner could<br \/>\nnot pay amount towards loan, this complaint is filed.\n<\/p>\n<p>5.\t\tIt<br \/>\nis submitted by the learned advocate for the petitioner that no<br \/>\namount is due and payable towards the respondent bank &#8211; Bank of<br \/>\nBaroda and now respondent No.2 &#8211; original complainant has no<br \/>\ngrievance against the present petitioner and requests to quash the<br \/>\ncomplaint.\n<\/p>\n<p>6.\t\tIn<br \/>\nview of above, to continue criminal proceedings would amount to<br \/>\nharassment to the petitioner as they have already paid the amount to<br \/>\nrespondent No.2 Bank. The respondent No.2 &#8211; Bank of Baroda has<br \/>\nno grievance against the present petitioner.\n<\/p>\n<p>7.\t\tThe<br \/>\nApex Court in the case of Madan Mohan Abbot Vs. State of Punjab<br \/>\nreported in (2008)4 Supreme Court Cases page 582 has observed<br \/>\nas under in paras 5 and 7 of the<br \/>\njudgment:\n<\/p>\n<p>&#8220;5.\n<\/p>\n<p>It is on the basis of this compromise that the application was filed<br \/>\nin the High Court for quashing of proceedings which has been<br \/>\ndismissed by the impugned order. We notice from a reading of the FIR<br \/>\nand the other documents on record that the dispute was purely a<br \/>\npersonal one between two contesting parties and that it arose out of<br \/>\nextensive business dealings between them and that there was<br \/>\nabsolutely no public policy involved in the nature of the allegations<br \/>\nmade against the accused. We are, therefore, of the opinion that no<br \/>\nuseful purpose would be served in continuing with the proceedings in<br \/>\nthe light of the compromise and also in the light of the fact that<br \/>\nthe complainant has, on 11th January 2004, passed away and the<br \/>\npossibility of a conviction being recorded has thus to be ruled out.&#8221;\n<\/p>\n<p>&#8220;7.\n<\/p>\n<p>We see from the impugned order that the learned Judge has confused a<br \/>\ncompounding of an offence with the quashing of proceedings. The outer<br \/>\nlimit of Rs.250\/- which has led to the dismissal of the application<br \/>\nis an irrelevant factor in the later case. We accordingly allow the<br \/>\nappeal and in the peculiar facts of the case, direct that FIR No.155<br \/>\ndated 17th November 2001 P.S. Kotwali, Amritsar and all proceedings<br \/>\nconnected therewith shall be deemed to be quashed.&#8221;\n<\/p>\n<p>8.\t\tApplying<br \/>\nthe ratio of the aforesaid decision of the Apex Court to the facts of<br \/>\nthe present case, I am of the opinion that this Criminal<br \/>\nMiscellaneous Application is required to be allowed and the parties<br \/>\nbe permitted to compound the offence.\n<\/p>\n<p>9.\t\tIn<br \/>\nthe result, this Criminal Miscellaneous Application is allowed. The<br \/>\ncomplaint being I.C.R.No.10 of 2007 registered before DCB Police<br \/>\nStation, Vadodara, and the proceedings therein are required to be<br \/>\nquashed and are accordingly quashed. Rule is made absolute.
