PUBLIC PROSECUTOR for Respondent(s) : 1, \nMR BD KARIA\nfor Respondent(s) : 2, \n==========================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMS.JUSTICE H.N.DEVANI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 14\/10\/2008 \n\n \n\n \n \nORAL\nJUDGMENT<\/pre>\n<p>By<br \/>\n\tthis application under Section 482 of the Code of Criminal<br \/>\n\tProcedure, 1973 (the Code), the applicant has prayed to quash<br \/>\n\tCriminal Case No.1096 of 2001 pending in the Court of the learned<br \/>\n\tJudicial Magistrate First Class, at Pardi, District Valsad.\n<\/p>\n<p>The<br \/>\n\tfacts of the case stated briefly are that the respondent No.2 herein<br \/>\n\thad lodged a complaint before the learned Judicial Magistrate First<br \/>\n\tClass, at Pardi alleging commission of the offence under Section 499<br \/>\n\tof the Indian Penal Code (IPC) against the present applicant and<br \/>\n\tanother which came to be registered as Criminal Case No.1096 of<br \/>\n\t2001.  The allegation in the complaint is to the effect that the<br \/>\n\taccused No.1 ?  Shri Avesh Ismail Kaizer, Legal Executive,<br \/>\n\trepresenting the respondent No.2 Company had filed a complaint on<br \/>\n\t6th September, 1997 before the GIDC Police Station, Vapi<br \/>\n\twith the intention of giving false statement and allegations against<br \/>\n\tthe complainant&#8217;s involvement in duplication of products like<br \/>\n\tCastrol CRB Plus, Castrol Dusol, Castrol GTX, Castrol 2 Tek and<br \/>\n\tCastrol Super TT, which are the products of the accused Company.  On<br \/>\n\tthe basis of the information given by the accused No.1, the GIDC,<br \/>\n\tVapi Police Station registered First Information Report being Vapi<br \/>\n\tPolice Station I ?  C.R. No.126 of 1997 and arrested the<br \/>\n\tcomplainant.  Not only that, pursuant to the lodging of the<br \/>\n\tcomplaint, the same was published in a leading newspaper [Sandesh].<br \/>\n\tAccording to the complainant, the contents of the said publication<br \/>\n\twere defamatory in nature which lowered the reputation and image of<br \/>\n\tthe complainant.  It is the case of the complainant that pursuant to<br \/>\n\tthe complaint, he was arrested and subsequently released on bail and<br \/>\n\tfurther investigation was made by the police.  However, the<br \/>\n\tcomplainant had not received any correspondence from the police or<br \/>\n\tfrom the Court.  Therefore, the complainant inquired about the<br \/>\n\tmatter from Pardi Court and came to know that chargesheet had been<br \/>\n\tsubmitted by the police authority after completing the<br \/>\n\tinvestigation.  Therefore, the complainant obtained certified copy<br \/>\n\tof the chargesheet and investigation report, and the orders of the<br \/>\n\tcourt, which according to the complainant, confirmed that he had<br \/>\n\tbeen released and acquitted from the chargesheet and the Court has<br \/>\n\tpassed an order to that effect.  According to the complainant, the<br \/>\n\tcause of action arose from the date of knowledge of the facts, after<br \/>\n\tobtaining the certified copy of the relevant reports and chargesheet<br \/>\n\tfrom the Court.\n<\/p>\n<p>Pursuant<br \/>\n\tto the complaint, the learned Judicial Magistrate First Class, Pardi<br \/>\n\texamined the complainant on oath and vide order dated 7th<br \/>\n\tMarch, 2001, directed issuance of summons against the accused<br \/>\n\tpersons, namely, the applicant and another.  Being aggrieved, the<br \/>\n\tapplicant has moved the present application for quashing the said<br \/>\n\tcomplaint.\n<\/p>\n<p>Heard<br \/>\n\tMr.Nigam Shukla, learned advocate for the applicant, Mr.Mukesh<br \/>\n\tPatel, learned Additional Public Prosecutor for respondent No.1 ?<br \/>\n\tState of Gujarat and Mr.B.D.Karia, learned advocate for respondent<br \/>\n\tNo.2.\n<\/p>\n<p>The<br \/>\n\tlearned advocate for the applicant has drawn the attention of the<br \/>\n\tCourt to certain factual aspects of the matter.  It is submitted<br \/>\n\tthat the First Information Report had been lodged by the accused<br \/>\n\tNo.1, Legal Executive, on 6th September, 1997; the<br \/>\n\tnewspaper reports were published on 7th and 8th<br \/>\n\tSeptember, 1997; the report under Section 169 of the Code of<br \/>\n\tCriminal Procedure, 1973 (the Code) had been filed by the police on<br \/>\n\t23rd November, 1997 and the same had been accepted by the<br \/>\n\tconcerned Court on 1st December, 1997, whereas the<br \/>\n\tpresent complaint has been lodged on 7th March, 2001.  It<br \/>\n\tis submitted that, in case of an offence committed under Section 499<br \/>\n\tof the IPC, punishment is provided under Section 500, which provides<br \/>\n\tfor simple imprisonment for a term which may extend to two years or<br \/>\n\twith fine or both.  It is submitted that, Section 468(2)(c) of the<br \/>\n\tCode provides that, in case of an offence which is punishable with<br \/>\n\timprisonment for a term exceeding one year, but not exceeding three<br \/>\n\tyears, cognizance of the complaint can be taken within a period of<br \/>\n\tthree years from the time of commission of the offence.  It is<br \/>\n\tsubmitted that, in the facts of the present case, the offence can be<br \/>\n\tstated to have been committed on 6th September, 1997 when<br \/>\n\tthe First Information Report was lodged on or 7th or 8th<br \/>\n\tSeptember, 1997 when the newspaper reports has been published.  It<br \/>\n\tis submitted that in the circumstances, the complaint which is filed<br \/>\n\ton 7th March, 2001 is barred by limitation inasmuch as it<br \/>\n\tis filed beyond the period of three years from the date of the<br \/>\n\toffence.\n<\/p>\n<p>It<br \/>\n\tis further contended that even on merits, insofar as the present<br \/>\n\tapplicant who is the Managing Director of the Company, is concerned,<br \/>\n\the is in no way connected with the offence in question inasmuch as<br \/>\n\the is not the complainant insofar as the First Information Report<br \/>\n\tlodged against the respondent No.2 ?  complainant is concerned.  It<br \/>\n\tis submitted that in the circumstances, there is absolutely no case<br \/>\n\tagainst the present applicant.\n<\/p>\n<p>In<br \/>\n\tsupport of his submissions, the learned advocate for the applicant<br \/>\n\thas placed reliance upon the following decisions of the Supreme<br \/>\n\tCourt :\n<\/p>\n<p>[a]\tRamesh<br \/>\nChandra Sinha v. State of Bihar,<br \/>\n(2003)7 SCC 254.\n<\/p>\n<p>[b]\t<a href=\"\/doc\/398318\/\">State<br \/>\nof Punjab v. Sarwan Singh, AIR<\/a> 1981 SC 1054.\n<\/p>\n<p>[c]\tSrinivas<br \/>\nPal v. Union Territory of Arunachal Pradesh, AIR 1988 SC<br \/>\n1729.\n<\/p>\n<p>[d]\t<a href=\"\/doc\/885750\/\">Surinder<br \/>\nMohan Vikal v. Ascharj Lal Chopra, AIR<\/a> 1978 SC 986.\n<\/p>\n<p>On<br \/>\n\tthe other hand, Mr.B.D.Karia, learned advocate for the respondent<br \/>\n\tNo.2 ?  original complainant has opposed the application.  It is<br \/>\n\tsubmitted that the limitation would start from the date of knowledge<br \/>\n\tand that, the respondent No.2 ?  complainant came to know about the<br \/>\n\treport under Section 169 of the Code being accepted by the Court<br \/>\n\tonly subsequently, and therefore, the limitation would start from<br \/>\n\tthat date.  In the circumstances, the complaint filed by the<br \/>\n\trespondent No.2 is well within the period of limitation.  It further<br \/>\n\tsubmitted that the present petition has been filed by the Managing<br \/>\n\tDirector, M\/s Castrol India Ltd., without specifically naming the<br \/>\n\tperson who is the Managing Director.  It is submitted that in the<br \/>\n\tcircumstances, the application itself is not maintainable.\n<\/p>\n<p>This<br \/>\n\tCourt has considered the submissions advanced by the learned<br \/>\n\tadvocates for the parties and has perused the record of the case.<br \/>\n\tInsofar as the contention regarding the application not being<br \/>\n\tmaintainable as having been filed through the Managing Director<br \/>\n\twithout the person being named, is concerned, the same has to be<br \/>\n\tstated to be rejected.  As can be seen from the affidavit<br \/>\n\taccompanying the petition, the same is affirmed by one Shri Ramesh<br \/>\n\tAmrutrao Savoor as Managing Director of Castrol India Limited.<br \/>\n\tBesides, in the complaint filed by the respondent No.2, accused No.2<br \/>\n\tis not a named person, but is a Managing Director of M\/s Castrol<br \/>\n\tIndia Limited.  In the circumstances, no fault can be found with the<br \/>\n\tapplicant in naming the Managing Director as the applicant in the<br \/>\n\tcause title of the application.\n<\/p>\n<p>Insofar<br \/>\n\tas the contention regarding the complaint being barred by limitation<br \/>\n\tis concerned, the same merits acceptance.    Though the learned<br \/>\n\tadvocate for the applicant has cited various decisions of the<br \/>\n\tSupreme Court, it would not be necessary to refer to each of them in<br \/>\n\tdetail, inasmuch as the decision of the Supreme Court in the case of<br \/>\n\t<a href=\"\/doc\/885750\/\">Surinder Mohan Vikal v. Ascharj Lal Chopra (Supra)<\/a><br \/>\n\tdirectly concludes the issue in favour of the applicant herein.  In<br \/>\n\tthe said decision, the Court has held that a complaint under Section<br \/>\n\t500, Penal Code for defamation will be barred if filed three years<br \/>\n\tafter the commission of the offence.  Where in a complaint under<br \/>\n\tSection 500 it is alleged that the defamatory matter was contained<br \/>\n\tin a complaint under Sections 406\/420, Penal Code against the<br \/>\n\tcomplainant, the period of limitation for filing complaint under<br \/>\n\tSection 500, Penal Code would commence from the date of the<br \/>\n\tcomplaint under Section 406\/420, Penal Code and not from the date<br \/>\n\tthe complainant was finally acquitted of offences under Sections<br \/>\n\t406\/420, Penal Code.  In the facts of the present case, the First<br \/>\n\tInformation Report against the complainant had been filed on 6th<br \/>\n\tSeptember, 1997, hence, the limitation would commence from the said<br \/>\n\tdate.  Whereas, the present complaint has been lodged on 7th<br \/>\n\tMarch, 2001, which is much beyond the period of limitation of three<br \/>\n\tyears.  In the circumstances, the complaint is required to be<br \/>\n\tquashed as being barred by limitation.  This is, therefore, a fit<br \/>\n\tcase for exercise of powers under Section 482 of the Code.\n<\/p>\n<p>\tFor<br \/>\n\tthe foregoing reasons, the application succeeds and is, accordingly,<br \/>\n\tallowed.  The complaint being  Criminal Case No.1096 of 2001 pending<br \/>\n\tin the Court of the learned Judicial Magistrate First Class, at<br \/>\n\tPardi, District Valsad, is hereby quashed qua the present<br \/>\n\tpetitioner.
