P4 is the order under challenge.   Proceedings<\/p>\n<p>were  initiated    against   the  petitioner&#8217;s  vehicle<\/p>\n<p>bearing   registration   No.   KL-55A\/1934   and   that<\/p>\n<p>culminated in Ext. P4 order of the District Collector.<\/p>\n<p>    2.   From a reading of Ext. P4 it is evident that<\/p>\n<p>the allegation was that there was an attempt to load<\/p>\n<p>river sand, that on knowing that the police party are<\/p>\n<p>arriving, the vehicle was sped away and that the<\/p>\n<p>vehicle was intercepted later and proceedings were<\/p>\n<p>initiated.   The order does not say that there was<\/p>\n<p>actual loading of river sand or transportation of the<\/p>\n<p>same.\n<\/p>\n<p>    3. Despite this, petitioner has been found to have<\/p>\n<p>violated Rule 29(8) of the Kerala Protection of River<\/p>\n<p><span class=\"hidden_text\">W.P.(C) No. 32252OF 2007            -2-<\/span><\/p>\n<p>Banks &amp; Regulation of Removal of Sand Rules, 2002 and<\/p>\n<p>on that finding, the value of the vehicle of Rs.<\/p>\n<p>35,000\/- is ordered to be realised and Rs.25,000\/- is<\/p>\n<p>imposed as fine.          It is this order that is under<\/p>\n<p>challenge.\n<\/p>\n<p>     4. The main contention raised by the petitioner is<\/p>\n<p>that in the absence of actual transportation of river<\/p>\n<p>sand, he could not have been levied the value or fine<\/p>\n<p>in terms of the powers conferred on the District<\/p>\n<p>Collector.      It is also stated that Rule 29(8) which is<\/p>\n<p>found to have been violated by the petitioner is<\/p>\n<p>totally alien to the facts of the case.<\/p>\n<p>     5. I have gone through Ext. P4 order and I am<\/p>\n<p>inclined to agree with the learned counsel for the<\/p>\n<p>petitioner that all that is found is that there was an<\/p>\n<p>attempt on the part of the vehicle for loading of river<\/p>\n<p>sand.    Rule 29(8) which is found to have been violated<\/p>\n<p>by the petitioner only provides that those who purchase<\/p>\n<p>river sand shall        obtain a pass and keep the same and<\/p>\n<p>shall not transport or keep the sand at any place,<\/p>\n<p>without the said pass.        On the allegations that have<\/p>\n<p>raised     against     the  petitioner this  rule  is   not<\/p>\n<p><span class=\"hidden_text\">W.P.(C) No. 32252OF 2007           -3-<\/span><\/p>\n<p>attracted at all.\n<\/p>\n<p>     6. Even otherwise, in the absence of a finding<\/p>\n<p>that there        has been loading and transportation of<\/p>\n<p>river sand, Rule 27 is totally inapplicable.     In view<\/p>\n<p>of this, Ext. P4 proceedings is totally unsustainable<\/p>\n<p>and the said order is liable to be quashed and I do so.<\/p>\n<p>Any deposit that is made by the petitioner shall<\/p>\n<p>necessarily      be    released.
