APP (DB) No.878 of 2009\n                                          RAJAN TIWARI\n                                                 Versus\n                                 STATE OF BIHAR THRU.CBI\n                                              -----------\n<\/pre>\n<p>                 For the appellant: Mr. Rana Pratap Singh, Sr. Advocate<br \/>\n                                     Mr. Subodh Kumar Jha, Advocate<br \/>\n                                     Mr. Amrendra Kumar, Advocate<br \/>\n                                     Mr. Jitendra Kr Pandey, Advocate<br \/>\n                  For the C.B.I.: Mr. Bipin Kumar, Advocate\n<\/p>\n<p>                                                &#8212;&#8212;&#8212;\n<\/p>\n<p>9   23-03-2011              Heard learned counsel for the appellant and<\/p>\n<p>                 learned counsel for the Central Bureau of Investigation.<\/p>\n<p>                            On behalf of the appellant it has been<\/p>\n<p>                 submitted that now the appellant has remained in custody<\/p>\n<p>                 for a total period of 12 years in connection with the<\/p>\n<p>                 present case. It has further been submitted that prayer of<\/p>\n<p>                 the appellant for bail was last rejected by this court on<\/p>\n<p>                 06-05-2010 and this court was misled on that occasion<\/p>\n<p>                 by submission made on behalf of Central Bureau of<\/p>\n<p>                 Investigation that the period of custody should not be<\/p>\n<p>                 counted as claimed by the appellant because in this case<\/p>\n<p>                 he was granted bail on 28-7-2004 although it does not<\/p>\n<p>                 matter that he was not released pursuant to that order of<\/p>\n<p>                 bail.\n<\/p>\n<p>                            In this case two persons were killed in the<\/p>\n<p>                 alleged incident, one was Brij Bihari Prasad who was<br \/>\n<span class=\"hidden_text\">                            2<\/span><\/p>\n<p>        facing some criminal cases from before and the other<\/p>\n<p>        victim was his bodyguard. The allegation against this<\/p>\n<p>        appellant is of firing at the bodyguard along with some<\/p>\n<p>        others.\n<\/p>\n<p>                  Although the period of custody appears to be<\/p>\n<p>        12 years but against the order refusing bail passed by this<\/p>\n<p>        court on 6-5-2010 the appellant had moved the Apex<\/p>\n<p>        Court vide Special Leave to Appeal (Crl) bearing<\/p>\n<p>        CRLMP No. 17477\/2010 and the same was dismissed as<\/p>\n<p>        withdrawn on 25-08-2010. In view of order of the<\/p>\n<p>        Supreme Court, we are not inclined to grant bail to the<\/p>\n<p>        appellant.
