HEMA, J.\n       - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - -\n                        B.A. No. 5777 of 2008\n        - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - -\n         Dated this the 25th day of September,2008\n\n                                 O R D E R\n<\/pre>\n<p>       Petition for anticipatory bail.\n<\/p>\n<p>       2. The alleged offences are under sections 407, 468, 471,<\/p>\n<p>420, 409 read with section 34 IPC. According to prosecution,<\/p>\n<p>the Hindustan News Print Ltd. was allowed to cut and remove<\/p>\n<p>eucalyptus trees from a portion of the forest. Passes were also<\/p>\n<p>issued by the forest officials for cutting and removing trees from<\/p>\n<p>the forest. Petitioner is a Supervisor of Hindustan News Print Ltd.<\/p>\n<p>and he has to countersign the passes. 152 loads of eucalyptus<\/p>\n<p>trees were removed from the forest, but only 118 loads reached<\/p>\n<p>to the Hindustan News Print Ltd. 34 loads were misappropriated<\/p>\n<p>and for this purpose passes were forged by the contractors with<\/p>\n<p>the aid of petitioner is the allegation.\n<\/p>\n<p>       3. Learned counsel for                 petitioner submitted that<\/p>\n<p>petitioner is still working in the Hindustan News Print Ltd. He is<\/p>\n<p>only a Supervisor who has to issue chalans for sales-tax. He also<\/p>\n<p>counter signs the passes. But, he has only countersigned only<\/p>\n<p>118 passes and he is absolutely innocent of the allegations<\/p>\n<p>made. He has no role in actually transporting the wood from the<\/p>\n<p>forest.  Petitioner      was      repeatedly        interrogated        by the<\/p>\n<p>BA 5777 \/08                        -2-\n<\/p>\n<p>Investigating Officer and hence his further interrogation may not<\/p>\n<p>be required.\n<\/p>\n<p>       4. Learned counsel for petitioner also submitted that the<\/p>\n<p>petitioner has no involvement in the 34 loads which are<\/p>\n<p>misappropriated. He has not countersigned          any passes for<\/p>\n<p>transporting such loads. The Management of the Hindustan<\/p>\n<p>Newsprint Ltd is convinced that the petitioner is innocent and<\/p>\n<p>after two days of suspension, petitioner was reinstated in<\/p>\n<p>service and still he is working in the Hindustan Newsprint Ltd<\/p>\n<p>as Supervisor. In such circumstances, anticipatory bail may be<\/p>\n<p>granted, it is submitted.\n<\/p>\n<p>      5. This petition is opposed.    Learned Public Prosecutor<\/p>\n<p>submitted that it is not correct to say that petitioner has no role<\/p>\n<p>in the transaction. Petitioner as the Supervisor used to be<\/p>\n<p>present when the trees were cut and removed and transported<\/p>\n<p>from the forest. Without his knowledge, the offence cannot be<\/p>\n<p>committed, since the passes are required to be countersigned<\/p>\n<p>by petitioner. As per the allegation, the passes are forged and<\/p>\n<p>petitioner is also involved in the forgery for the purpose of<\/p>\n<p>removing 34 loads unauthorizedly under the guise it is for the<\/p>\n<p>purpose of Hindustan News Print Ltd. Learned Public Prosecutor<\/p>\n<p>BA 5777 \/08                        -3-\n<\/p>\n<p>conceded that the petitioner is interrogated by the police and<\/p>\n<p>petitioner may not be required for further interrogation.<\/p>\n<p>      7. On hearing both sides, I find that the petitioner can be<\/p>\n<p>granted anticipatory bail and the following order is passed:-<\/p>\n<blockquote><p>            Petitioner   shall  surrender    before   the<\/p>\n<p>      Magistrate Court concerned within ten days from<\/p>\n<p>      today and if bail application is filed, he shall be<\/p>\n<p>      released on bail on his executing a bond for<\/p>\n<p>      Rs.25,000\/- with two solvent sureties each for the<\/p>\n<p>      like sum to the satisfaction of the learned<\/p>\n<p>      Magistrate, on the following conditions:<\/p>\n<\/blockquote>\n<blockquote><p>            i)   Petitioner shall co-operate with the<\/p>\n<p>                  investigation.\n<\/p><\/blockquote>\n<blockquote><p>            ii)   Petitioner shall report before the<\/p>\n<p>                  investigating officer as and when<\/p>\n<p>                  directed.\n<\/p><\/blockquote>\n<blockquote><p>            iii) Petitioner shall not tamper with<\/p>\n<p>                  evidence or commit any offence while<\/p>\n<p>                  on bail.\n<\/p><\/blockquote>\n<blockquote><p>      Petition is allowed.\n<\/p><\/blockquote>\n<blockquote>\n<\/blockquote>\n<blockquote><p>                                  K.HEMA, JUDGE<\/p>\n<p>       mn.<\/p>\n<\/blockquote>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court P.K.Kesavan vs State Of Kerala on 25 September, 2008 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 5777 of 2008() 1.
