It is<br \/>\n\talso ordered that both the offences shall run concurrently.\n<\/p>\n<p>Aggrieved<br \/>\n\tby the aforesaid judgment and order the appellant No.1 &#8211;<br \/>\n\tAmichandbhai alias Amabhai Bhikhabhai Patel and appellant No.2 &#8211;<br \/>\n\tLaliben Bhikhabhai have filed Criminal Appeal No.1377 of 1993 with<br \/>\n\tthe aid of Section 374(2) of the Cr.P.C. challenging the order or<br \/>\n\tconviction and sentence recorded against them, whereas State of<br \/>\n\tGujarat has filed Criminal Appeal No.412 of 1994 with the aid of<br \/>\n\tSection 377 of the Cr.P.C. challenging the order of sentence on the<br \/>\n\tground of same being inadequate and for enhancement of sentence.\n<\/p>\n<p>At<br \/>\n\tthe time of hearing of these appeals, we have noticed the submission<br \/>\n\tmade by the Registry of this Court, wherein it is inter-alia stated<br \/>\n\tthat Mr.H.L.Patel, learned advocate, who has filed appearance on<br \/>\n\tbehalf of both the appellants has expired. Therefore, this Court has<br \/>\n\tissued notice to both the appellants informing them to remain<br \/>\n\tpresent before the Court personally or by an advocate or someone by<br \/>\n\tlaw authorised to act on their behalf. The said notice has returned<br \/>\n\tunserved, as both of them have expired. The death certificate is<br \/>\n\talso attached along with the note at Flag A &amp; B.\n<\/p>\n<p>Upon<br \/>\n\tperusal of the copy of death certificates issued by Talati &#8211;<br \/>\n\tcum &#8211; Mantri, Kesharganj Gram Panchayat, Taluka Vadali,<br \/>\n\tDistrict Sabarkantha, it is seen that appellant No.1 Amichandbhai<br \/>\n\talias Amabhai Bhikhabhai Patel has died on 22.11.2000 and appellant<br \/>\n\tNo.2 Laliben Bhikhabhai has died on 30.06.2003. In this connection,<br \/>\n\tstatement of Dhulabhai Bhikhabhai Patel, who is brother of appellant<br \/>\n\tNo.1 and son of appellant No.2, is also recorded, who has produced<br \/>\n\tthe xeroz copies of death certificates, wherein inter-alia he has<br \/>\n\tconfirmed the death of both of them before the concerned police<br \/>\n\tofficer who has gone for serving the notice of this Court.\n<\/p>\n<p>Therefore,<br \/>\n\tthe death of both the appellants &#8211; accused is now confirmed.\n<\/p>\n<p>In<br \/>\n\tview of this, so far as Criminal Appeal No.1377 of 1993 is<br \/>\n\tconcerned, it is filed under Section 374(2) of the Cr.P.C. by the<br \/>\n\tappellants challenging the conviction and sentence, and since they<br \/>\n\tdied during the pendency of the appeal and none of their relatives<br \/>\n\thas applied to this Court within 30 days for leave to continue<br \/>\n\tappeal, the appeal filed by the appellants is abated by virtue of<br \/>\n\tproviso to Sub-section 2 of Section 394 of the Cr.P.C.
