03.   27.10. 2010            I.A. No. 2085 of 2010 is a petition for<\/p>\n
                    condoning the delay of two years and six months in<\/p>\n
                    the filing of this appeal.\n<\/p>\n
                             Learned counsel for the appellant submits<\/p>\n
                    that the appellant is continuously in custody since<\/p>\n
                    19.01.2005 and that on the date of trial-court’s<\/p>\n
                    judgment i.e. 28.01.2008 also he was in custody.<\/p>\n
                    Further submission is that due to the long<\/p>\n
                    incarceration of the appellant, there was none to<\/p>\n
                    arrange money for filing of the appeal.        Learned<\/p>\n
                    counsel says that anyhow the appellant’s father had<\/p>\n
                    tried to engage a counsel by executing Vakalatnama<\/p>\n
                    but the father died and thereafter the filing of appeal<\/p>\n
                    could not be finalized. Learned counsel continues to<\/p>\n
                    submit that anyhow the appellant requested his<\/p>\n
                    relatives to arrange for some money and get the<\/p>\n
                    appeal filed and that thereafter with the help of his
\n                            2<\/span><\/p>\n
       relatives the appeal was filed.\n<\/p>\n
                  Learned counsel for Union of India does not<\/p>\n
       oppose the prayer for condoning the delay.<\/p>\n
                  In the facts and circumstances the delay in<\/p>\n
       filing of this appeal is condoned and the I.A. is<\/p>\n
       allowed.\n<\/p>\n<\/p>\n
